Min 07/02/2013 1 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building July 2, 2013 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present. Glenn Barham - Mayor Michael Smith Councilors Ben Hoover Annetta Dotson - Brian Hooker - Tim Ingle - Mary Ward - Darron Leiker - City Manager Miles Risley - City Attorney Renae Benham - Acting City Clerk Mayor Barham called the meeting to order. Item 2a Reverend Cheryl Murray of Wesley United Methodist Church gave the invocation. Item 2b Mayor Barham led in the Pledge of Allegiance. Item 3 Mayor Barham recognized Mr. Curtis Benton, Heavy Equipment Operator, Public Works -- Street Department, as Employee of the Month for July 2013. Mayor Barham presented Mr. Benton with a plaque, a letter of appreciation, restaurant tickets and a check. 2 Item 4 Jim Ginnings, 5201 Taft Blvd., spoke on the water issues. He offered support and encouragement in the re-use project and the efforts the City is making and offered thanks for all the City is doing and continues to do. Russell Nettles, 902 River Oaks Drive, Austin, Texas, spoke on the fireworks signs at the city limits stating that having fireworks in a motor vehicle is illegal. He requested that the fireworks signs be taken down due to a question of legality. Mr. Nettles feels the signs are incorrect and that they need to be taken down. Mayor Barham responded that the signs are legal according to our attorney. Mayor Barham further stated that nobody would receive a citation for having fireworks in their vehicle. Where they may run into issues is when they take them out of that vehicle and try to discharge them. Mayor Barham added that the signs would come down after the 4 th and may be reworded for the next fireworks season but that is up to the legal department. Keith Cameron, 2620 Elmwood, spoke on the engineering projects currently underway. He asked if we have a city engineer on staff. He was introduced to Russell Schreiber, the Public Works Director. He stated it seems like we are always going out for our engineering projects. Mayor Barham informed Mr. Cameron that we have five engineers on staff who remain busy 40 hours a week with projects. Mr. Cameron said he was just wondering why we seemed to be farming out all of this contracting when our own engineering staff should be able to handle it. Mayor Barham responded that we have more work to do than five engineers can take care of. City Manager, Darren Leiker, added that we have so many projects we would have to hire 25 engineers to keep up with the projects so that is the reason we contract some of the work out. The other reason is we hire for these specialized projects engineering firms with specialized expertise. Item 5 Approval of the Minutes of the June 18, 2013, Council meeting was tabled until the next meeting. Item 6 City Manager gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Smith that the Consent Agenda be approved. Motion seconded by Councilor Dotson and carried by the by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None Minutes of the following boards and commissions were received. (a) Reinvestment Zone#2 Tax Increment Financing Board, February 8, 2012 3 Item 7a RESOLUTION NO. 65-2013 Resolution Awarding Bid For The City's Estimated Annual Supply Of Unleaded Gasoline And Diesel Fuel To BMH Oil Company. Moved by Councilor Smith that Resolution No. 65-2013 be passed. Motion seconded by Councilor Ingle and carried by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None Item 7b RESOLUTION NO. 66-2013 Resolution Authorizing The City Manager To Apply For Grant Funds To The Edward Byrne Memorial Justice Assistance Grant Program In The Amount Of $36,518.00 With Co-Applicant, Wichita County Sheriffs Office. Moved by Councilor Ward that Resolution No. 66-2013 be passed. Motion seconded by Councilor Dotson and carried by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None Item 7c RESOLUTION NO. 67-2013 Resolution Authorizing The City Manager To Submit An Application To The United States Air Force Static Display Program For A T-38 Talon To Be Displayed At Wichita Falls Regional Airport. Moved by Councilor Ward that Resolution No. 67-2013 be passed. Motion seconded by Councilor Ingle and carried by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None 4 Item 7d RESOLUTION NO. 68-2013 Resolution Approving The Programs And Expenditures Of The Wichita Falls Economic Development Corporation (WFEDC)And Amending The Budget To Include Up To $928,800 For The Eagle Rail Car Services Recruitment Project. Moved by Councilor Smith that Resolution No. 68-2013 be passed. Motion seconded by Councilor Ingle and carried by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None Item 8a City Manager, Darron Leiker, presented one staff report, an update to the impound facility. Chief of Police, Manuel Borrego, stated that since the opportunity to acquire some space, including some office space, at 3101 Armory Road, impounding of vehicles began April 1 and since that time they have actually occupied the building. Chief Borrego presented a slide show to give an update on the progress at the location. Item 8b Members of the City Council presented the following matters. Councilor Dotson wanted to thank the City staff that went out last week in the District and a couple of people from the City drove around, and wanted to say thank you for that. The citizens do appreciate the City taking time out for that. She also asked that everybody please take a moment to pause for all of our military members and first responders who gave the ultimate sacrifice for all of us and to just remember that freedom is not free and that people did die for all of us and just have a safe 4"'of July. Councilor Ward agreed with Councilor Dotson there are a lot of military people here that have been in the war, a lot of people work in the City that have been military before and wanted to offer appreciation to those that serve our country and fight for our freedom. She offered thanks and a blessed 4"'to all. Councilor Ingle stated that wildfires are a large concern at this time and offered appreciation to John Reese and his staff on the ready-set-go program. He expressed concern that it did not get the publicity that it needed and knows that people talked about it, but is concerned that people do not take the wildfire risk seriously just because it is some distance away. He thanked John Reese and his staff for their work and willingness to assist in educating citizens about fire dangers. He also thanked Jim Ginnings for his earlier comments and added that a discussion regarding budget and strategy will be discussed later today. He also reminded everybody about the 4"' of July fireworks at the MPEC and encouraged the citizens to come and thank a veteran if you get the chance. 5 Item 8b continued Councilor Smith reminded everyone that fireworks are illegal to be shot in the city limits. The Fire Department will be on alert July 4t', that night, and with the support of the Police Department, will insure the safety of homeowners and property owners in the City, and stated that in the midst of the historic drought that we are in, fireworks are flammable, they start fires, and we need to realize that and abide by the rules and regulations. He also stated that the 4t' in the Falls starts at 6:00, July 4"', and the fireworks at about 9:15. He also congratulated Officer Chris Henning of the Police Department. She's been named president of the organization DARE Texas, a very high honor. She is the City's local DARE person in the Police Department's DARE unit. He also stated the Fire Department graduated their most recent academy of new fire fighters. It was held at the MPEC and was a great ceremony. He added that the crowning glory was the bagpipe and drum group from Oklahoma City. He reported in a one week period the Police Department responded to 2,949 calls and made 106 arrests. Councilor Smith ended by asking everyone to pray for rain and encouraged everyone to learn what the City is doing about the drought situation and if you cannot find these answers, call the City, that the City is here to serve its citizens. He told everyone to have a safe and happy 4"'of July. Councilor Hooker thanked the staff on the water efforts they are putting forth in trying to get that finalized and wrapped up as well as the Jenny project. He is looking forward to that project getting done. He also said he noticed how nice the right-of-ways in Wichita Falls looked in comparison to state highways he traveled coming back from Fort Worth. Wichita Falls roadways are mowed, the trash picked up and looks very nice and clean. Councilor Hooker ended by asking everyone to have a happy 4t'of July. Councilor Hoover was pleased to hear about the airport project and the museum that is going to be going forward and it does look like it is going to be a first class operation. He added that it will be a great thing for the younger generation to see what has been done 60-80 years ago and how we have progressed and how modem our Air Force is today. He further stated that it will be a great exhibit and is very excited about it and it is money well spent. He encouraged citizens to be safe on the July 4"'— to go out and have a good time, celebrate our Independence Day, and also participate in the celebration that evening. Mayor Barham added that at 9:00 on July 4"'the parade downtown will start at 9t" and Ohio and come up 9t' Street going west to the Kell House where they will have various events there for the younger kids. City Council recessed at 9:45 a.m. and reconvened at 10:15 a.m. Item 9 A Pre-Budget Workshop For Fiscal Year 2013/2014 was held.
