Ordinance Authorizing The Sale Of Excess City Owned Property
Consisting Of 0.30 Acres Located At 3800 Call Field Road To LG
Acquisitions, LLC In The Amount Of $260,520
WHEREAS, the City Council finds that the City has complied with all
prerequisites to lawfully receiving bids and conveying the property described in the
attached Survey and Field Notes at the aforementioned address, to LG Acquisitions,
LLC, as provided by relevant portions of Texas Local Gov't Code §§ 253.001, 253.008,
and /or 272.001;
WHEREAS, the prospective buyer submitted a bid of $260,520 by sealed bid.
Bids were opened on May 15, 2013 at 4:00 p.m. in a public forum, and the prospective
buyer deposited a check for $26,052 (representing 10% of the total bid) with the City's
Property Management office; and
WHEREAS, the City Council finds that it is in the public interest to sell the
property located at 3800 Call Field Road to the buyer described in this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. In consideration of the receipt of $260,520, the City Council approves the sale
of 0.30 acres located at 3800 Call Field Road, as described in the attached Survey and
Field Notes and as depicted in the attached Location and Aerial Maps, to LG
Acquisitions, LLC.
2. The City Manager is authorized and directed to execute all documents
necessary to complete the aforementioned sale and conveyance to LG Acquisitions,
LLC, subject to the covenants described in the Restrictive Covenants, with changes
as approved by the City Attorney.

Restrictive Covenants
Restrictive Covenants — 3800 Call Field Road
On July 21, 2011, the City of Wichita Falls obtained certain property described as Lot
No. One, Block No. One, Tompkins Addition to the City of Wichita Falls, Wichita
County, Texas, according to the Plat of Records in Volume 26, Page 41, Wichita
County Plat (Strategic Property). This property was obtained in order to construct the
Rhea Road /Lawrence Road Roadway Project (Project). The purpose of this Project was
to build an improved roadway intersection for the benefit of the public at Call Field,
Rhea and Lawrence Roads. The Conveyed Land constitutes a portion of this Strategic
Property coupled with a portion of what was Lawrence Road prior to Project, the
remainder of such real properties (Remainder Property) will benefit from this restrictive
covenant. The following restrictive covenant benefits the Remainder Property in that it
will increase vehicular safety while reducing visual obstructions, clutter, and visual noise
to members of the public that utilize the Remainder Property on and around Lawrence
Road. The restrictive covenant will additionally benefit all properties by ensuring that all
allowable signage will be for on- premise uses and will not be diminished by competition
from large off - premises advertising and signage.
It is understood and agreed that this conveyance is made and accepted, and the realty
is granted, on and subject to the following covenants, conditions, and other restrictions:
No billboard of any kind shall be built, placed, or erected on the Conveyed Land.
This restriction is in addition to any other restrictions stated elsewhere in this
instrument.
2. Conveyed Land shall be used for commercial purposes only. Residential uses of
any kind are prohibited.
3. The primary building materials used to construct the fagade of all structures built
upon Conveyed Land shall be brick, stone, or stucco. Structures do not include
sidewalks or parking lots.
4. Structures built on any portion of Conveyed Land shall be at least 3,200 sq. ft. A
structure that extends onto adjoining land may meet the minimum square
footage requirement by utilizing structure's area on the adjoining land.
All restrictions set forth in this instrument will apply to and run with the conveyed land,
and all successive future owners and occupants will be similarly bound by, and will have
the same right to invoke and enforce, the restrictions applicable to this conveyance as
the original parties to this instrument. Additionally, it is expressly acknowledged that the
City of Wichita Falls, as the owner of all or a portion of the Remainder Property that
benefits from this restrictive covenant, shall have the right to invoke and enforce the
restrictions applicable to this conveyance.
