CALL TO ORDER The meeting was called to order by Chairman Taylor at 2:00 p.m. Chairman Taylor then proceeded to make the following comments: a. This meeting is being broadcast live on Channel 11. It will be replayed at 2:00 p.m. daily including Saturday and Sunday until the next live meeting is aired which will be the second Wednesday of next month at 2:00 p.m. b. Motions made by the Commission members include all staff recommendations and developmental requirements listed in the staff report. Any deviations will be discussed on a case -by -case basis and voted on accordingly. c. Applicants and citizens who wish to address the Commission or answer questions from the Commission members are asked to please speak into the microphone at the podium. This meeting is being taped and there is no microphone to record statements made from the audience. PUBLIC COMMENTS No one from the audience wished to address the Commission. II1. APPROVAL OF MINUTES Ms. Metty made a motion to approve the minutes of the May 8, 2013 meeting; Mr. Anderson seconded. The minutes were approved with a unanimous vote. IV. CONSENT AGENDA Public Hearing on Final Plats The Planning & Zoning Commission recommended approval of the following plats subject to the Standard Conditions of Approval for Final Plats and Replats and any specific conditions listed: Standard Conditions of Approval for Final Plats Provide utility and drainage easements as required by utility companies and Director of Public Works. Submit water and sewer plans; street; sidewalk; and drainage plans to the Director of Public Works and water plans to the Fire Marshall. Drainage plans must be complete enough to include impact on surrounding property and include detention facilities as required by Director of Public Works. Coordinate street lighting plan and provide utility easements as required by the Director of Traffic & Transportation. Note: Approval of a plat does not imply approval of development of property in violation of the Zoning Ordinance. FINAL PLAT: Burlison Addition, Lot 1, Block 1 (June, 2013) a. Change plat date to May 2013 to correctly reflect month /date of plat submission. (Planning) b. If possible, please show city limit line on location map. (Planning) C. Move subdivision title above lot and block. (Planning) d. Please indicate storm water detention (SWD) note on plat. (Planning) e. Indicate right -of -way (R.O.W.) at two variable points along U.S. Hwy 281. (Planning) f. Please show all of the original lot to clearly illustrate the portion of the parcel being subdivided and platted. This practice will allow for thorough documentation of all platting in the city's periphery [ETJ]. (Planning) g. Provide utility slips. (Planning) h. The basis of bearings refers to the centerline of Jentsch Road, but is not shown on the map, please reflect the basis of bearings in relation to the parcel. (Public Works) j. It would appear that the Hwy 281 right -of -way in this area is consistent in its width at 100' wide, please show the east right -of -way line. (Public Works) k. All access to State roadways shall be approved by TxDOT. (TxDOT) I. Any development will require the use of on -site sewage facilities; subdivision plans may be required by TCEQ rule. Please contact the Health District for information. (Health) CARPORTS: 1. Case C 13 -19 Carport in the front setback 3806 Parker Boulevard Mr. Donisio Montez requested conditional use approval to construct a carport in the front setback at his residence on Parker Blvd. There are two (2) properties within the 200 foot notification area with carports in the front setback. Twelve (12) surrounding property owners were notified of this carport request. Four (4) or 33.33% replied in favor and none (0) were opposed. 2. Case C 13 -21 Carport in the front setback 1624 Covington Street Felipe and Angelica Orozco requested conditional use approval to construct a carport in the front setback at their residence on Covington Street. There are three (3) properties within the 200 foot notification area with carports in the front setback. Twenty -two (22) surrounding property owners were notified of this carport request. Three (3) or 13.64% replied in favor, none (0) responded as opposed, and one (1) or 4.55% replied as undecided /other. Mr. Harmon made a motion to approve the Consent Agenda; Mr. Kidwell seconded. The motion carried. V. REGULAR AGENDA Case 13 -18 Carport in the front setback 4304 Featherston Avenue Mr. Michael Martini requested conditional use approval to construct a carport in the front setback of his residence on Featherston Avenue. There are six (6) carports within the 200 foot notification area with carports in the front setback. Thirty -one (31) surrounding property owners were notified of this request. Four (4) or 12.90% responded in favor and one (1) or 3.23% responded as opposed. P & Z COMMISSION PAGE 4 JUNE 12, 2013 Mr. Odom explained anytime a negative response for a carport case is received, it will be moved from the Consent Agenda to the Regular Agenda to offer the opportunity for comments from the surrounding property owners or concerned citizens. Staff encourages the applicant to attend the meeting to answer any questions the Commission members or citizens may have. Mr. Martini stated this carport would protect his two (2) cars. Mr. Odom addressed Mr. Anderson's concern regarding the neighborhood opposition by stating the comments involved the eight (8) foot, eight (8) inch distance to the street which would be too close [to the street], would block the view of traffic, would become a safety problem, would make the neighborhood less attractive, and would make house sales more difficult. To questioning by Mr. Anderson regarding the distance cars or pickups could be parked in relation to Featherston, Mr. Odom replied there was no specific distance from the property line to the edge of the carport. He continued by stating carports in the front of a property must meet a certain criteria [specific height and number of poles] which usually will not create a visual problem. Ms. Metty stated she does not feel this carport would be an issue considering the number of surrounding carports. Mr. Harmon made a motion to approve this request; Ms. Metty seconded. The motion carried. 2. Case C 13 -20 Request for a conditional use permit for chemical storage (crop protection products, insecticides, growth regulators, and bagged fertilizer adjuvants) in a Light Industrial (LI) zoning district 1911 Sheppard Access Road Mr. John Hankins with WinField Solutions requested a conditional use permit for chemical storage within a Light Industrial zoning district at 1911 Sheppard Access Road. This existing 75,000 square foot building was previously a storage facility for Ashley Furniture. It is located in an industrial complex which is shared by various industrial uses including two (2) trucking facilities. The distance to the nearest residential area is 1,500 feet. City Fire Marshal David Collins indicated the Fire Dept. has inspected this building. It meets all International Fire Code requirements for chemical storage and has a sprinkler system throughout the building. Twelve (12) surrounding property owners were notified of this request. One (1) or 8.33% replied in favor, none (0) responded as opposed, and one (1) or 8.33% responded as undecided or other. Mr. Hankins stated this business is similar to Estes Chemical and will be using the same procedures and processes. There will be a small number of new jobs available. Mr. George Banta, property owner of two (2) surrounding properties, questioned the company's liability and how would fume contamination or explosions be handled. Mr. Hankins stated no bulk fertilizer will be onsite. There will be some flammable contents; the City Fire Marshal and his company's Environmental Health and Safety team, are comfortable with their appropriate exposures. He continued by stating the amount of chemicals would have minimal inhalation hazards. Hazardous materials are drop shipped from the manufacturer directly to the customer and will not be stored at this facility thus eliminating any exposure for the Wichita Falls area. Mr. Banta asked if there was liability insurance for nearby properties. Mr. Hankins stated he would research the exact liability amount and contact Mr. Banta. P & Z COMMISSION PAGE 5 JUNE 12, 2013 Ms. Payne asked where the chemicals were currently being stored. Mr. Hankins stated they are in the warehouse at this location. He explained he was not aware a conditional use would be required; however, he contacted Mr. Odom as soon as he discovered this was the proper procedure. Mr. Hankins contacted the Fire Marshal as soon as the move in March was scheduled. Mr. Anderson asked if his business was reviewed by OSHA, EPA or other similar regulating bodies. Mr. Hankins replied there is annual review by Texas Dept. of Agriculture (TDA) which also serves as the EPA review. The facility is inspected as well as the records are reviewed. Mr. Anderson then inquired about the security system for his facility. Mr. Hankins stated the building is locked and there is a security system. Mr. Banta commented that the Fire Marshal stated there was minimal risk at this facility. Mr. Hankins stated this facility's primary risk might be a leak or puncture of products. They have security procedures for all types of accidents. If there should be a catastrophic event, he has expert personnel he can contact for assistance. Chairman Taylor stated he was glad to see an increase to the job market for our city. Mr. Wingo made a motion to approve this request; Ms. Metty seconded. The motion carried. 3. Case C 13 -22 Conditional use approval to place a manufactured home in a Residential Mizxed Use (RMU) zoning district 1204 Borland Lane Mr. Joseph Ross, Jr. requested a conditional use permit to locate a new manufactured home in an RMU zoning district at 1204 Borland Lane. This area was developed in 1925 as single family residential and through the years several single -wide mobile homes have been located there. Eleven (11) surrounding property owners were notified of this request. Six (6) or responded in favor and none (0) were opposed. Ms. Metty asked the applicant about the skirting, Mr. Ross commented he plans to get a carport first then install the skirting. Ms. Payne made a motion to approve this request with the condition that brick or stone skirting be placed on the new manufactured home; Mr. Anderson seconded. VI. OTHER BUSINESS City Council Update Mr. Odom reported there were no items from this Commission that required City Council action during the last month. VII.
