Ordinance amending the Fiscal Year 2025-2026 budget to authorize an
emergency purchase of a replacement refuse collection unit in the
amount of$392,796.00
WHEREAS, Section 102.009 of the Texas Local Government Code authorizes the
City Council to authorize an emergency expenditure as an amendment to the original
budget in a case of grave public necessity to meet an unusual and unforeseen condition
that could not have been included in the original budget through the use of reasonably
diligent thought and attention; and,
WHEREAS, a City refuse collection unit was being towed to a repair facility when,
en route, the tow contractor drove beneath a low bridge on East Scott Street, causing the
refuse unit to strike the bridge and be totaled; and,
WHEREAS, the loss of this refuse unit significantly reduces the City's operational
refuse collection fleet and impairs the City's ability to provide regular and reliable solid
waste collection services; and,
WHEREAS, the reliable collection and removal of solid waste is essential to the
protection of the public health, safety, and sanitation of the City and its residents, and the
continued loss of this unit from service constitutes a grave public necessity; and,
WHEREAS, the sudden destruction of the refuse unit in a collision while under
third-party tow is an unusual and unforeseen condition; and,
WHEREAS, this condition could not have been included in the original budget
through the use of reasonably diligent thought and attention; and,
WHEREAS, funds are available, and the City Council finds it necessary to amend
the budget to appropriate $392,796.00 from the Sanitation Fund for the purchase of a
replacement refuse collection unit; and,
WHEREAS, the City is pursuing recovery from the tow contractor and its insurer,
and any proceeds recovered shall be credited to the Sanitation Fund to offset the cost of
the replacement unit; and,
WHEREAS, the City Council finds that the need to amend the budget constitutes
an emergency, a grave public necessity, and an unusual and unforeseen condition that
could not, by reasonable diligence, have been included in the original budget for the
current fiscal year, and that this ordinance should take effect immediately upon its
passage for the immediate preservation of the public peace, health, and safety.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS:
SECTION 1 . The FY 2025-2006 budget is hereby amended to appropriate
$392,796.00 from the Sanitation fund to the Fleet fund for the purchase of a replacement
refuse collection unit.
SECTION 2. The City Council finds that this appropriation is an emergency
expenditure made in a case of grave public necessity to meet an unusual and unforeseen
condition that could not have been included in the original budget through the use of
reasonably diligent thought and attention, as authorized by Section 102.009 of the Texas
Local Government Code.
