Resolution authorizing the emergency purchase of one 2027 Mack
TE64 w/ Labrie/Wittke Commercial Front-Loading Refuse Body from
Bruckner Truck Sales, Inc., in the amount of$392,796.00
WHEREAS, a City refuse collection unit was being towed to a repair facility
when, en route, the tow contractor drove beneath a low bridge on East Scott Street,
causing the refuse unit to strike the bridge and be totaled; and,
WHEREAS, the loss of this refuse unit significantly reduces the City's
operational refuse collection fleet and impairs the City's ability to provide regular and
reliable solid waste collection services; and,
WHEREAS, the City Council finds that Bruckner Truck Sales, Inc., is offering
one 2027 Mack TE64 w/ Labrie/Wittke Commercial Front-Loading Refuse Body,
through the H-GAC Purchasing Cooperative, and it is in the City's best interest to
purchase equipment in accordance with the Cooperative Purchasing Programs; and,
WHEREAS, Texas Local Government Code §252.022 exempts items
purchased through interlocal cooperative purchasing contracts from the State's
competitive bidding requirements; and,
WHEREAS, the City Council of the City of Wichita Falls has passed a
resolution approving the participation in such cooperative agreements.
NOW, THEREFORE, BE IT BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
City Manager is authorized to execute all documents, as approved by the City
Attorney, necessary to purchase one 2027 Mack TE64 w/ Labrie/Wittke Commercial
Front-Loading Refuse Body, through the H-GAC Purchasing Cooperative, from
Bruckner Truck Sales, Inc., in the amount of $392,796.00.
