Resolution authorizing the execution of an Interlocal Cooperation
Contract between the City of Wichita Falls and the Texas Department
of State Health Services for mobile food inspection services;
authorizing the City Manager, or his designee, to execute all necessary
documents.
WHEREAS, House Bill 2844 was passed during the 89th Legislative Session; this
modified the regulation of mobile food vendors in Texas; and,
WHEREAS, DSHS had to modify the existing Texas Food Establishment Rules
(TFER) to create a new rule set in the Texas Administrative Code (TAC 25.226) to
address the regulation of mobile food vendors; and,
WHEREAS, effective July 1 , 2026, every mobile food vendor operating in Texas
must have a Mobile Food Vendor License issued by DSHS in order to operate; and,
WHEREAS, the Health Department and the Texas Department of State Health
Services (DSHS) desire to enter into a contract to establish responsibilities of both
agencies regarding mobile food inspection services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The Interlocal Cooperation Contract by and between the City of Wichita Falls and
DSHS for mobile food inspections is hereby approved, and the City Manager or his
designee, is authorized to execute said Agreement, in a form as approved by the City
Attorney, on behalf of the City of Wichita Falls.
