Ordinance Canvassing The Returns Of The General Municipal
Election Held In The City Of Wichita Falls, Texas On May 11, 2013
WHEREAS, the City Council of the City of Wichita Falls has heretofore called for
a General Election ("the election") to be held in said City on May 11 , 2013, to elect a
Councilor At Large, Councilor District 1 , and Councilor District 2;
WHEREAS, on March 19, 2012 City Clerk Lydia Ozuna certified to the
Canvassing Authority that Steve Whitson, candidate for councilor at large was
ineligible; however, in compliance with the Texas Election Code and direction of the
Secretary of State, his name was not omitted from the ballot,
WHEREAS, election officers who held the election have duly made the returns
of the results thereof, and said returns have been duly delivered to the Canvassing
Authority;
WHEREAS, it is hereby officially found and determined that the meeting at which
this ordinance was passed was open to the public, and public notice of the time, place
and purpose of this meeting was given, all as required by the Texas Government Code;
and
WHEREAS, after canvassing the official returns of the election, it was found to
be duly and legally held in all respects, and that 1323 voters voted in the election,
and that votes were cast as follows:
COUNCILOR AT LARGE:
Steve Whitson (Ineligible) received 179 votes
Michael L. Smith received 994 votes
COUNCILOR DISTRICT 1 :
Ben Hoover received 320 votes
Robert Frischer received 120 votes
COUNCILOR DISTRICT 2:
Donnie Melton received 71 votes
Annetta Pope received 277 votes
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The election was in all respects legally held in accordance with the laws of the
State of Texas and the Charter and the Ordinances of the City of Wichita Falls.
The City Council officially finds, determines and declares the results of the
election to be that:
Michael L. Smith was duly and legally elected Councilor At Large;
Ben Hoover was duly and legally elected Councilor District 1 ;
Annetta Pope was duly and legally elected Councilor District 2.
