Charter Review Committee Minutes - 10/28/2019 MINUTES OF THE CHARTER REVIEW COMMITTEE October 28, 2019 Present: Mayor Stephen Santellana § Committee Members Councilor Jeff Browning § Councilor Bobby Whiteley § Glenn Barham § Darrell Coleman § Michael Smith § Paul Menzies, Assistant City Manager § City Staff R. Kinley Hegglund, Jr., City Attorney § Marie Balthrop, City Clerk § 1. Call to Order Mayor Santellana called the meeting to order at 3:02 p.m. 2. Approval of Minutes (09/23/2019) Glenn Barham moved to approve the minutes from September 23, 2019. The motion was seconded by Darrell Coleman and it carried unanimously. 3. Workshop Kinley Hegglund reviewed sections 54-64, and 130 — 154 and the following changes were proposed: Section 57 — Glenn Barham suggested removing the word "thereon" from the third sentence, and removing the word "but" and starting a new sentence with the word "Pending" to begin the fourth sentence. Section 60 — It was suggested to strike the entire fourth paragraph. Section 64 - Remove the word "therein" from the second sentence in the second paragraph. Section 130 — It was suggested to remove all of Section 130 and replace with the following: "The City Council may create, maintain, and abolish such municipal courts of record, as authorized by state law." 2019 Charter Committee Minutes of October 28, 2019 1 Section 131 — It was suggested to change the title of the section to Public Information, and revise as follows: "Subject to the provisions of the Texas Government Code Chapter 552 and any successors, all accounts and records of every office and department of the city must be open to the public at all reasonable times, except records and documents from which Texas Government Code Chapter 552 and any successor may allow." Section 132 — It was suggested to strike the first four paragraphs and replace with the following: "Should any member of the City Council have a conflict of interest pursuant to any State laws or municipal ordinances regulating conflict of interest of municipal officers, with an agenda item then before the City Council, he will openly declare same before discussion proceeds, and he will be prohibited from discussing the item or voting on the question if such is required by State law. Said member of the City Council will also file the appropriate conflict of interest paperwork prior to said meeting with the City Clerk as required by State law. No member of the City Council shall enter into a written contract with the city where the council member will receive a financial benefit, nor will the city enter into a contract with a company owned wholly, or in part, by a member of the city council or that employs a member of the city council." 6.
