Ordinance Partially Closing And Abandoning An Approximately 826
Square Foot Portion Of The Alley Between 3103 Kemp And 2405
Piedmont Subject To The Removal Of An Oncor Utility Pole And
Retaining The Entire Alley As A Utility Easement
WHEREAS, Mike Wheat, with Wichita Falls Construction, on behalf of the
owners of 3103 Kemp Boulevard, has requested the City partially close, vacate and
abandon 826 square feet of the alley located between said property and 2405
Piedmont; and
WHEREAS, all affected utility companies and City departments have reviewed
this request and have recommended conditional approval to close, abandon, and
vacate this alley, subject to removal of an electrical pole and retention of the entire area
as a utility easement; and
WHEREAS, it has been determined to be in the best public interest to close,
vacate, and abandon said alley as herein indicated on the attached Location Map and
Exhibit "A."
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1 . The portion of alley located between 3103 Kemp And 2405 Piedmont, as
described above and as depicted in the attached Location Map and Exhibit "A"
consisting of approximately 826 square feet, is hereby closed, abandoned, and
vacated, subject to the removal of a utility pole and retention of a utility easement
covering the entire area of the aforementioned alley.
2. In consideration of the receipt of $3,304.00 for the cost of the property, plus
$350.00 for the cost of the appraisal and the retention or dedication and relocation of
utilities and easements, this ordinance shall approve the closure of the aforementioned
alley.
3. The City Manager is authorized to execute a quitclaim deed to convey the
property with the retained utility easement.
