This meeting is being broadcast live on Channel 11. It will be replayed at 2:00 p.m. daily including Saturday and Sunday until the next live meeting is aired which will be the second Wednesday of next month at 2:00 p.m. b. Motions made by the Commission members include all staff recommendations and developmental requirements listed in the staff report. Any deviations will be discussed on a case -by -case basis and vote accordingly. c. Applicants and citizens who wish to address the Commission or answer questions from the Commission members are asked to please speak into the microphone at the podium. This meeting is being taped and there is no microphone to record statements made from the audience. d. Please silence all cell phone ringers during the meeting. If it is necessary for you to have a cell phone conversation during the meeting, please do so in the hallway outside this room. P & Z COMMISSION October 13, 2010 II. PUBLIC COMMENTS No one from the audience wished to address the Commission. III. APPROVAL OF MINUTES Ms. Payne made a motion to approve the minutes of the September 8, 2010 meeting. Mr. Tate seconded the motion. The minutes were approved with a unanimous vote. IV. CONSENT AGENDA Public Hearing for Final Plats The Planning & Zoning Commission recommended approval of the following plats subject to the Standard Conditions of Approval for Final Plats and Replats and any specific conditions listed: Standard Conditions of Approval for Final Plats Provide utility and drainage easements as required by utility companies and Director of Public Works. Submit water and sewer plans; street; sidewalk; and drainage plans to the Director of Public Works and water plans to the Fire Marshall. Drainage plans must be complete enough to include impact on surrounding property and include detention facilities as required by Director of Public Works. Coordinate street lighting plan and provide utility easements as required by the Director of Traffic & Transportation. Note: Approval of a plat does not imply approval of development of property in violation of the Zoning Ordinance. 1. FINAL PLAT: a. Mc Kenzie Subdivision, Lot 6 -A, Block 4 • Utility slips must be provided. (Planning) b. Westwood Garden Estate, Block 228A • Utility slips must be provided. (Planning) • Add 10' utility easement along Beverly Dr. (Oncor) 2. CARPORTS: a. Case C 10 -28 Carport in the front setback 4802 Bonny Drive Mr. Douglas Berend requested conditional use approval to construct a carport within the front setback at 4802 Bonny Drive. There are three (3) properties within 200 feet of the perimeter of this property with carports located in the front setback. P & Z COMMISSION October 13, 2010 Fifteen (15) surrounding property owners were notified of this request. Six (6) replied in favor, and none (0) responded as opposed, undecided or no opinion. b. Case C 10 -29 Carport in the front setback 1302 31St Street Mr. Delfino Maldonado requested conditional use approval to construct a carport within the front setback at 1302 31st Street. There is one (1) property within 200 feet of the perimeter of this property with a carport in the front setback. Eighteen (18) surrounding property owners were notified of this request. None (0) replied in favor; none (0) responded as opposed; and, three (3) responded as undecided or no opinion. Mr. Ash made a motion to approve the Consent Agenda; Ms. Morrow seconded. The motion carried. V. REGULAR AGENDA 1. Case C 10 -30 Request for conditional use approval to increase the height of an existing church in a Single Family Residential (SF -2) District 2101 Puckett Road Mr. David Potter, representative for First Baptist Church, requested a conditional use permit to increase the height of the sanctuary portion of the existing church located at 2101 Puckett Road. The current height is 16' -9" and the proposed height is 25' -6" for an overall increase of slightly under 9 feet. Fifteen (15) surrounding property owners were notified of this request. Three (3) replied in favor; and, none (0) responded as opposed, undecided or no opinion. Mr. Tate made a motion to approve this request; Mr. Ash seconded. The motion carried. Prior to Case C 10 -31, Mr. Odom proposed using additional site photos from all available angles to assist the Commission in their decision making process. Mr. Tate reminded Commission members that performing site checks would help resolve some of the particulars of a case. 2. Case C 10 -31 Request for conditional use approval to allow the location of a manufactured home in a Single Family Residential (SF -1) District 4216 Iowa Park Road Chad and Brandi Wilson requested the placement of a new 32 'x 86' manufactured home on a 21 -acre tract of land located at 4216 Iowa Park Road. The applicants currently own a contractor's yard at this location. They wish to locate this home towards the rear of the property in order to reside there. The Planning staff recommended approval with the condition that brick or stone skirting be constructed around the base of the home. P & Z COMMISSION October 13, 2010 Five (5) surrounding property owners were notified of this request. No (0) replies were received. Mr. Wilson, the property owner, requested the use of a steel composite deck for the front of the manufactured house, in lieu of the brick skirting, and stone landscaping to further screen the base of the house. He stated the manufactured home will set back approximately 1,300 feet from the front of the property and the recommended skirting would not be visible. Mr. Wilson requested an allowance for additional time of 90 days to complete the decking and landscaping. In order to comply, he would need the brick skirting to be completed prior to occupancy permit issuance. Mr. Taylor questioned the recommendation of brick skirting. Mr. Tate stated the base of the manufactured house would not be visible from the street due to the distance. He felt the use of brick skirting, in this case, was not necessary. Mr. Wilson concluded by saying this additional work would create a "custom" appearance. Chairman Nelson suggested an amendment to the original motion to address Mr. Wilson's two requests. Ms. Payne made a motion to approve the conditional use with the condition the applicant be granted 90 days beyond issuance of the occupancy permit for the installation of the decking, stone work, and landscaping in lieu of brick skirting. Mr. Stephenson seconded and the motion carried. 3. Case C 10 -32 Request for conditional use approval to allow for the location of a package store in a General Commercial (GC) District 5316 Southwest Parkway James Wong, applicant for the property, requested conditional use approval for the location of a package liquor store at 5316 Southwest Parkway. The site is currently vacant and is close to the northwest corner of Southwest Parkway and Barnett Road. The site plan indicates a drive - thru window on the west side of the building. Eighteen (18) surrounding property owners were notified of this request. Two (2) responded in favor, and six (6) responded opposed. Chairman Nelson asked what type of alcohol permit the adjacent convenience store currently holds. Mr. Odom stated they have a wine and beer license. Mr. Kidwell made a motion to approve this request; Mr. Stephenson seconded. The vote was eight (8) in favor and one (1) opposed. The motion passed. 4. Case C 10 -33 Request for conditional use approval to allow the location of a manufactured house in a Single Family (SF -2) District 417 N. Beverly Applicants, Stephen and Janet Ford requested the location of a 30' -8" x 48' manufactured home on a 1.28 acre tract at 417 North Beverly. The applicants currently live on this site in an existing home. They plan to add an accessory dwelling to the north end for family members. Staff recommended the placement of brick or stone skirting around the base. P & Z COMMISSION October 13, 2010 Twenty -one (21) surrounding property owners were notified of this request. Two (2) responded in favor, and three (3) were opposed. Mr. Odom read a letter to the Commission from a neighbor addressing setback issues, aesthetics, and site orientation. Mr. Stephenson requested a frontal view of the proposed home. Mr. Odom stated the required setbacks are 25 feet from N. Beverly and 15 feet from Northeast Drive. Chairman Nelson stated the recommendation is to include brick or stone skirting at the base; Mr. Ford agreed. Mr. Odom noted the parking requirement has been met with the addition of a two -stall carport, plus room for additional vehicles on the circular driveway. Mr. Ford commented he has an enclosed two -car garage on the property. Mr. Taylor questioned the deed restrictions; Mr. Odom replied the City does not enforce deed restrictions. He then noted that mobile homes are not permitted but manufactured homes are not addressed. Mr. Taylor made a motion to approve this request; Mr. Kidwell seconded. The motion carried. VI. OTHER BUSINESS City Council Update Mr. Odom stated the Planning and Zoning Commission did not have any items at the last City Council meeting. VII. ADJOURN The meeting adjourned at 2:33 p.m. L. O.
