CALL TO ORDER The meeting was called to order by Chairman Berg at 2:05 p.m. ♦ Members ♦ Alternate #1 ♦ Council Liaison ♦ City Staff ♦ Members ♦ Alternate #2 Chairman Berg noted that all motions made at this meeting will include all staff recommendations and developmental requirements listed in the staff reports. Chairman Berg stated that the following cases had been withdrawn: R 04 -04 Rezoning application for 2701 Princeton; Case 04 -13 Conditional Use request for mini - storage buildings at 2701 Princeton; and the request to close a portion of Rama Drive and Gene Drive. II. APPROVAL OF MINUTES Ms. Cleary made a motion to approve the minutes of the March 10, 2004 meeting. Mr. Nelson seconded the motion. The minutes were approved with a unanimous vote. III. CONSENT AGENDA 1. Public Hearing on Preliminary Plats — no plats were submitted PLANNING & ZONING COMMISSION APRIL 14, 2004 PAGE 1 2. Public Hearing on Final Plats The Planning & Zoning Commission recommended approval of the following plats subject to the Standard Conditions of Approval for Final Plats and Replats and any specific conditions listed below: Provide utility easements as required by utility companies and Director of Public Utilities, and drainage easements as required by Director of Public Works. Submit water and sewer plans to the Utilities Engineer; water plans to the Fire Marshall; and street, sidewalk and drainage plans to the Director of Public Works. Drainage plans must be complete enough to include impact on surrounding property and include detention facilities as required by Director of Public Works. Coordinate street lighting plan with Director of Traffic & Transportation, if underground electric utilities are to be provided. Note: Approval of a plat does not imply development of property in violation of the Zoning Ordinance. 1. Bluebonnet Park Addition, Section Eight, Block 6, Lot 45 (Apr. (PUBLIC WORKS) Mr. Sons made a motion to approve the Consent Agenda. Mr. Rowland seconded the motion. The Consent Agenda passed with a unanimous vote. IV. REGULAR AGENDA 1. Bluebonnet Park Addition, Section Eight, Block 6, Lot 45 (Apr. '04) a. Provide utility slips. b. Final plat does not match current preliminary plat; to correct this, revise plat and dedicate street as shown on Preliminary Plat. Construct street or escrow funds as required by Subdivision Ordinance. C. Place 25' building limit line adjacent to future street. d. Extend public street to serve proposed lot. (PUBLIC WORKS) e. Construct internal street according to City of Wichita Falls criteria. (PUBLIC WORKS) f. Extend water and sewer to serve proposed lot. g. Provide stormwater detention for proposed lot according to City of Wichita Falls ordinance and criteria. (PUBLIC WORKS) h. Verify easement between Lots 29 and 30. (PUBLIC WORKS) j. Provide temporary turn - around as required by Public Works. (PUBLIC WORKS) Mr. Barr made a motion to approve this plat; Ms. Cleary seconded. The vote was unanimous in favor of approval. 2. High Point Village, Section 6 (Apr. '04) a. Provide utility slips. b. Provide volume and page for easements where information is not shown. C. This subdivision is zoned General Commercial, rezoning to Single Family is recommended. d. Show existing right -of -way of Rathgeber Road and label previously dedicated. e. Re -label "ONCOR" easements as "utility easements." f. Extend water and sewer to serve all proposed lots. g. Construct internal street according to City of Wichita Falls ordinance and criteria. (PUBLIC WORKS) h. Provide stormwater detention for proposed development area, according to City of Wichita Falls ordinance and criteria. (PUBLIC WORKS) i. Provide curb and gutter construction, or escrow amount, for Rathgeber Road. (PUBLIC WORKS) j. Coordinate with owner of Tesco easement prior to the dedication of the utility easement that is overlapping existing Tesco easement. (PUBLIC WORKS) k. No public playground or park in subdivision. (PARKS) I. Additional easements will be needed prior to approving final plats. (ONCOR) M. Ten foot (10') dedicated easements will be needed along east and west rights -of- way of Ricci Street. Mr. Barr abstained from the discussion and voting on this case. Mr. Sons made a motion to approve this plat. Mr. Nelson seconded. The vote was seven in favor and none were opposed. 3. Case C 04 -09 Carport 3019 Huskie Drive Mr. Robert Wachsman requested a carport to be located within the front setback of his residence. There are two properties within 200 feet of his residence that have carports in the setback. Eighteen surrounding property owners were notified of this request. Seven responded in favor and none were opposed. Ms. Cleary made a motion to approve this carport request. Mr. Barr seconded. Mr. Wachsman requested the carport to assist with transporting a family member who has health concerns. The vote was unanimous in favor of approval for the carport. C 04 -10 Carport 401 East Rogers Drive Mr. Virgil Robinson requested a carport to be located in the front setback of his home on East Rogers Drive. There is one property with a carport in the setback within 200 feet of his residence. Seventeen surrounding property owners were notified of this request. Six responded in favor; none were opposed; and one responded as no opinion or undecided. Mr. Sons made a motion to approve this request. Ms. Cleary seconded. The vote was unanimous in favor of the carport. 5. C 04 -11 Package Store in General Commercial 500 North Eastside Drive Mr. Richard Ok requested a conditional use permit to locate a package store in an existing building on Eastside Drive. The building is in GC zoning and was last occupied by Uncle Ben's Chicken. Eleven surrounding property owners were notified of this request. Three responded in favor and none were opposed. Mr. Rowland made a motion to approve this permit. Mr. Nelson seconded. Mr. Ok explained that he would be moving his existing package store on Eastside Drive. He stated the new address would be a better location for his business. The vote was unanimous in favor of granting the conditional use permit. 6. C 04 -12 Carport 4316 Hughes Drive Mr. and Mrs. Grady Solomon requested a carport to be located in the front setback oftheir residence. There are no properties within 200 feet of this property that have carports in the setback. Ten surrounding properties owners were notified of this request. Six replied in favor and none were opposed. Ms. Cleary made a motion to approve this request. unanimous in favor of approval. 7. Case C 04 -14 Carport 2824 Lansing Blvd. Mr. Barr seconded. The vote was Mr. Murphy Lee McCauley requested a carport to be located in the front setback of his home There are no properties within 200 feet that have carports in the setback. One responded in favor, two were opposed, and one responded as no opinion or undecided. Mr. Rowland made a motion to approve this carport. Mr. Lane seconded the motion. The applicant and his representative were not present for this meeting. Mr. Clark stated the applicant was cautioned about deed restrictions concerning this matter. Mr. Odom stated the applicant indicated the deed restrictions had expired. Mr. Rowland stated there had been a carport started in this area but the developer sought legal measures to have it removed. Chairman Berg stated that he believed there were no carports in Fountain Park. Mr. Barr stated that he owns property outside the notification area and there are no carports in the area. Mr. Nelson asked if a carport were inappropriate. Chairman Berg stated, since there are no carports and there are [viable] deed restrictions, he felt a carport would not becompatible with the surroundings. There were no votes in favor and eight opposed. The carport request was denied. V. OTHER BUSINESS 1. Proposed Text Amendment to Zoning Ordinance Recreational Vehicle Parking The Commission requested that staff review a citizen's request to regulate the residential parking requirements for oversized recreational vehicles. The City's Legal Department provided a survey of Texas cities' parking regulations for such vehicles. Seven area photographs showing various sizes of recreational vehicles parked in front of houses were displayed in the agenda book. Mr. Odom made the following suggestions: 1. Set a limitation of vehicle length based on community standards; 2. Include commercial vehicles in the ordinance; and 3. Allow a provision for parking larger RV's in the front of houses for a limited time. Mr. Odom noted that the only regulation the City currently has addresses oversized vehicles parked in the right -of -way. He stated that complaints are rare. Mr. Odom stated that the average RV is approximately 35' long. Mr. Nelson asked if suggested language for an ordinance could be drafted. Mr. Odom stated once the size of vehicle and the restrictions were determined, the ordinance would be forthcoming. Mr. Rowland asked if RV's could be restricted to parking behind the building limit line? Chairman Berg stated the larger RV's seem inappropriate (in a residential area). Ms. Cleary mentioned that her neighbor stores their RV at an off -site location and is only at their residence when the family is preparing to go or returning from a trip. Mr. Barr commented that an RV should not extend over the sidewalk. Mr. Clark stated there are regulations prohibiting someone from living in an RV parked at a residence. Mr. Nelson commented that the pictures bothered him and he was siding with Mr. Rowland. He suggested having a workshop to review details and coordinate writing the ordinance. Mr. Odom stated he would have a draft ordinance ready for the Commission at the workshop. Mr. Birck stated some homes are set back further than the regulated 25 feet. Mr. Odom suggested the building limit line might be an appropriate measure. Mr. Odom asked if the Commission objected to parking RV's in front of the house. It was agreed. PLANNING & ZONING COMMISSION APRIL 14, 2004 PAGE 6 Mr. Burns commented that not many complaints are made regarding RV's. He suggested an ordinance based on the size of an RV, limited setbacks, and restricted length of stay at residences. VI. Public Comments Mr. Mike Patterson stated he was the citizen asking for a review of the RV parking situation. He emphasized that he does not want an overly- restrictive ordinance. He expressed concern about the timeframe in getting approval of this ordinance. Mr. Odom stated the City Attorney would determine whether this issue would have grandfathering rights. Mr. Patterson stressed that he was concerned that the length of stay be as short as possible. Mr. Birck reminded the Commission that there are storage places for RV's. Ms. Cleary noted that there are RV parks for visitors traveling through or to Wichita Falls. VII. Additional Business 1. City Council Update Mr. Clark stated that the property at 3101 Sheppard Access was approved for a zoning change to Light Industrial. VIII. Other Business Sign Ordinance: Mr. Clark informed the Commission that the sign ordinance has been distributed to the Home Builders Association and the Board of Realtors for review. It will come back for P &Z approval at the May meeting. Mr. Barr inquired about the right -of -way in the parking lot at Call Field Shopping Center, where Lawrence Road dead -ins into Call Field Road. He continued by stating there have been temporary signs but currently a large sign was placed in the right -of -way. Mr. Clark stated that staff would check into the matter. IX.
