Any deviations will be noted in the discussion period for that case. II. APPROVAL OF MINUTES Mr. Lane made a motion to approve the minutes of the April 14, 2004 meeting. Mr. Sons seconded the motion. The minutes were approved by a unanimous vote. III. CONSENT AGENDA 1. Public Hearing on Preliminary Plats The Planning & Zoning Commission recommended approval of the following plat(s) subject to the Standard Conditions of Approval for Preliminary Plats and any specific conditions listed below: Standard Conditions of Approval for Preliminary Plats Provide utility and drainage easements as required by utility companies and the Director of Public Works. PLANNING & ZONING COMMISSION MAY 12, 2004 PAGE 1 I Submit water and sewer plans to the Utilities Engineer; water plans to the Fire Marshall and street, sidewalk and drainage plans to the Director of Public Works. Drainage plans must be complete enough to include impact on surrounding property and include detention facilities as required by Director of Public Works. Coordinate street lighting plan and provide utility easements as required by the Director of Traffic and Transportation. Submit two (2) copies of corrected preliminary plat to Planning Division before final platting. Provide curb and gutter or curb and gutter escrow per City of Wichita Falls Subdivision Ordinance. (PUBLIC WORKS) Ms. Cleary made a motion to approve the Consent Agenda. Mr. Lane seconded the motion. The Consent Agenda passed with a unanimous vote. PLANNING & ZONING COMMISSION MAY 12, 2004 PAGE 3 IV. REGULAR AGENDA Case R 04 -05 Rezone from Manufactured Home Residential to General Commercial 3405, 3407 & 3315 Sheppard Access Road and 30 Locke Lane Mr. Manuel Mejia requested rezoning of 3.72 acres at 3405, 3407 & 3315 Sheppard Access Road and 30 Locke Lane from Manufactured Home Residential to General Commercial. He plans to construct small, site -built homes similar to those currently in his mobile home park. MHR zoning does not permit site -built homes and rezoning to General Commercial would allow for single - family dwellings to be constructed. Staff advised the applicant that no new single - wide manufactured or mobile homes could be placed in an area zoned General Commercial. Staff is also recommended rezoning the auto repair shop, located to the south, from Manufactured Home Residential to General Commercial. Staff felt that this was inadvertently zoned MHR in 1985. Six surrounding property owners were notified of this request. Three responded in favor and none were opposed. Mr. Bradberry made a motion to recommend approval to City Council for this rezoning case. Ms. Cleary seconded. The vote was unanimous in favor of approval. Mr. Marty Martinez, representative for the applicant, was present at the meeting. The vote was unanimous in favor of the recommending approval to City Council. 2. Case C 04 -08 Carport 4719 Hollandale Avenue Mr. M. L. Bellows requested approval of a carport constructed in the front setback at his residence. He did not obtain conditional use approval or a building permit prior to construction. There were no carports located in the front setbacks within a 200 feet area of this house. Thirty -four surrounding property owners were notified of this request. Six responded in favor, one was opposed, and one responded as no opinion /undecided. The applicant stated that there is one carport across the street but not in the setback. Within a two block area, he noted there were six carports similar to the one he constructed. Mr. Sons made a motion to approve this carport. Mr. Nelson seconded the motion. The carport was unanimously approved. 3. Case C 04 -15 Carport 1901 Deer Parkway Mr. Lonzell Lewis requested a conditional use permit to construct a carport in the front setback at 1901 Deer Parkway, his residence. There are three carports in the front setbacks of homes located within 200 feet of this house. PLANNING & ZONING COMMISSION MAY 12, 2004 PAGE 4 Twenty -six surrounding property owners were notified of this request. Eight replied in favor and none were opposed. Ms. Cleary made a motion to approve this carport. Mr. Bradberry seconded the motion. The carport was approved with a unanimous vote in favor. 4. Case C 04 -16 Carport 2713 Roanoke :,. Mr. Richard Reams requested permission to construct a carport in the front setback at his residence. There are no properties within 200 feet of his home that have carports in the front setbacks. Nineteen surrounding property owners were notified of this request. Two responded in favor, none were opposed, and one responded with no opinion /undecided. Mr. Sons made a motion to approve this carport request. Mr. Bradberry seconded the motion. The carport passed with a unanimous vote in favor. 5. Case C 04 -17 Carport 4202 Blankenship Mr. Carl Chancellor requested permission to construct a carport in the front setback at his residence. There are five properties with carports in the front setback within 200 feet of this house. Twenty -eight surrounding property owners were notified of this request. Six responded in favor and nine were opposed. Mr. Lane made a motion to approve this carport request. Mr. Bradberry seconded the motion. The carport passed with a unanimous vote in favor. 6. Case C 04 -18 Carport 2315 Doris Street Mr. Dwight Ingram requested permission to construct a carport in the front setback of his residence. There is one property within 200 with a carport in the front setback. Twenty -two surrounding property owners were notified of this carport request. Two responded in favor and none were opposed. Mr. Nelson inquired about the proposed fence; Mr. Odom stated the applicant might be able to locate the fence where it is shown but it will require further investigation. Mr. Sons made a motion to approve this request. Ms. Cleary seconded the motion. The vote was unanimous in favor of the carport. PLANNING & ZONING COMMISSION MAY 12, 2004 PAGE 5 7. Case C 04 -19 Carport 1908 Central Freeway Mr. Larry Shaw requested permission to construct a carport in the front setback of his residence. There are no properties within 200 feet that have carports in the front setback. Twenty surrounding properties were notified of this request. Six replied in favor and none were opposed. Mr. Bradberry made a motion to approve the carport. Mr. Dowdy seconded the motion. The vote was unanimous in favor of approval of the carport. 8. Case C 04 -20 Carport 902 Sally Circle Mr. Hencil Robinson requested permission to construct a carport in the front setback of his residence. There are no properties within 200 feet of this house with carports in the front setback. Eighteen surrounding property owners were notified of this request. Eight replied in favor and none were opposed. Ms. Cleary made a motion to approve this request. Mr. Sons seconded the motion. The vote was unanimous in favor of approval. 9. Case C 04 -21 Recreational Vehicle Park 1701 Central Freeway East Mr. Mike Knox requested permission to construct a recreational vehicle park on a 13 -acre tract zoned General Commercial at 1701 Central Freeway East. This use requires conditional use approval in GC zoning. The proposed project will have 94 RV stalls with associated amenities. Twenty -eight surrounding property owners were notified of this request. Three replied in favor, two were opposed, and three were unmarked but expressed concerns. Mr. Odom stated one response mentioned concerns that were submitted to City staff in December, 2003, addressing the pre- construction grading and the resulting noise and dust. The City's Building and Code Administration office investigated the concerns finding there were no violations. Mr. Odom noted that there would be a privacy fence required along the Single Family side of the property. Ms. Cleary made a motion to approve this request. Mr. Bradberry seconded the motion. Mrs. Jackie Cole and Miss Natalie Cole, 2701 S. Bandera, expressed their concerns. Chairman Berg explained that their residence is in a Single Family zone; however, the property directly east of them is zoned General Commercial. He then stated that rezoning is a privilege of the landowner; the general public does not have the opportunity to rezone land they do not own. Ms. Doris Kinney, owner of 2705 and 2507 S. Bandera, stated she was also representing her neighbors, Mac Kilmore at 2709 and Curtis Brown at 2801 S. Bandera. They are long time residents in this neighborhood and fully understand this is commercial property. She PLANNING & ZONING COMMISSION MAY 12, 2004 PAGE 6 commented that she supported this proposed project. She asked if the 20 foot easement could remain to facilitate access to the rear of their properties and for utility company access. Mr. Odom stated this is a dedicated right -of -way. If this project is approved, the property will require platting and, at this time, if the City needs an alley, it will be requested. However, the City is no longer using alleys for trash collection. Mr. Stillson stated that in order for the City to require an easement, there must be a need. It was suggested that Ms. Kinney make a written request to the City's Public Works Department regarding this easement. Mr. Mike Knox, applicant, stated the site plans are being drawn and the architect is due to start once the building size is determined. The projected opening date is scheduled to be no later than December, 2004. The dust situation was reviewed by City and State officials (with no findings). Chairman Berg stated that landscaping and a privacy fence to the west would be required for this project. Mr. Devin Smith, Cornerstone Engineering, stated there would be 34 foot setback, including a fence, 10 foot landscaped area, and 24 foot driveway, from the west property line and pads where the RV's would be parked. Mr. Nelson asked about generators running, barking dogs, and curfews. Mr. Knox stated that generators are not operating when parked because there will be complete utilities. He stated this would be a five star RV park with meeting rooms and indoor swimming pool. There will be on -site management with someone living on the premises. Noise will be controlled by management. Mr. Knox described the park as having wireless Internet, cable television, picnic tables, horseshoes, and shuffleboard. The pads will be level and concrete. He stated that the (interior) roads might be shad or gravel that is compacted and sealed. There will be grass between each pad with concrete at the entrance. Mr. Odom stated the ordinance does not permit gravel drive surfaces. Mr. Smith commented that if possible, there might be gravel turnarounds similar to those at the end of an unfinished street in a subdivision. Mr. Knox stated that this project might be done in phases. Chairman Berg suggested that the last phase should be the row along the west property line in order to be less disruptive to the neighbors. Mr. Knox was agreeable, if the park was built in phases. Chairman Berg asked about the RV parking on the west side; Mr. Smith stated a revision not reflected on the site plan was made with the parked RV's facing east. Chairman Berg commented that would be a condition of approval. Mr. Knox stated the metal fence would be eight foot tall with landscaping consisting of trees and shrubs; Chairman Berg stated that would be another condition of approval. Miss Cole stated concerns about property values, constant traffic, and dust. Chairman Berg asked if she thought the landscaping might help the dust problem. Miss Cole replied it would not. Mr. Birck stated that once the project is completed, property values would not be effected. To the comments regarding dust, Mr. Birck said it was a matter of nature and fact and it accompanies development. Chairman Berg stated that any development in the city would incur some dust. Mrs. Cole stated that she was concerned about property values, noise, dust, traffic, sewers and RV owners' animals. Mr. Curtis Brown, 2801 S. Bandera, stated that with the privacy fence installed, the neighbors would not be aware of the RV's. He stated his concern was the width of the easement in the rear. Mr. Odom suggested that Mr. Brown should also write a letter to Public Works. The vote was unanimous in favor of approval of the RV park. Chairman Berg reviewed the conditions of approval: PLANNING & ZONING COMMISSION MAY 12, 2004 PAGE 7 1. Pads on west side of development (pads #101 -119) are to be turned so motor homes will face east. 2. Applicant agreed to develop pads #101 -119 (pads on west side of development) last. 3. Eight (8) foot privacy fence required on property abutting Single Family. 4. Landscaping required — especially on west side of development. An amended motion was made and seconded including the conditions. The vote on the amended motion was unanimous in favor of approval. V. OTHER BUSINESS 1. Sign Ordinance Mr. Odom presented the revised sign ordinance. He stated that it had been sent to sign contractors, the Board of Realtors, and the homebuilder's association for review. Mr. Bradberry made a motion to recommend approval of the sign ordinance to City Council. Mr. Sons seconded the motion. The Commission voted unanimously to approve the motion. 2. City Council Update Mr. Odom reported there was no business involving Planning and Zoning cases or decisions. 3. Staff /Commission Discussion Mr. Odom stated that the workshop for RV neighborhood parking was successful. He will meet with the Assistant City Attorney to review the proposed ordinance and bring it to the June P &Z meeting for review. End of televised segment VI.
