CALL TO ORDER The meeting was called to order by Chairperson Cleary at 2:00 p.m. II. Mr. Stephenson seconded the motion. The minutes were approved with a unanimous vote. III. CONSENT AGENDA 1. Public Hearing on Preliminary Plats The Planning & Zoning Commission recommended approval of the following plat(s) subject to the Standard Conditions of Approval for Preliminary Plats and any specific conditions listed below: Standard Conditions of Approval for Preliminary Plats Provide utility and drainage easements as required by utility companies and the Director of Public Works. Submit water and sewer plans to the Utilities Engineer; water plans to the Fire Marshall and street, sidewalk and drainage plans to the Director of Public Works. Drainage plans must be complete enough to include impact on surrounding property and include detention facilities as required by Director of Public Works. Submit two (2) copies of corrected preliminary plat to Planning Division before final platting. Note: Approval of a plat does not imply development of property in violation of the Zoning Ordinance. a. High Point Village, Ninth Revision (October 2006) a. Show building limit lines along Jacksboro Highway and Flo Drive, adjacent to Lots 35, Block 1, and Lot 4, Block 3. b. Show elevation contour lines. c. Draw line to distinguish between platted and unplatted lots. d. Staff recommends rezoning the residential lots to SF -2. e. Extend water and sewer to serve all lots. (Public Works) f. Construct internal streets in compliance with City ordinances. (Public Works) g. Comply with stormwater ordinance "zero impact ". (Public Works) h. No park, playground, or open space. (Parks) i. Public Hearing on Final Plats The Planning & Zoning Commission recommended approval of the following plats subject to the Standard Conditions of Approval for Final Plats and Replats and any specific conditions listed below: Provide utility easements as required by utility companies and Director of Public Utilities, and drainage easements as required by Director of Public Works. Coordinate street lighting plan with Director of Traffic & Transportation, if underground electric utilities are to be provided. Note: Approval of a plat does not imply development of property in violation of the Zoning Ordinance. 1. Lucas Addition, Block 1, Lot 1 (Oct. 2006) a. Provide utility slips. b. Comply with stormwater ordinance "zero impact ". (Public Works) c. This area normally has on -site sewage facilities. Applications and subdivision reviews will be needed. (Health) Mr. Barr made a motion to approve the Consent Agenda. Mr. Tate seconded the motion. The Consent Agenda passed with a unanimous vote. PLANNING & ZONING COMMISSION OCTOBER 11, 2006 PAGE 2 IV. REGULAR AGENDA 1. Case C 06 -30 Conditional use approval to construct an accessory building with ten (10) foot tall walls and an overall height of 16 feet and to reduce the side setback from 16 feet to six (6) feet 2100 Canyon Ridge, Lot 58 -A, Canyon Trails Subdivision The applicant applied for a conditional use permit to construct a residential accessory structure with a six -foot setback from an interior side property line. The Subdivision Ordinance requires a setback that matches the overall height of an accessory structure if the wall height is over eight feet or the overall height is over 15 feet. In this case, the wall height is ten feet and the overall height is 16 feet; therefore, a 16 -foot setback is required. Section 6 of the Subdivision Ordinance allows a lesser setback through the conditional use process if the structure is made of similar style and materials as the primary structure. Based on the plans submitted, we feel that the proposal meets the requirements and we recommend approval of this request. Fourteen (14) surrounding property owners were notified of this request. One (1) responded in favor and one (1) was opposed. Dr. Brian Hasse, property owner, stated that the purpose for this building was to store his pickup truck and to use the area for art and hobby purposes. Future uses might be as a recreation, party room, or pool house with accompanying bathroom. The south facing wall will have an exposure of eight feet. He noted that he is keeping the building in conformance with the style and structure of the house. Mr. Barr inquired about the deed restrictions. Mr. Odom stated that the City does not check deed restrictions but advises the applicant to do so. The vote was eight (8) in favor and one (1, being Mr. Barr) opposed. The conditional use permit was approved. V. OTHER BUSINESS 1. City Council Update • Ordinance Rezoning 6301 Southwest Parkway To General Commercial, And Amending The Land Use Plan Designation From Low Density Residential To Commercial. • Amendment To Article V. Outdoor Storage, And Article IV. Weeds, Rubbish And Unsanitary Matter, Chapter 46 Environment, And Sections 2000 And 3540 Of Appendix B, Zoning, Of The Code Of Ordinances. Mr. Clark stated both of the above agenda items were approved by City Council. He explained that staff is doing a survey of the screening issues and letters will be sent to people in violation of this ordinance. 2. Staff /Commission Discussions Mr. Clark reported TXDOT confirmed that Fifth Street /Seymour Highway will have two through lanes.
