MINUTES:
Call to Order
Dr. Richard Sutton called the meeting to order at 12:10 p.m.
II. Approval of Minutes
Dr. Richard Sutton requested a motion to approve the minutes of the October 6, 2006 meeting.
Robin Moreno, M.T. made a motion to approve the minutes. Dr. Beverly Stiles seconded the
motion. The motion carried.
At this time it was noted that Dr. Rains and Kathy Sultemeier, D.V.M. absence was excused.
Tobacco Ordinance — Fernando Tezaguic, Environmental Health Coordinator
Fernando Tezaguic, Environmental Health Coordinator discussed the current smoking
ordinance. He discussed the history of the ordinance and how the Health District had become
involved with the Clean Air Coalition in order to determine if there was a need to review and
update the ordinance. He also discussed the cardiovascular study performed by the DSHS
and that the City of Wichita Falls ranked poorly in part due to our current ordinance ranking as
a weak ordinance. He discussed some of the health issues associated with second hand
smoke. He introduced Kern Hogue of the American Cancer Society and member of the Clean
Air Coalition. She spoke concerning the Surgeon General's report and how according to the
report our current ordinance does not protect the citizens of Wichita Falls against second hand

smoke. She discussed the use of smoking and non - smoking sections and how even with
ventilation that patrons and workers were exposed to dangerous carcinogens. She discussed
the right of workers to work in a safe environment. Board members had questions about the
ordinance and the Health District's ability to enforce the new ordinance if it were ever passed
in particular the requirement that people not be allowed to smoke no closer than 20 feet from a
doorway. There were also questions about Clean Air Wichita Falls including who made up the
coalition and if the organization could be considered a PAC. Kern explained that the
organization is made up of representatives of different organizations in the community who
have a common desire to educate the public concerning the risk of second hand smoke and to
advocate for a stronger ordinance. She explained CAWF is not a PAC. They also had
questions concerning the funding of the organization. It was discussed that funding for the
printing of brochures and the web site had come from a Health District grant.
They also questioned whether the ordinance would put undue hardship on the restaurant and
bar establishments in trying to enforce the ordinance. There was also discussion concerning
smoking in private clubs such as the VFW. Judge Gossom noted he had been at a meeting at
the VFW and several of the members had expressed their feeling that they had fought for their
country and they should be able to smoke where they wanted. Mr. Tezaguic explained that as
long as the private clubs did not employ anyone that members could continue to smoke. Due
to time constraints, the discussion was ended.
IV. Food Score Posting — Fernando Tezaguic, Environmental Health Coordinator
A motion was made by Dr. Stiles and seconded by Bryan Press to table this item until the next
meeting.
V. Open Meeting Training Update — Lou Franklin, Director of Health
The Texas Open Meetings Act video training is to be completed by each board member on
their own by the next meeting. The online link will be forwarded by email to members who
would need to print their certificate at the end of the training. Robin Moreno, M.T. completed
the training turning in her certificate.
VI. Next Meeting Date
The next meeting will be held on February 23, 2007.
VII. Adjourn
Dr. Richard Sutton requested a motion to adjourn. The motion was made by Brian Press and
seconded by Robin Moreno, M.T. The motion carried and the meeting was adjourned at 1:00
p. M.
