The meeting was requested by Lt. James Wimeson, Fire Department, for the
purpose at ac(Adin whether or not It. Bobby Howard was eligible to take
the Captain' s examination which was given March 26, 1964. Also, Lt . Jameson
asked or a hearing reirding the grade lie made on the examination. This
question ma due to AU error in grading the papers on the day of the
examination.
Mr. Lyle Cherry presi.led at the meeting.
Mr. Jameson maintained that Bobby Howard was not eligible to take
the examintion because of a demotion which was created by ordinance (Hiange.
However, it w,is learned that Mr. Howard had held position of driver for more
than a two-year period, which is required before any applicant is eligible
to take any promotional ex imination. Mr. Poward ma de lieutenant January 6,
1962; was Join Led un,ler ordinance 2018, but was promoted back to lieutenant
June 1 , 1963, under Ordinance Number 2019. Discussion was made regarding type
of demotion. It Was decided that demotion was in compliance with ordinance
passed by the City and not tram something that the employee had done to create
the demotion. The Civil Service Commission dismissed themselves to review
the case, acid by unanimous decision ruled that from legal standpoint, Bobby
Howard was elig bft to take examination and that he remain on eligibility
list .
Second request was made by Mr. Jameson regarding error in grading of
his paper or examination which was giver March 26, 1964. Also, he asked
that the first grade be reinstated from 92.96 to 96. 11, the higher being
his grade before final
It was learned that Mr. Jameson was not present at the time of grading
right after the examirJtion was given. He told the commission that he felt
it was his duty to return to work. Mr. Cherry maintained that all men who
took examinttion have a right to be present at the time of grading of papers.

All except Mr. ,Jameson were present. It was learned that eight men were
standing nvex the director of civil service and his secretary while they
were fr.iding papers and that there was much discussion, which caused
contusio . This could have been the reason for error in the grading of
Mr. , meson' s paper. It was further discussed that applicants should
remain seAed and in silence, except for the one whose paper is being
graded.
Mr, Cherry made the statement that the director of civil service
gives the examination, but under rules promulgated by the commission.
He also said that they will attempt to make some changes for future
reference. One was that each test provide a place for signature and
must he signed by examinee. He requested that all applicants initial
any change on examination paper; also, that the director should initial
same. It was decided that materials be furnished applicants to study
before examination is given, and that materials must contain information
pertaining to that particular test. It was learned that Chief Johnson
reviewed all questions before examination was given.
Lt. William F. Carter requested that 'department head be present
at time of examination. However, Mr. Cherry said that Civil Service
Rules do not require a department head to be present.
The Civil Service Commission dismissed themselves to review the
case and ruled that commission re-examine papers of Mr. Jameson. This
procedure was taken and found that it had been graded correctly. It
was ruled that Mr. Jameson's grade remain the same.
