Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas, met in regular session at 8:30 a.m. on the above date in the Council Chambers at Memorial Auditorium with the following members present. Stephen Santellana - Mayor Bobby Whiteley - Mayor Pro Tem/At-Large Tim Brewer - Councilors Jeff Browning - Steve Jackson - Larry Nelson - Michael Smith - Darron Leiker - City Manager Kinley Hegglund - City Attorney Marie Balthrop - City Clerk Mayor Santellana called the meeting to order at 8:30 a.m. Item 2a — Invocation Michael Smith, Councilor District 1 , gave the invocation. Item 2b — Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. Item 3a — Employee of the Month — Oren Brown, Aviation, Traffic & Transportation, Public Transportation 8:31 a.m. Mayor Santellana recognized Oren Brown as the Employee of the Month for April 2023 and shared a brief video. Mayor Santellana congratulated Mr. Brown and presented him with a plaque, letter of appreciation, dinner for two, and a check, and thanked him for his service. Item 3b — Proclamation — National Telecommunicator Week, Police Department 8:37 a.m. Mayor Santellana read a proclamation proclaiming April 9-14, 2023, as National Telecommunicator Week and asked all citizens to join him in thanking these unseen first responders as they are invaluable in emergencies. These dedicated men and women deserve our heartfelt appreciation, not just this week, but every day. Item 3c — Proclamation National Public Health Week, Health Department 8:40 a.m. Mayor Santellana read a proclamation proclaiming April 3-9, 2023, as National Public Health Week in Wichita Falls and he called upon the people of Wichita Falls to observe this week by helping their families, friends, neighbors, co-workers, and leaders better understand how public health serves our community. Item 3d — Recognition of Foreign Exchange Students — Dave Clark 8:45 a.m. Dave Clark introduced foreign exchange students from Wichita County, and recognized foreign students here with their parents stationed at Sheppard Air Force Base. Mayor Santellana presented each student with a certificate and expressed his excitement and appreciation for their time in Wichita Falls. Item 4-5 — Consent Items 8:54 a.m. CITY COUNCIL MINUTES April 04, 2023 Page 2 Darron Leiker, City Manager, gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Browning to approve the consent agenda. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Jackson, Nelson, Smith, and Whiteley Nays: None Item 4 — Approval of Minutes of the March 21, 2023, Regular Meeting of the Mayor and City Council Item 5 — Receive Minutes (a) Landmark Commission, November 22, 2022 Item 6(a)i — Public Hearing 8:55 a.m. Conduct a public hearing on an ordinance to rezone 2901 City View Drive (Hicks Subdivision, Lot 1 , block 1) from Light Industrial (LI) to Single Family 1 (SF-1) zoning district and amend the Land Use Plan from Light Industrial to Low Density Residential to allow for the development of an additional residential structure. Mayor Santellana opened the public hearing at 8:56 a.m. Terry Floyd, Director of Development Services, discussed the proposed rezone and amendment to the Land Use Plan. This is a lot split to allow for a single family home that was unanimously approved by the Planning and Zoning Commission and staff recommends approval. Mayor Santellana closed the public hearing at 8:59 a.m. Item 6(a)ii — Ordinance 13-2023 8:59 a.m. Ordinance to rezone 2901 City View Drive (Hicks Subdivision, Lot 1 , Block 1) from Light Industrial (LI) to the Single Family 1 (SF-1) zoning district and amend the Land Use CITY COUNCIL MINUTES April 04, 2023 Page 3 Plan from Light Industrial to Low Density Residential to allow for the development of an additional residential structure. Moved by Councilor Browning to approve Ordinance 13-2023. Motion seconded by Councilor Jackson and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Jackson, Nelson, Smith, and Whiteley Nays: None Item 6b — Ordinance 14-2023 9:00 a.m. Ordinance making an appropriation to the Special Revenue Fund for Public Health Infrastructure Grant (PHIG) funding in the amount of $2,509,263 received from the Department of State Health Services and authorizing the City Manager to execute contract accepting same. Moved by Councilor Brewer to approve Ordinance 14-2023. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Jackson, Nelson, Smith, and Whiteley Nays: None Item 6c — Ordinance 15-2023 9:01 a.m. Ordinance accepting $187,090 for the Public Transportation Division from the Texas Department of Transportation in Federal Transit Agency funds for FY 2020 Section 5339 Bus and Bus Facilities Formula Grants. Moved by Councilor Browning to approve Ordinance 15-2023. Moved by Councilor Brewer to approve Ordinance 16-2023. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Jackson, Nelson, Smith, and Whiteley Nays: None Item 7a — Resolution 38-2023 9:08 a.m. a.m. Resolution authorizing the City Manager to Approve Change Order No. 1 and Final for the Multi-Purpose Event Center (MPEC) Parking Facility Improvements Project for a deduct in the amount of $147,433.70. Moved by Councilor Brewer to approve Resolution 38-2023. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Jackson, Nelson, Smith, and Whiteley Nays: Councilor Jackson Item 7b — Resolution 39-2023 9:10 a.m. CITY COUNCIL MINUTES April 04, 2023 Page 5 Resolution for appointment to Wichita-Wilbarger 9-1-1 District. Moved by Councilor Brewer to approve Resolution 39-2023. Motion seconded by Councilor Browning. The 9-1-1 District recommends the reappointment of Glenn Barham for a two-year term. Motion carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Jackson, Nelson, Smith, and Whiteley Nays: None Item 7c — Resolution 40-2023 9:11 a.m. Resolution approving an agreement under the Meet and Confer process to allow for creation and maintenance of multiple eligibility lists for beginning positions in the Police Department. Moved by Councilor Browning to approve Resolution 40-2023. Motion seconded by Councilor Brewer and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Jackson, Nelson, Smith, and Whiteley Nays: None Item 8a — Announcements concerning items of community interest from members of the City Council. No action will be taken or discussed. 9:13 a.m. Councilor Whiteley congratulated Oren Brown, employee of the month, and congratulated the foreign exchange students. He also recognized Wendy Presson's class for attending the Council meeting. Councilor Smith thanked the bicycle group that has volunteered to clean up the circle trail and he encouraged others to get involved. Throughout COVID there was a great need CITY COUNCIL MINUTES April 04, 2023 Page 6 for employees, and he discussed the need for people to fill vacancies at the City of Wichita Falls. He stated that recently Meals on Wheels has expanded to the entire County, and they need volunteers, and he thanked the Parks and Recreation department for the spring flowers. Councilor Brewer thanked Patsy's House for the Save Jane event he participated in. Councilor Jackson thanked the foreign exchange students, expressed his appreciation for Meals on Wheels being expanded to the County, and he gave kudos to Patsy's House for the Save Jane event. Mayor Santellana thanked the foreign exchange students, and thanked Councilors for attending meetings for him while he was unavailable. Item 9 — Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda 9:20 a.m. Scott Poenitzsch, 3399 Peterson Road S., Iowa Park, addressed the Council as the President of the Farmer's Market Association, on behalf of the board of directors, over 165 members and participating vendors and thousands of market customers. He discussed their efforts along with others to allow alcohol sales at the Farmer's Market Association location at One Life Church. Mr. Poenitzsch noted that there is a business in the same area that was granted a variance, and discussed the misinformation provided at the December 2022 Council Meeting, which he was unable to attend. The board and association membership feel the vote to not allow their variance request is retaliatory since they moved their location from City owned property, but he feels the decision is rooted in misinformation. The board and association request that the Council place the variance request on a future agenda. Joyce Stephens, 1218 N. 8th Street, addressed the Council and expressed her concern regarding no longer having access to communications from the Fire Department through Broadcastify which allows citizens to hear the location of first responder and fire calls. Notifications have stopped due to an equipment failure, and she requested the City Council consider funding the replacement of the failing equipment. Item 10 — Executive sessions 9:27 a.m. City Council adjourned into Executive Session at 9:27 a.m. in accordance with Texas Government Code §551 .074. CITY COUNCIL MINUTES April 04, 2023 PAGE 7 OF 8 City Council reconvened at 12:38 p.m. Mayor Santellana reconvened in open session and announced that no votes or polls were taken.
