Res 043-2023 Repair Flood Damage in MPEC Seminar Room with Clark Contractors 04/18/2023 Resolution No. 43-2023
Resolution authorizing the City Manager to execute all documents
necessary to repair the damage that occurred in the Seminar Room
due to flooding in the amount of $143,213 with Clark Contractors
WHEREAS, the City of Wichita Falls experienced an unexpected water line rupture
at the Multipurpose Event Center (MPEC) on December 23, 2022, that damaged the
seminar room; and
WHEREAS, Texas Local Government Code Section 252.022(a)(1) allows for the
suspension of the competitive procurement process where a public calamity has
occurred; and,
WHEREAS, the flood at the MPEC caused water damage to the seminar room of
the MPEC, and the City Council, by this action herein, has made a determination that said
public calamity exists and there is a need for the suspension of the competitive
procurement requirements in order to preserve the property of the municipality.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The City Manager is hereby authorized to execute all documents in forms
approved by the City Attorney with Clark Contractors for the remediation and repair of the
seminar room within the MPEC in a form approved by the City Attorney.

The following are clarifications included in our Proposal:
a. Assumes work to be completed in one phase/mobilization.
b. All work to be performed during the following work hours(Mon—Fri 7:00 AM—5:00 PM and
Sat—Sun 8:00 AM—5:00 PM).
c. Payment and Performance Bond is included.
d. Current market material pricing.Due to market volatility,price increases may be experienced
after 30 days.
e. Areas included and limited to:Seminar 211,Booth 212,Dressing 209&218,Vestibule 219,
Toilet 208.
f. Finishes are based on Construction document plans and specifications provided by GAK,dated
October 10,2022.
g. Demolition includes:
i. Demo of all carpet,base,wood chair rail throughout except handrail portion along
sloped walkway,drywall(from floor up to 4'high),wall covering and sound wall
panels(82"high along south wall of seminar room).At vanity locations,drywall to be
removed up to the face of the vanity.
h. Rough Carpentry includes:
i. Construction cleaning,waste removal,protection of finish work,removal and re-
installation of existing seminar room seating.
i. Drywall includes:
i. Replace drywall from floor up to 4'high throughout and up to 82"high at sound wall
panels.Assumes 1 layer of drywall only.
j. Carpet&Resilient Base includes:
i. Install owner furnished carpet(CP-008&CP-010).Assumes CP-008 in Booth 112.
Furnish and install vinyl base VB-005.
k. Painting includes:
i. Prep and paint all walls throughout where previously painted or had wall covering.Also
includes painting south wall of Seminar room(82"high)where sound panels were
previously installed.
ii. Prep and paint wood chair rail/handrail(upper portion)that will remain along sloped
walkway in Seminar Room.Also paint wood crown molding throughout.
2. The following items are not included in our Proposal:
a. Any work not described as included above.
b. City permit/design review fees.
c. Texas sales and use tax.
d. Liquidated damages.
e. Testing&inspections services/fees.
f Builder's Risk Insurance.Clark Contractors,LLC and its Subcontractors and Sub-Subcontractors
shall be named as additional insureds in the Builder's Risk Policy Furnished by the Owner.
g. Unforeseen or hidden conditions.
h. Material escalation allowances are not carried in our proposal.Any price increases will be
handled via change order.
i. Environmental Survey or Asbestos report.

j. Hazardous materials remediation,abatement or removal.
k. Dehumidification or temporary mechanical equipment.
1. Liquidation and removal of all existing FF&E that is not noted as included in Demo.
m. Salvaging of any items not included in the Demo notes.
n. Utility company charges included power&water for construction use.
o. Repair or replacement of any fixed seating in Seminar Room.
p. Furnishing,storage or warehousing of carpet.
q. Removal or replacement of floor and wall tile in Toilet 208.
r. Removal or replacement of vanity counters,plumbing fixtures,toilet accessories,and mirrors.
s. Bringing existing electrical/plumbing/fire alarm fire sprinkler installations up to current code.
t. Existing fire sprinkler heads/locations to remain as is.No new fire sprinkler work is included in
our price.
u. Provide new electrical outlet/device cover plates.
v. Existing fire alarm devices to remain as is.No new fire alarm work is included in our price.
w. Any Mechanical,Electrical,Plumbing,Low Voltage,A/V work.
