Item 3b — Proclamation — National Telecommunicator Week, Police Department 8:37 a.m. Mayor Santellana read a proclamation proclaiming April 9-14, 2023, as National Telecommunicator Week and asked all citizens to join him in thanking these unseen first responders as they are invaluable in emergencies. These dedicated men and women deserve our heartfelt appreciation, not just this week, but every day. Item 3c — Proclamation National Public Health Week, Health Department 8:40 a.m. Mayor Santellana read a proclamation proclaiming April 3-9, 2023, as National Public Health Week in Wichita Falls and he called upon the people of Wichita Falls to observe this week by helping their families, friends, neighbors, co-workers, and leaders better understand how public health serves our community. Item 3d — Recognition of Foreign Exchange Students — Dave Clark 8:45 a.m. Dave Clark introduced foreign exchange students from Wichita County, and recognized foreign students here with their parents stationed at Sheppard Air Force Base. Mayor Santellana presented each student with a certificate and expressed his excitement and appreciation for their time in Wichita Falls. Mayor Santellana opened the public hearing at 8:56 a.m. Terry Floyd, Director of Development Services, discussed the proposed rezone and amendment to the Land Use Plan. This is a lot split to allow for a single family home that was unanimously approved by the Planning and Zoning Commission and staff recommends approval. No action will be taken or discussed. 9:13 a.m. Councilor Whiteley congratulated Oren Brown, employee of the month, and congratulated the foreign exchange students. He also recognized Wendy Presson's class for attending the Council meeting. Councilor Smith thanked the bicycle group that has volunteered to clean up the circle trail and he encouraged others to get involved. Throughout COVID there was a great need PAGE 6 of 8 AGENDA ITEM NO.3. for employees, and he discussed the need for people to fill vacancies at the City of Wichita Falls. He stated that recently Meals on Wheels has expanded to the entire County, and they need volunteers, and he thanked the Parks and Recreation department for the spring flowers. Councilor Brewer thanked Patsy's House for the Save Jane event he participated in. Councilor Jackson thanked the foreign exchange students, expressed his appreciation for Meals on Wheels being expanded to the County, and he gave kudos to Patsy's House for the Save Jane event. Mayor Santellana thanked the foreign exchange students, and thanked Councilors for attending meetings for him while he was unavailable. Item 9 — Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda 9:20 a.m. Scott Poenitzsch, 3399 Peterson Road S., Iowa Park, addressed the Council as the President of the Farmer's Market Association, on behalf of the board of directors, over 165 members and participating vendors and thousands of market customers. He discussed their efforts along with others to allow alcohol sales at the Farmer's Market Association location at One Life Church. Mr. Poenitzsch noted that there is a business in the same area that was granted a variance, and discussed the misinformation provided at the December 2022 Council Meeting, which he was unable to attend. The board and association membership feel the vote to not allow their variance request is retaliatory since they moved their location from City owned property, but he feels the decision is rooted in misinformation. The board and association request that the Council place the variance request on a future agenda. Joyce Stephens, 1218 N. 8th Street, addressed the Council and expressed her concern regarding no longer having access to communications from the Fire Department through Broadcastify which allows citizens to hear the location of first responder and fire calls. Notifications have stopped due to an equipment failure, and she requested the City Council consider funding the replacement of the failing equipment. INITIATING DEPT: Information Technologies & Facilities STRATEGIC GOAL: Efficiently Deliver City Services STRATEGIC OBJECTIVE: Practice Effective Governance COMMENTARY: The approved 2022-23 Budget includes $315,154 to upgrade existing server and network equipment for the City. These funds are used to replace aging and unsupported network and server equipment every fiscal year. This purchase will allow us to consolidate several servers into one appliance. This will lower our overall footprint and create redundancy that we currently do not have while reducing our annual server maintenance cost. This HPE Nimble DHCI unit carries a 5-year warranty agreement and will be deployed on our City Business Network. This device is a combination network storage device and a virtual server bank. It will complete the redundancy from the unit that was purchased for the Public Safety network last September. CDW Government LLC is a reseller for the system's manufacturer, and CDWG Government LLC is on the Texas Department of Information Resources (DIR) purchasing contract. INITIATING DEPT: Aviation, Traffic, & Transportation STRATEGIC GOAL: Efficiently Deliver City Services STRATEGIC OBJECTIVE: Practice Effective Governance COMMENTARY: On March 7, 2023, the Council rejected the lone bid for roadway striping services. The one bid received was for$161 ,780.00. Once the bid was rejected, staff worked with the Purchasing Division to rebid the project. The Wichita Falls Traffic Engineering Division has stopped using traffic paint to mark roadway surfaces. Painted pavement markings have a service life of 2-3 months on high volume roadways, but fade away quickly thereafter. To replace paint as a pavement marking, staff recommends the use of thermoplastic type materials. These materials can last up to 3-5 years, depending on traffic volumes and turning movements. These materials also have better reflectivity performance than paint, particularly at night and in weather-related driving conditions. Staff has indicated that they will have the vendor install 96,300 lineal feet of yellow and white thermoplastic pavement markings. This work will focus on higher volume roadways and Downtown. It will also address some dedicated bicycle lanes. In addition, there will be 20 "turn arrow" pavement markings replaced in this scope of work. Staff anticipates that this work will begin in May of 2023, and it will take one week to complete. Theo Stoll from the City Clerk's office issued the Oath of office to Amy Bobrowitz,Shunta McFadden, and Betty Richie, and had them fill out the Statement of elected/appointed official documentation. Celena Bradley, Children's specialist, reviewed the library's Summer Reading statistics and talked about some of the library's popular programs. She also asked that those interested in volunteering for Touch a Truck (Oct. 1, 10 a.m. to 2 p.m.) email Jana Hausburg: iana.hausburg@wfpl.net Ms. Hausburg distributed copies of a revised Conference Room Policy and a newly created Study Room Policy. Both were approved by the board. Ms. Hausburg then reviewed highlights from a meeting she attended on Sept. 9th held by Partners Library Action Network (PLAN). Primarily of interest was a report by Wendy Woodland from the Texas Library Association (TLA) regarding the upcoming 88th Texas Legislative Session (starts Jan. 10, 2023): PAGE 1 of 2 AGENDA ITEM NO. 5.a • Access to materials: TLA will continue to promote and support school librarians specifically and librarians in general as experienced, educated professionals who select books to reflect their student population (community) • Education: TLA will continue to protect the right to read and stress the importance of intellectual freedom • Economic development • Expect bills that will tighten obscenity definition and remove the education exemption in Penal Code Section 43.24 --this could have significant impact on public libraries • Promoted TLA's help line for those librarians who experience challenges • Helping promote a grassroots organization: Texans for the Right to Read: righttoreadtexas.com #righttoreadTX Ms. Hausburg discussed the library's process when receiving a Library Materials Complaint Form. In August 2022, the Museum of North Texas History gave a presentation to Council with recommendations of what to sell and what to restore/preserve of the historical artifacts and holdings. With the Council's approval, they began the arduous task of inventorying and tagging the artifacts. Some of the collection is too large for the museum to house and some is in poor condition and would require more resources to restore than they have available. INITIATING DEPT: Aviation, Traffic, & Transportation STRATEGIC GOAL: Provide Adequate Infrastructure STRATEGIC OBJECTIVE: Complete Signature Public Improvements COMMENTARY: In December of 2022, Texas Department of Transportation (TxDOT) announced a Call for Projects under the Transportation Alternatives Set Aside Program. The Program, as administered by TxDOT, provides funding for a variety of alternative transportation projects as follows: • Bicycle infrastructure improvements • ADA and pedestrian improvements • Shared use paths • Sidewalk improvements • Infrastructure-related projects to improve safety for non-motorized transportation The federally funded program, while administered through TxDOT, provides opportunities to expand transportation choices and enhance the transportation experience through categories of activities related to the surface transportation system. The grant focuses on non-traditional/non-motorized vehicle transportation projects. The City of Wichita Falls has successfully completed the first stage of the application process. As a result, TxDOT has asked the City to complete the next step and to submit a formal application. The deadline for the application is June 5, 2023. Subsequently, the City of Wichita Falls has the opportunity to fund and complete one of two final sections of the circle trail project through TxDOT's competitive grant process. This application will apply for funds to complete the section of trail that will run along the south side of the Wichita River from near the Camp Fire property to Lucy Park. Staff recommends Council's endorsement of this resolution. The City of Wichita Falls supports funding this project as described in the 2023 Transportation Alternatives Nomination Form (including the construction budget, the department's 15% administrative costs, and the required local match) and is willing to commit to the development of the project, implementation, construction, maintenance, management, PAGE 1 OF 5 PAGES AGENDA ITEM NO. 7.0 and financing. The City of Wichita Falls is willing and able to enter into an agreement with TxDOT through this resolution should the project be selected for funding. Total Project Cost: $3,428,441.00 TxDOT Transportation Alternative Set-Aside Grant (80%): $2,742,753.00 City of Wichita Falls Local Match (20%): $685,688.00 If the grant application is approved, City staff anticipates requesting the City's Type B Sales Tax Corporation (4B) continue their partnership in the Circle Trail Project by providing funds for the 20% match and related ancillary costs. S. C. §133, that nominates a particular project for consideration, exercises jurisdiction over the geographic area in which that project is located, and commits to the project's development, implementation, construction, maintenance, management, and financing; and, WHEREAS, the Transportation Alternative funds may be used for development of preliminary engineering (plans, specifications, and estimates and environmental documentation) and construction of pedestrian and/or bicycle infrastructure. These funds require a local match, comprised of cash or Transportation Development Credits (TDCs), if eligible. The City of Wichita Falls would be responsible for all non-reimbursable costs and 100% of overruns, if any, for this project; and, WHEREAS, the City of Wichita Falls, as Project Sponsor, supports funding these projects as described in the 2023 Transportation Alternatives Set-Aside Nomination Form (including the construction budget, the department's 15% administrative costs, and the required local match) and is willing to commit to the project's development, implementation, construction, maintenance, management, and financing. The project sponsor is willing and able to enter into an agreement with the Texas Department of Transportation by resolution or ordinance should the project receive Transportation Alternative funding; and, WHEREAS, the City of Wichita Falls is a public body organized and established in accordance with Chapter 458 of the Texas Transportation Code, enacted by the Legislature of the State of Texas; and, WHEREAS, the City of Wichita Falls is specifically authorized by Chapter 456 of the Texas Transportation Code of the law of the State of Texas to accept and dispense federal financial assistance. The City Council hereby authorizes the City Manager to apply for and accept funding, in a form approved by the City Attorney, in an amount of $2,742,753 for this project.
