Construction Board of Adjustment Minutes - 06/15/1989 t MINUTES OF THE BUILDING BOARD OF ADJUSTMENTS AND APPEALS Thursday, June 15 , 1989 Board Members Present : City Representatives : Randall Poteet Earl Potts Don Johnston Sam Paschal Bill Duke Michael Lam, Council Liaison Ralph Perkins John Glover Ted Litteken Board Members Absent : James Foster Regular Agenda & Business The meeting was called to order by Chairman John Glover at 9 : 20 A. M. Agenda Item #1 - Discussion of the 1988 Standard Existing Buildings Code. Mr. Glover called on Sam Paschal , City Plans Examiner, to provide a summary to the Board of the contents and purpose of the Standard Existing Buildings Code. Mr. Paschal explained that staff review indicated that the Code provided written guidelines for rehabilitation of structures that otherwise would not meet the existing code requirements. Older structures normally do not provide the same level of safety requirements as new buildings and therefore there should be some standard criteria for determining the level of upgrade necessary when the building is re-occupied and/or rehabilitated. Mr. Paschal stated that , although the Inspection Division now uses the Code for these decisions, it is recommended that the City adopt the Code as an established guide. Mr. Paschal stated that the Code provides alternate methods of construction and rehabilitation that would enable the City to preserve existing buildings and encourage the continued use of existing buildings. Several alternate construction methods as detailed by the Code were discussed. After further discussion of the Code, Mr. Glover stated that the Board should entertain a motion for a recommendation to Council . Mr. Poteet made the motion that "The Building Board of ' Adjustments and Appeals recommends that the City Council adopt the 1988 Edition of the Standard Existing Buildings Code" . The motion was seconded by Don Johnston. The recommendation was approved by a vote of six ( 6 ) for, and zero (0 ) against. Agenda Item #2 - Discussion of Building Contractor Licensing Law. Mr. Potts distributed a copy of the City ' s present contractor licensing ordinance and explained that this ordinance, although referred to as a licensing law, was little more than a registration requirement. Mr. Potts noted that several building contractors had expressed a desire to upgrade our ordinances in order to better protect property owners . It was noted that the ordinance required that contractors obtain a five thousand dollar ( $5 , 000) code compliance bond and register with the Building Inspection Division . It was noted that the ordinance contained no criteria for denial or revocation of a license and therefore anyone could, in effect , obtain a license as a building contractor in the City. Mr. Duke stated that contractors, by advertising that they were licensed and bonded by the City, may be using the ordinance to legitimize their business and give the impression to the customer that the contractor was qualified to do the work. Mr. Potts noted that, last year , many people acquired contractor licenses for roofing work that possessed little or no experience in that field. However, the present ordinance provided no procedure for denial of the license. After further discussion, it was recommended that staff contact other cities in order to see if there were established contractor licensing programs that we could review. Mr. Potts stated that he would initiate further study of a proposed program and report back to the Board at the next meeting .
