Construction Board of Adjustment Minutes - 06/08/2004 Minutes Construction Board of Adjustments and Appeals June 8, 2004 Board Members Present: City Personnel & Visitors: Jackie Lebow, Jr. (Chairman) Bobby Teague (Building & Code Harris Pink (Alternate) Administrator) Gary Oatman Jerry Gamble (Assistant Phil Ringman Administrator) Charles Barr Mark Price (City Attorney) John Ferguson Jay Lavender (Jabeauxx Roofing) Chuck Dennis (Alternate) Syd Litteken Board Members Absent: Jimmy Barnes Leo Lane The Construction Board of Adjustments and Appeals was called to order by Chairman Lebow at 2:10 PM on June 8, 2004. Chairman Lebow noted that the meeting had been called to order to hear an appeal of the Revocation of Jabeauxx Roofing License. Chairman Lebow called on Mr. Teague to state the reason for the revocation of Jabeauxx License. Mr. Teague stated that the license had been revoked due to multiple violations. Mr. Teague stated that the Building Official could revoke the license. This is stated in the code of Ordinances section 105 D. He stated that five citations had been issued for failure to purchase permits. Mr. Lavender was called upon to state the particulars of his appeal. Mr. Lavender stated that he has changed his procedures so that he is now more efficient in his business. Mr. Lavender was asked if he was an officer of Jabeau Roofing at the time of their suspension. He stated that he was not. He stated the he sold the business in 1982. He also stated he was not involved with Jabeau Roofing. Mr. Teague had information stating that he was still involved with the Jabeau Roofing when previous citations and a suspension were issued. Chairman Lebow stated that evidence presented stated that he was an officer of the Company at the time of suspension. Chairman Lebow also inquired about the citations. Mr. Teague stated that he believed that they had been paid. Mr. Teague also stated that the fines are set in the Code of Ordinances for operating without a license. He also stated the judge sets the fines issued for not obtaining a permit. Mr. Oatman asked if the board could have a short discussion among the board members. After a short recess the board returned. Motion was made by Mr. Dennis that the revocation stand. Mr. Ferguson seconded the motion and the Board voted 7-0 in favor of the motion. Next on the agenda was the discussion on allowing homeowners that are going to occupy a home be allowed to obtain a permit to remodel the home. After discussion the motion was made by Mr. Dennis to leave the ordinance as is. Mr. Pink seconded the motion. And the board voted 7-0 in favor of the motion. Regarding other business, Mr. Teague mentioned the State Electrical License and the possibility of the Electrical Board being dismembered and 2 new members being added to the Construction Board of Adjustments and Appeals.
