HE IT RESOLVED by the Board of Aldermen of the
City of Wichita Falls, Texas; that,
PH REAP, the Board of Alderson* as heretofore*
by resolution* dirsetsd the improvment of Buehanan Street
between Tenth 410th) Street and Avenue 'a'* by paving the
sus with concrete pavement and installing curbs thereon* and
ARRAS« thereafter, epeeifieations were prepared
by City Engineer, for said Improvements* and advertisement
was :made far bids therefor, and opened and considered by the
Board of Aldermen and thereafter the bid of G, •, Zimmerman
was adopted by the Board of .idermen, and
IRBR;EAS, thereafter said der prepared and
filed with the Board of Aldermen his mart* stating the total
cost of the said ltpeewssrnt, and proportion of such cost
parable by the owners of abutting property, and by street and
steam railways* and the east of such isprovessnt per front
foot of abutting property, and the names of persons* firms, oar•
porattioue or estates owning the property abutting on the prow
posed improvement* with a deaeriptt n of their property, and the
total *oat of audi improvement to each pareel of property, and

of Alderman and duly approved! and
TR .1WiSo the Board of Aldermen has finally deteraina
ed to assess a part of the Goat of said improvement against the
said owners and their property.

That it is finally determined to assess such part
of the oast of said improvement against the owners of said pre.
party and against their property* as hereinafter provided.

That a baring shall be givan to the said owners
or their agents or attorneys, and all person interested in
the said matter as to said emseaanents and as to the amount to
be assessed against each owner and his property and as to the
benefits to said property from said improvements or any other
thing in commotion herewith, which hearing shall be had in the
City Council Chaelbsr of the Oity of Wichita Pails, Texas, at
the City Sell, situated on the corner of ninth and Ohio Streets,
/ oar the 1tz day of August, A. D. 1908, until said bearing

That after the said hearing said Board of Aldermen
will by ordin• ee, assess against the meld owners of property
and against their property, suck sums as shall be determined to
be just and equitable, and that said assessment will be made in
accordance with 'the front loot plan and rule,. as the frontage
of the owner is to the whole frontage to be improved, provided
that if the said rule or plan shall be determined in any ease to
be unjust or inequitable, then that the Baird of Aldermen will
adopt such rule of apportionment as she 1 be just end equitable,
having in view the benefits to each owner, and the burdens ima•
posed upon them, provided that no assessment shall be made a.
gainet any owner or his property in excess to the benefits to
said property, in the enhanced value thereof, by means of snob
improvements.
