Min 09/08/1920 ar SEPTEMBER STH, 1920. The Board of Aldermen met in called session on the above date for the transaction of the business o` the City, with Mayor W.D. Cline presiding and Aldermen Curlee, Bralley, Bonner, :.cDowell and City Clerk Throburn in attendance. ORDINANCE NO. 305. An ordinance making appropriation for the support of the City Government of the City of Wichita Falls, for one year beginning April lst, 1920, ending March 31st, 1921. Madng appropriation and provision fir the payment of 250,000.00 of time warrants of the City, ayable to C.a.Nichols, said time warrants • being given in art payment for the construction of a sanitary sewer in the City of Wichita Falls, and making appropriation for other pur- poses hereinafter named, and declaring an emergency was on motion of Alderman Curlee seconded by Alderman Bralley placed on tts third and final reading by the following yea and nay vote: alderman Curlee yea • -bralley yea Bonner yea f! McDowell yea Mayor Cline then declared Ordinance passed on its third and final reading by all the Aldermen present voting yea. Moved by Alderman Curlee that Ordinance No 305 be passed "as read" which rotion ":.as ,onded ty Alderman Bralley and carried. Moved by Alderman Curlee that the "Mayor of the City of .:ichita Falls, Texas, is hereby authorized and empowered to borrow an amount if money not to exceed the sum of One Hundred and Fifty Thousand and No/100 ($150,000.00) Dollars, from the Banks of the City of '.ichita Falls, Texas at the rate of seven (7f) per cent per annum. Said money so borrowed is to be used for the purpose of defraying the current expenses of the City and shall be apid back as soon , as the tax money of the City comes in. the Mayor is hereby authorized to execute proper notes or evidences of debt of the City payable to the lender or lenders of said money, which shall be a binding obligation of the said City for said amount or ampunts of said notes or evidences of debt, which motion was seconded by Alderman Bonner and carrie'. Moved by Alderman Curlee that the bid of ninety cents ;er linear foot for laying of a water main on Filmore Street from Sixth Sreet to • Ninth Street be accepted which motion was seconded by alderman McDowell and carried. Moved by Alderman McDowell that Alderman Bonner be appointed • a committee of one to confer ith County officials with the object of having an audit made of the books of the Genreal Hospital which motion was sec nded by Alderman Curlee and carried. • 14 A Petition was then presented asking for the paving of three blocks on Tilden Street and Alderman Curlee moved that the following tesolu- tions be passed which motion was seconded by Aid. McDowell, and carried. FIRST RESODUTION. Be it resolved by the Board of Aldermen, City of Wichita Falls, TEAS, that it is hereby declared to be a public necessity to curb, pave and excavate Tilden STreet from Avenue D to Avenue G. Streets in the City of Wichita Falls, Texas, as hereinafter set out. To build new curb or reset old curb according to the plan and specifications made b, t e City Engineer, of _ ichita Falls, Texas, and on file in the office of the City Secretary, of Wichita Falls, Texas. To pave said street between said limits and curb lines accord- ing to the plans and s ecifications of the City Engineer of the City of Wichita Falls, Texas. Be it furthr resolved that the City Engineer be in tructed to speedily prepare a preliminary estimate of the cost of the said improvement and present same to the Board of Alderman for their approval and that the City Clerk make the proper publication of th:;se resolutions. 04. SECOND RESOLUTION. Resolution ordering the improvement of Tilden Street from Avenue D to Avenue G,Streets in the City of Wichita Falls, Texas. Be it resolved by the Board of Aldermen of the City of Wichita Falls, Texas, that he above described streets shall be improved in the follow- ing manner, to-wit: 1. That the said street shall be graded, excavated or filled. 2. That new curb be built or reset old curb and that said streets be paved between said limits and said curb lines, according to the plans and specifications to be f_zrnished therefor by the City ENGINEER OF THE City of Wi- chita Falls, Texas. 3.That the said roadway shall be paved with one of the following materials, and bids be ta';en threfor, to-wit: (a) Tarvia (b) Asphaltum. Bids shall be taken for concrete curbs, and said ' ork of imp- rovement shall be done with such of said materials and under such methods and plans as may be selected by the Board of Alderman after the bids are received. 4. That the cost of the said improvement shall be paid as follows, to-wit: (a) The City of ichita Falls, Texas, shall pay the whole cost of paving the intersections of said streets, named to be paved, with the other streets and alleys . (b) The remaining cost of such improvement shall be paid as follows, to-wit: The owners of property, abutting on said streets, named to be paved, shall pay the whole cost of installing concrete curbs in front of their respective properties and of the remaining cost, the City of Wichita Falls, shall pay one-fourth and the owners of such abutting property three fourths. That the pro •ortion of the costs herein named to be paid by the owners of abu ting property shall be paid in three equal installment as follows: one third cash, on the acceptance of t e improvement by the City of Wichita Falls, one third in one year from the date of said acceptance, and one third in two years from said date. That the said deferred payments shall bear interest at B per cent per annum from said date of acceptance provided that said owners of abutting property shall tge privilege of pa 1ng the'said assessments in whole or in part hi before maturity, with accruded interest to the date of payment. • That the proportion of said costs payable by the owners of said abutting property shall be assessed against the said owners and against their said propertu n accordance with the terms of the General Laws of the State of Texas, and in accordance with what is known as the "front foot plan or rule", as the frontage of the property on the said street named to be paved. ,rovi- ded that if the application of this rule, ' wild, in the opinion of the Board of Aldermen in particular cases, be unjust or une;ual, it will be the duty of said Board of Aldermen to assess and apportion said cost in such proportion as it may deem just and equitable, having in view the special benefits in enhanced value to be received by each owner of said )roperty, so as to produce a subst- antial equality of benefits b , and burdens imposed upon each owner. That no assessments shall be made against any such owner or his property until after notice has been given such owner and a hearing as provided by the General Laws of the State of Texas, and provided that no a:;s- essment shall be made a ainst any owner or his property in excess to the ben- efits to such property in enhanced value ther of by said improvement. That the Engineer of the City of Wichita Falls is hereby direct- ed at once to prepare specifications and file the same with the Board of Alder- men for each of the hereinabove described pavements or improvements. That, in the specifications prepared,vprovitmons shall be made for requiring all contractors to give a maintenance bond for a term of not longer than five years for the maintenance of the )averents hereinabove described. That such specifications shall require the bidder to make a bid upon the various above anamed pavements or materials of improvements; with a maintenance bond as herein provided. The said specifications shall also state the amount of the con- struction bond required to be given, as well as the method by which it is pro- posed to pay the cost of the said pavement- said method being in accordance with this resolution. THIRD RESOLUTION. Be it resolved by the Board of Aldermen of the City of /ichita Falls, that the specifications here presented to the Board of Alderman by the City Engineer, and prepared by him for the improvement of the hereinabove described streets, as heretofore defined, having been aarefully considered by the Board of Aldermen be, and the same are hereby approved and adopted as the specifications for the improvements of the said street. Be it further resolved by the Board of Aldermen that the.City Secretary be, and is hereby instructed to, at once advertise for sealed bids for the construction of said improvement provided by the said specifications; such advertiseent to appear or be inserted in the Wichita Daily Times paper, a paper of general circulation in the City of Wichita Falls, and shall runfor a period of fifteen days from the date of the first insertion in the said paper; all bids to be made subject to the terms of the General Laws of the State of Tex as in such cases made and provided. Said bids shall be filed with the City Secretary, and shall be opened at a public meeting of the Board of Aldermen. The Board of Aldermen then adjourned Read and approved this f� day of Sept.1920 Attest; «sib 4cior . 16 THE STATE OF TEXAS I COUNTY OF WICHITA I Notice is hereby given that :;here will be taken up and con- sidered by the Board., of Aldermen of the City of ichita Falls, Texas, the question of whether the City of Wichita Falls, Texas, shall borrow an amount of money not to exceed the sum Of One Hundred and Fifty Thousand and No/100 ($150,000.00) Dollars, for the purpose of defraying t'C a the current expense s of the City, at a meeting to be held at 7:30 p.m. { at the Council Chamber of the city Hall of the City of Wichita Falls, Texas, on the 8th day of September, 1'20, and any person or persons may appear before the Board of Aldermen at such time and place and will be given a full and fair hearing by said Board. Thix notice is given in accordance with the Provisions of the City Charter, Section No. 100 and shall be known as a Temporary Loan, which shall be paid back out of the receipts from taxes for the fiscal in which said loan is made.
