Bids for paving on Buc'r a Street were then opened and bid for
paving awarded to Om-merman & Co and$ ordered done by the City because of
the fact that theCity having equiprent on hand can do thework cheaper than any
contractor, and Alderman Bonner moved that the following resolution be passed
which motion was seconded by Alderman Curlee and carried.
RESOLUTIONS DETERMINING THE NECESSITY OF ASSESSING PART
OF THE COST OF IMPROVING Buchanan Street all the unpaved portion
from Tenth Street to Avenue H,STREETS AGAINST THE OWNERS OF AB-
UTTING PROPERTY, AND ORDERING TEE HEARING OF TEE OWNERS OF
SUCH PROPERTY, AND NOTICE HEREOF AND FIXING THE TINE AND PLACE
FOR'SUCH HEARING:
Be it resolved by the Board of Aldermen of the City of Tlchita
Falls, Texas. That;
WH REAS, the Board of Aldermen, as heretofore, by resolution,
directed the improvement of Buchanan Street, all the unpaved portion from tenth
Street to Avenue H Streets, by pacing the same with Concrete pavement and in-
stalling curbs thereon, and
WHEREAS, thereafter, specifications were prepared by Julian
Montgomery, City Engineer, for said improvements, and advertisement was made
for bids therefor, and opened and considered b, the Board of Aldermen and
thereafter the bid of Zimmerman & Co for said work of improvement was adopted
by the Board of Alderman, and
' WHEREAS, thereafter said Engineer prepared and filed with the
Board of Aldermen his report, stating the total cost of the said improvement,
and proportion of such cost pagable by the owners of abutting property, and by
street and steam railways,and the cost of such improvement per front foot of
abutting property and the names of persons, firms, corporations or estates,
pwning,the property abutting on the proposed improvement, with a description
of their property, and the total cost of such improvement to each parcel of
property, and
WHEREAS, said report was considered by the Board of Alderman
and duly approved.
WHEREAS, the Board of Aldermen has finally determined to assess
a part of the cost of said improvement against the said owners and their property
1. That it is finally determined hereby to assess such part of
the cost of said improvement against the owners of said property and against
their property, as hereinafter provided.
2. That a hearing shall be given to the said owners or their
agents or attorneys, and all persons interested in the said matter as to said
assessments and as to the amount to be assessed against each owner and his pro-
perty and as to the benefits to said property from said improvement or any other
thing in connection herecith, which hearing shall be had in the Board of Alder-
man chamber of the City of Wichit Falls, Texas, situated in the City Hall at
9th Street and Ohio Avenue, the rd day of September A. D. 1920, until paid
hearing is fully accomplished, an at which hearing the said owners or other
persons may appear by counsel or in person, and offer evidence, and said hear-
ing shall be adjourned from time to time and from day to day until all such
persons, their attorneys or agents shall have been given a full and fair hearing,
and the City Secretary of the City of Wichita Falls, is hereby further ordered
and directed to give notice of the said hearing by registered letter, deposited
at the postoffice at Wichita Falls, Texas, addressed to the o ners, their agents
, 19 or attorneys, a copy hereof and by publication hereof, as required by the
General Laws of the State of Texas.

3. That after the said hearing said Board of Aldermen will by
ordinance, assess against the said owners of property and against their prop-
erty, such sums as shall be determined to be just and equitable, and that said
assessment will be made in accordance with "the front foot plan or rule", as
the frontage of the owner is to the whole frontage to be improved, provided
that if the said rule or plan shall be determined in any case to be unjust
or inequitable, then that the Board of Alder ,en will adopt such rule of appor-
tionment as shall be just and equitable, having in view the benefits to each
owner, and the burdens imposed upon them, provided that no assessment shall be
made against any owner or his property in excess to the benefits to said prop-
erty, in the enhanced value thereof, by means of such improvements.
4. That the City SEcretary of this city is hereby directed to
give notice hereof by publication of this resolution, signed by hi..., which pub-
lication shall be by advertisement inserted three times in the Wichita Daily Time
a newspaper published in said city, the first publication of which shall be at
