THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS MET
IN REGULAR SESSION ON THE ABOVE DATE FOR THE IIVESACT*-
ION OF THE BUSINESS OF THE CITY WITH MAYOR ':i. D. CLINE

AND CITY CLERK THORBURN IN ATTENDANCE.
MINUTES OF MEETING HELD ON AUG. 26th, Sept. 2nd, 6th,
8th, 9th 10th, 11th and 13th, were read and approved.
A petition was then presented asking the Board of Alder-
men to order paved -Travis Street between Ninth & Tenth and on motion
of Alderman Curlee seconded by Alderman Bonner, the following resolut-
ions were carried by the following yea and nay vote.
Yeas- Alderman Bonner, Curlee, Bralley, McFall.
Nays- None.
RESOLUTIONS AND ORDINANCES.
FIRST -ESOLUTION.
Be it resolved by the Board of Aldermen, City of Wichita
Falls, Texas, that it is hereby declared to be a public necessity to curb
pave and excavate, Travis Street between Ninth and Tenth Streets in the
City of Wichita Falls, Texas, as hereinafter set out.
To build new curb or reset old curb according tothe plan and
specifioations made by the City Engineer, of Wichita Falls, Texas, and on
file in the office of the City Secretary, of Wichita Fails, Texas.
To pave said street between said limits and curb lines ac-
cording to the plans and specifications of the City Engineer of the City
of ',"ichita Falls, Texas.
Be it further resolved that the City Engineer be instruct-
_ ed to speedily prepare a preliminary esti-ate of the cost of the said
improvement and present same to the Board of Alderman for their approval
and that the City Clerk make the proper publication of these resolutions.
SECOND RESOLUTION.
Resolution ordering the improvement of Travis Street bet-
ween Ninth and Tenth Street in the City of Wichita Falls, Texas.
Be it resolved by the Board of Aldermen of the City of
Wichita Falls, 'Texas, that the above described streets shall be improved
in the following manner, to-wit:
1. That the said street shall be graded, excavated or
filled.
2. That new curb be built or reset old curb and that said
streets be paved between said limits and said curb lines, according to the
lane and specifications to be furnished therefor by the City ENGINEER
of the City of Wichita Falls, Texas.
3. That the said roadway shall be paved with one of the
following materials, and bids be taken therefor, to-wit:
(a) Concrete
Bids shall be taken for concrete curbs, and said work of
improvement shall be done with such of said materials and under such
methods and plans as may be selected by the Board of Aldermen after the
bids are received.
4. That the cost of the said improvement shall be paid as
follows, to-wit:
(a) The City of Wichita Falls, Texas, shall nay the whole
cost of paving the intersections of said streets, named to be paved, with
the other streets and alleys.
(b) The remaining cost of such improvement shall be paid
as follows, to-wit:
The owners of pro, rty, abutting on said streets, named
to be paved, shall pay the whole cost of installing concrete curbs in
front of their respective properties and of the remaining cost, the City
of Wichita Falls, shall pay one-fourth and the owners of such abutting

propertythree-fourths.

That the proportion of the costs herein named to be paid
by the owners of abutting property shall be paid in three equal install-
ments as follows: one third cash, on the ac eptance of the improvement by
the City of Wichita Fails, one-third in one year from the date of laid
acceptance, and one-third in two years from said date.
That the said deferred payments shall bear interest at 8
per cent per annum from said date of acceptance, provided that said owners
of abutting property shall the privilege of paying the said assessments
in whole or in part before maturity, with accruded interest to the date
of payment.
That the proportion of said costs payable by the owners
of said abutting property shall be assessed against the said owners and
against their said rop,rty in accordance with the terms of the General
Laws of the State of Texas, and in accordance with what is mown as the
"front foot plan or rule," as the frontage of the property on the said
streets named to be paved; provided that if the application of this rule
would, in the opinion of the Board of Aldermen in particular cases, be
unjust or unequal, it will be the duty of said Board of Aldermen to ass-
ess and apportion said cost in such proportion as it may deem just and
equitable, having in view the special benefits in enhanced bailie to be
received by each owner of said property, so as to produce a substantial
equality of benefits by, and burdens imposed upon each owner.
That no assessments shall be made against any such owner
or his property until after notice has been givensuch owner and a hear-
ing as provided by the General Laws of the State of Texas, and provided
that no assessment shall be made against any owner or his property in
excess to the benefits to such property in enhanced value thereof by said
improvement.
That the Engineer of the City of Wichita Falls is hereby
directed at once to prepare specifications and file the same with tue
Board of Aldermen for each of the hereinabove described pavements here-
inabove desoftbed,, pavements or improvements.
That, in the specifications prepared, provisions shall be
made for requiring all contractors to ive a maintenance bond for a term
o*' not lonter than five years for the maintenance of the pavements here-
inabove described.
That such specifications shall require the bidder to mane
a bid upon the various above named pavements or materials of improvements;
with a maintenance bond as herein provided.
The said specifications shall also state the amount of the
construction bond required to be given, as well as the method by which it is
proposed to pay the cost of the said pavenent; said method being in accor-
dance with this resolution.
THIRD RESOLUTION.
Be it resolved by the Board of Aldermen of the City of It
Wichita Falls, that the specifications here presented to the Board of Ald-
erman by the City Engineer, and prepared by him for the improvement of the
hereinabove described streets, as h retofore defined, having been carefully
considered by the Board of Aldermen be, and the same are hereby approved
and adopted as the specifications for the improvements of the said street.
Be it further resolved by the Board of Aldermen that the
City Secretary be, and is hereby instructed to, at once advertise for se-
aled bids for the construction of said improvement provided by the said
specifications; such advertisement to appear or be inserted in the Wichita
Daily Times paper, a paper of general circulation in the City of Wichita
Falls, and shall run for a period of Ten days from the date of the first
insertion in the said paper; all bids to b e made subject to the terms of
the General Laws of the State of Texas in such cases made and provided
Said bids shall be filed with the City Secretary, and shall be opened
at a public meeting of the Board of Aldermen.
Bide on paving on Tilden Street were then opened and Cont-
ract for paving award to Plains Paving Co and on the motion of Aldermen
Curiae seconded by Aldernan Boner the following resolution was carried

RESOLUTIONS
Determining the Necessity of Assessing Part of the Cost
of improving Tilden Street all the unpaved portion from Avenue D to Ave-
nue H Streets against the owners of abutting property, and ordering the
hearing, of the owners of such property, and notice hereof and fixing the
time and place of such hearing:
Be it resolved by the Board of Aldermen of the City of
Wichita Falls, Texas, That:
Whereas, the Board of Aldermen, as heretofore by resolution,
directed the improvement of Tilden Street, all the unpaved portion from
Avenue D to Avenue H streets by paving the same with asphaltum pavement
• end installing curbs thereon, and
WHEREAS, Thereafter, specifications were prepared by Julien
tiontgomery, City Engineer, for said improvements, and advertisement was
made for bids therefor, and opened and considered by the Board of Aldermen
and thereafter the bid of Plains Paving Co., for said work of improvement
was adopted by the Board of Aldermen, and
WHEREAS, thereaft>r said Engineer prepared and filed with
the Board of Aldermen his report, stating the total cost of the said im-
provement, and proportion of such cost payable b7 the owners of abutting
property, and by street and steam railways, and the cost of such improv-
ement per front foot of abutting property and the names of porsons, firma
corporations or estates, owning the property abutting on the proposed
improvement, with a description of their property, and the total cost of •
such impro-cement to each parcel of property, and
WHEREAS, said report was considered by the Board of Alder-
men and duly ap-roved.
WHB2 AS, the Board of Aldermen has finally determined to
assess a part of the cost of said improve .=nt against the said owners
and their property.
1.That it is finally determined hereby to assess such part

Moved by Alderman Curlee that the property owners on the
West side of Clark Street be permitted to put in sidewalks under the
supervision of the City rnginesr.

of weeds on premises in the City of Wichita Falls, Texas, declaring
the same to be a nuisance, and describing the method for the abate-
ment of same, and pritiding for coats to be imposed against the owner
of the said premises, prescribing a penalty and declaring an emergency".
Moved by Alderman Curlee that the rules requiring ord-
inances to be read at three meetings be suspended. which motion was
seconded by Alderman Bonner and carried.
