The Board of Aldermen of the City of Wichita Falls, Texas, met in regular adjourned session in the City Hall in said City, on this the 22nd day of October, 1920. PRESENT: W. D. Cline, Mayor W. S. Thorburn, City Clerk The following among other proceedings were had to-wit: There was presented to the Board of Aldermen by the Mayor, for its consideration and passage, an ordinance No. 324 entitled, 'AN ORDINANCE AUTHORIZING THE ISSUANCE OF BONDS OF THE CITY OF WICHITA FALLS, TEXAS, IN THE AMOUNT OF TWO HUNDRED AND SIXTY THOUSAND DOLLARS ($260,000.00) MATURING THIRTY YEARS FROM THEIR DATE WITH OPTION OF RE- DEMPTION AT ANY INTEREST PAYING PERIOD AFTER FIVE YEARS FROM THEIR DATE, BEARING INTEREST AT THE RATE OF SIX PER CENTUM (6%) PER ANNUM, PAYABLE SEMI-ANNUALLY ON MAY 1ST AND NOVEMBER 1ST OF EACH YEAR FOR THE PURPOSE OF CONSTRUCTING STORM SEWERS IN AND FOR SAID CITY AND LEVYING A TAX ON EACH ONE HUNDRED DOLLARS VALUA- TION OF TAXABLE PROPERTY IN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AND TO CREATE A SINKING FUND SUFFICIENT TO REDEEM THEM AT MATURITY AND DECLARING AN EMERGENCY', Moved by Alderman McDowell, seconded by Alderman Curlee that the ordinance be read in full. Ayes: Alderman Curlee Bonner " Bralley " McDowell " Shepherd Nays: None The ordinance follows: "AN ORDINANCE AUTHORIZING THE ISSUANCE OF BONDS OF THE CITY OF WICHITA FALLS, TEXAS, IN 'THh AMOUNT OF TWO HUNDRED AND SIXTY THOUSAND DOLLARS ($260,000.00) MATURING THIRTY YEARS FROM THEIR DATE WITH OPTION OF REDEMPTION AT ANY INTEREST PAYING PERIOD AFTER FIVE YEARS FROM THEIR DATE, BEARING INTEREST AT THE RATE OF SIX PER CENTUM (6%) PER ANNUM, PAYABLE SEMI-ANNUALLY ON MAY 1ST AND NOVEMBER 1ST OF EACH YEAR FOR THE PURPOSE OF CONSTRUCTING STORM SEWERS IN AND FOR SAID CITY AND LEVYING A TAX ON EACH ONE HUNDRED DOLLARS VALUA- TION OF TAXABLE PROPERTY IN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AND TO CREATE A SINKING FUND SUFFICIENT TO REDEEM THEM AT MATURITY AND DECLARING AN EMERGENCY", WHEREAS, on the llth day of September, A. D. 1920, the Board of Aldermen of the City of Wichita Falls, Texas, by an ordinance duly and legally passed, ordered that an election be held within the limits of said City on the 12th day of October, A. D. 1920 for the purpose of determining whether the Board of Aldermen of the City of Wichita Falls shall be author- ized to issue the bonds of said City in the amount of $700,000.00 for the 55 purpose of constructing a complete sanitary sewer system in and for the said City; in the amount of $260,000.00 for the purpose of constructing storm sewers; in the amount of $340,000.00 for the purpose of constructing per- manent street improvements; in the amount of $200,000.00 for the purpose of constructing improvements and extensions to the present water works system; in the amount of $25,000.00 for the purpose of constructing a public build- ing, towit, an incinerator; in the amount of $75,000.00 for the purpose of constructing public building, towit, the construction of additions to and repairs of the City Hospital; in the amount of $25,000.00 for the purpose of acquiring public parks, play grounds and cemeteries, all of said bonds to mature serially or otherwise within the discretion of the Board of Aldermen not to exceed forty years from their date and to bear interest at the rate of 6% (six per centum) per annum, payable semi-annually, and whether said Board of Alderman shall be authorized to levy a tax on each One Hundred Dollars valuation of taxable property in said City to pay the annual interest and provide a sinking fund for each of said series of bonds sufficient to redeem them at maturity; notice of which election was duly and legally given in accordance with the laws of the State of Texas and the City Charter of the City of Wichita Falls, Texas; and WHEREAS, said election was duly and legally held on the 12th day of October, 1920, and the result of said election was duly certified and returned to this Board by the Judges and Clerks thereof, and on the 14th day of October, 1920, the Board of Aldermen of the City of Wichita Falls by order duly passed, considered said returns and canvassed the same and found that there were cast at said election 372 votes, "For the issuance of bonds in the amount of Two Hundred and Sixty Thousand ($260,000.00) Dollars, maturing serially or otherwise at such times as may be fixed by the Board of Aldermen not to exceed forty years from their date bearing interest at the rate of six (6%) per centum per annum, payable semi-annually for the purpose of Constructing Storm Sewers and for the levy of a tax on each One Hundred Dollars valuation of taxable property in said City sufficient to pay the interest on said bonds and create a sinking fund to redeem them at maturity", and 18 votes were cast "against the issuance of bonds in the amount of Two Hundred and Sixty Thousand ($260,000.00) Dollars, maturing serially or otherwise at such times as may be fixed by the Board of Aldermen not to exceed forty years from their date, bearing interest at the rate of six per centum (6%) per annum, payable semi- annually for the purpose of Constructing Storm Sewers and against the levy of a tax on each One Hundred Dollars valuation of taxa- ble property in said City sufficient to pay the interest on said bonds and create a sinking fund to redeem them at maturity", and the Board of Aldermen 56 thereupon declared that the proposition so submitted was sustained and adopted by a majority vote of the qualified property taxpayers voting at said election; and WHEREAS, this Board has examined into and investigated the reg- ularity of the proceedings for said election, and declared same to be legally called and held and that a notice required by law to be given has been duly and legally given and that said election was conducted in strict conformity with the requirements of law; and WHEREAS, of the propositions submitted at said election, and the bonds voted thereat, it is the purpose of this Board in this one ordi- nance to authorize the issuance of Two Hundred and Sixty Thousand ($260,000.00) Dollars bonds maturing thirty years from their date with option of redemp- tion at any interest paying period after five years from their date, bearing interest at the rate of six per centum (6%) per annum, payable semi-annually and to levy a tax to pay the interest on said bonds and provide a sinking fund to pay them at maturity: THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: (1) That bonds of said City to be denominated, City of Wichita Falls Storm Sewer Bonds be issued for the purpose of constructing Storm Sewers in and for said City under and by virtue of Title 22, of the Revised Civil Statutes of the State of Texas and particularly Chapter 17 of said Title, "Vernon's Complete Texas Statutes, 1920," and the City Charter of the City of Wichita Falls. (2) Said bonds to be numbered from (1) to 260 inclusive, shall be in the denomination of $1,000 which shall be dated November 1, 1920, and shall mature thirty years from their date, but the City of Wichita Falls reserves the right of redeeming any or all of said bonds on November 1, 1925, or at any interest paying date thereafter by paying principal and accrued interest, and said bonds shall on their face reserve to the City of Wichita Falls such option. (3) Said bonds shall bear interest at the rate of 6% per annum, payable semi-annually on the 1st day of May and November of each year. (4) Principal and interest shall be payable on presentation and surrender of bonds or proper coupons at the Hanover National Bank, New York City. (5) Said bonds shall be signed by the Mayor, countersigned by the City Clerk, registered by the City Treasurer and the corporate seal of said City shall be impressed on each of them, and the fac-simile signatures of the Mayor and City Clerk shall be lithographed upon the coupons attached to each of said bonds. (6) Said bonds and coupons shall be in substantially the follow- 5 7 ing form: NO. $1,000.00 UNITED STATES OF AMERICA STATE OF TEXAS CITY OF WICAITA FALLS CITY OF WICEMTA FALLS STORM SEWER BONDS The City of Wichita Falls, a municipal corporation duly incor- porated under and by virtue of the laws of the State of Texas, for value received, is indebted to and hereby promises to pay to bearer, on the lst day of November, A. D., 1950 at the Hanover National Bank, New York, New York, the sum of ONE THOUSAND DOLLARS. in lawful money of the United States of America with interest thereon from the date hereof at the rate of six per centum (6%) per annum, payable semi- annually on the lst day of May and November each year, both principal and interest payable at the bank above named; and the full faith and credit of the City of Wichita Falls and all of the resources of said City are hereby pledged to the prompt payment of the principal of this bond and the interest thereon at maturity. The City of Wichita Falls reserves the right of redeeming this bond November 1, 1925, or on any interest paying date thereafter, by paying principal and accrued interest, and in the event that the same shall be sailed in for redemption before maturity, notice thereof in writing, shall be given to the holder thereof by the City Treasurer at least thirty days before the date fixed for redemption, and should this bond not be presented for redemption, the same shall cease to bear interest from and after the date so fixed for redemption. This Bond is one of a series of Two Hundred and Sixty Bonds of like date and tenor, numbered from one to 260 both inclusive and issued for the purpose of constructing storm sewers under and by virtue of the Constitution and of Title 22 of the Revised Civil Statutes of Texas, and particularly Chapter 17 of said Title, uVernonts Complete Texas Statutes, 1920,u and the City Charter of the City of Wichita Falls, and pursuant to an ordinance duly and legally adopted by the Baird of Aldermen of said City. The date of this bond in accordance with the ordinance above mentioned is November 1, 1920. AND, it is hereby certified and declared that provision has been made, as required by the Constitution and laws of the State of Texas, for the levy and collection of an annual tax sufficient to pay the interest on said bonds as the same shall become due, and to pay the principal sum at 5 P maturity: that said bonds have been authorized by a majority vote of the qualified property tax paying voters voting at an election held for that pur- pose on the 12th day of October, 1920, and that all acts, conditions and things required to be done precedent to and in the issuance of this bonds, have been properly done, have happened and been perdormed in regular and due time as re- quired by the Constitution and laws of the State of yews andby the City Charter of the City of Wichita Falls, and that the total indebtedness of said City ino- luding this bond does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the City of Wdohita Falls, by its Board of Aldermen, has caused this bond to be signed by its Mayor, countersigned by the City Clerk, registered by the City Treasurer, with its corporate seal imp reseed hereon, and the annexed interest coupons to be executed by the lithographed fac-simile signatures of this said Mayor and City Clerk, as of the date above mentioned. City Clerk. 59 (7) On the back of each of said bonds shall be printed the following certificate: OFFICE OF THE COMPTROLLER OF PUBLIC ACCOUNTS G. THE STATE OF TEXAS. Register No. I HEREBY CERTIFY that there is on file and of record in my office a certificate of the Attorney General of the State of Texas to the effect that this bond has been examined by me as required by Article 619, Vernon's Sayles' Revised Civil Statutes for the year of 1914 and that it has been issued in conformity with the Constitution and laws of the State of Texas and that it is a valid and binding obligation upon the City of Wichita Falls, Texas, and said bond has this day been registered by me. (8) Be it further ordained by the Board of Aldermen of the City of Wichita Falls, that to pay the interest on said bonds as the same shall mature and to create a sinking fund sufficient to discharge the principal thereof at maturity, there shall be annually levied, and there is hereby levied for the year of 1920, a tax of 7.68 cents on the $100.00 valuation of taxable property in said City; that for the year of 1921, and each succeeding year while any of said bonds are outstanding and unpaid, there shall be computed and ascertained what rate of tax, based upon the latest approved tax rolls of said city, will be required to fully make, raise and produce in each of said years a sum of money necessary to pay all interest accruing and becoming due in said year and to provide a sinking fund equal to one-thirtieth of the principal of said bonds and a tax at such rate as shall be found necessary (said tax in any year, however, not to be less than the tax of .O768 cents as aforesaid) shall be levied, assessed and collected in each of said years, and at the time other city taxes are levied, assessed and collected, and the proceeds from said taxes shall be applied to the purposes named. (9) The fact that there is an urgent public need for a con- struction of storm sewers in said City for the preservation of the health of the community, creates an emergency and public necessity that the rule requiring ordinances to be read on three separate days be suspended, and said rule is hereby suspended and this ordinance shall take effect and be in force from and after its passage and it is so ordained. 6� There was then presented to the Board of Aldermen by the Mayor, for its consideration and passage, an ordinance No. 325, entitled "AN ORDINANCE AUTHORIZING THE ISSUANCE OF BONDS OF THE CITY OF WICHITA FALLS, TEXAS, IN THE AMOUNT OF THREE HUNDRED AND FORTY THOUSAND ($340,000.00) DOLLARS MATURING THIRTY YEARS FROM THEIR DATE WITH OPTION OF REDEMPTION AT ANY INTEREST PAYING PERIOD AFTER FIVE YEARS FROM THEIR DATE, BEARING INTER- EST AT THE RATE OF SIX PER CENTUM (6%) PER ANNUM, PAYABLE SEMI-ANNUALLY ON MAY 1ST ANDNOVEMBER 1ST OF EACH YEAR FOR '17I1. WHEREAS, on the llth day of September, A.D., 1920, the Board of Aldermen of the City of Wichita Falls, Texas, by an ordinance duly and legally passed, ordered that an election be held within the limits of said City on the 12th day of October, 1920, for the purpose of determining whether the Board of Aldermen of the City of Wichita Falls shall be authorized to issue the bonds of said City in the amount of $700,000.00 for the purpose of con. strutting a complete sanitary sewer system in and for the said City; in the amount of $260,000.00 for the purpose of constructing storm sewers; in the amount of $340,000.00 for the purpose of constructing permanent street im- provement; in the amount of $200,000.00 for the purpose of constructing improvements and extensions to the present water works system; in the amount of $25,000.00 for the purpose of constructing a public building, towit, an incinerator; in the amount of $75,000.00 for the purpose of constructing public buildings, towit, the construction of additilons to and repairs of the City Hospital; in the amount of $25,000.00 for the purpose of acquiring public parks, play grounds and cemeteries, all of said bonds to mature serially or otherwise within the discretion of the Board of Aldermennot to exceed forty years from their date and to bear interest at the rate of 6% per annum, payable semi-annually, and whether said Board of Aldermen shall be authorized to levy a tax on each One-Hundred Dollars valuation of taxable property in said City to pay the annual interest and provide a sinking fund li for each of said series of bonds sufficient to redeem them at maturity; not- ice of which election was duly and legally given in accordance with the laws of the State of Texas and the City Charter of the City of Wichita Falls, Texas; and WHEREAS, said election was duly and legally held on the 12th day of October, 1920, and the result of said election was duly certified and returned to this Board by the Judge and Clerks thereof, and on the 14th day of October, 1920, the Board of Aldermen of th e City of Wichita Falls by order duly passed, considered said returns and canvassed the same and found that there were cast at said election 368 votes, "For the issuance of bonds in the amount of SEVENTY-FIVE THOUSAND DOLLARS, maturing serially or otherwise at such time as may be fixed by the Board of Aldermen not to exceed forty years from their date bearing interest at the rate of six (6%) per centum per annum, payable semi-annually for the purpose of CONSTRUCTING A PUBLIC BUILDING TO-WIT, ADDITIONS TO AND REPAIRS TO CITY HOSPITAL and for the levy of a tax on each One Hundred Dollars valuation of taxable property in said City sufficient to pay the interest on said bonds and create a sinking fund to redeem them at maturity," and 21 votes were cast "against the issuance of bonds in the amount of Seventy-Five Thousand Dollars, maturing serially or otherwise at such times as may be fixed by the Board of Aldermen not to exceed forty years from their date, bearing interest at the rate of six per centum (6%) per annum, payable semi-annually for the purpose of CONSTRUCTING A PUBLIC BUILDING TO-WIT, ADDITIONS TO AND REPAIRS TO CITY HOSPITAL AND AGAINST THE LEVY OF A TAX ON EACH One Hundred Dollars valuation of taxable property in said City sufficient to pay the interest on said bonds and create a sinking fund to redeem them at maturity," and the Board of Aldermen thereupon deolared that the proposition as submitted was sustained and adopted by a majority vote of the qualified property taxpayers voting at said election; and, WHEsREAS, this Board has examined into and investigated the regularity of the proceedings for said election, and deolared same to be legally called and held and that a notice required by law to be given has been duly and legally given and that said election was conducted in strict conformity with the requirements of law; and WHEREAS, of the propositions submitted at said election, and the bonds voted thereat, it is the purpose of this Board in this one ordinance to au- thorize the issuance of Seventy-five Thousand Dollars Bonds maturing thirty years from their date with option of redemption at any interest paying period after five years from their date, bearing interest at the rate of six per centum (6%) per annum, payable semi-annually and to levy a tax to pay the 90 interest at the rate of six per cent per annum on said bonds and provide a sinking fund to pay them at maturity; THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: (1) That bonds of said City to be denominated, City of Wichita Falls Hospital Bond Series Two, be issued for the purpose of constructing a public building to-wit, Additions to and repairs to City Hospital in and for the said City under and by virtue of Title 22, of the Revised Civil Statutes of the State of Texas and particularly Chapter 17 of said Title, "Vernon's Complete Texas Statutes, 1920," and the City Charter of the City of Wichita Falls. (2) Said Bonds to be numbered from (1) to 75 inclusive, shall be in the denominat ion of $1,000 which shall be dated November 1, 1920 and shall mature thirty years from their date, but the City of Wichita Falls reserves the right of redeeming any or all of said bonds on November 1, 1925, or at any interest paying date thereafter by paying principal and accrued interest, and said bonds shall on their face reserve to the City of Wichita Falls such option. (3) Said bonds shall bear interest at the rate of 6% per annum, payable semi-annually on the 1st day of May.and November of each year. (4) P'incipal and interest shall be payable on presentation and surrender of bonds or proper coupons at the Hanover National Bank, New York City. (5) Said bonds shall be signed by the Mayor, countersigned by the City Clerk, registered by the City Treasurer and the corporate seal of said City shall be impressed on each of them, and the fac-simile signa- tures of the Mayor and City Clerk shall be lithographed upon the coupons attached to each of said bonds. (6) Said bonds and coupons shall be in substantially the follow- ing form: 91 No. $1,000.00 UNITED STATES OF AMERICA STATE OF TEXAS CITY OF WICHITA FALLS CITY OF WICHITA FALLS HOSPITAL BOND SERIES TWO The City of Wichita Falls, a municipal corporation duly incor- porated under and by virtue of the laws of the State of Texas, for value received, is indebted to and hereby promisee to pay to bearer, on the lst day of November, A. D. 1950 at the Hanover National Bank, New York, New York, the sum of ONE THOUSAND DOLLARS in lawful money of the United States of America with interest thereon from the date hereof at the rate of six per centum (6%) per annum, payable semi- annually on the lst day of May and November each year, both principal and interest payable at the bank above named; and the full faith and credit of the City of Wichita Falls and all of the resources of said City are hereby pledged to the prompt payment of the principal of this bond and the inter- est thereon at maturity. The City of Wichita Falls reserves the right of redeeming this bond on November 1, 1925, or on any interest paying date thereafter, by paying principal and accrued interest, and in the event that the same shall be called in for redemption before maturity, notice thereof in writing shall be given to the holder thereof by the City Treasurer at least thirty days before the date fixed for redemption, and should this bond not be presented for redemption, the same shall cease to bear interest from and after the date so fixed for redemption. This bond is one of a series of seventy five Bonds of like date and tenor, numbered from one to seventy-five both inclusive and issued t for the purpose of constructing a public building, to-wit, additions to and repairs to City Hespital,under and by virtue of the Constitution and of Title 22 of the Revised Civil Statutes of Texas, and particularly Chapter 17 of said Title, "Vernon's Complete Texas Statutes, 1920", and the City Charter of the City of Wichita Falls, and pursuant to an ordinance duly and legally adopted by the Board of Aldermen of said City. The date of this bond in accordance with the ordinance above mentioned is November 1, 1920. AND, it is hereby certified and declared that provision has been made, as required by the Constitution and laws of the State of Texas, for hi. 92. the levy and collection of an annual tax sufficient to pay the interest on said bonds as the amine shall become due, andto pay the principal sum at maturity; that said bonds have been authorized by a majority vote of the qualified proper- ty tax paying voters voting at an election held for that purpose on the 12th day of October, 1920, and that all acts, conditions and things required to be done precedent to and in the issuance of this bond, have been properly done, have happened and been performed in regular and due time as required by the Con- stitution and laws of the State of texas and by theCity Charter of the City of Wichita r'alls, and that the total indebtedness of said City including this bond does not exceed any constitutional or statutory limitation. (8) Be it further ordained by the Board of Aldermen of the City of Wichita Falls, that to pay the interest on said bonds as the same shall matinee and to create a sinking fund sufficient to discharge the principal thereof at maturity, there shall be annually levied, and there is hereby levied for the year of 1920, a tax of 2.22 cents on the $100 valuation of taxable property in said City; that for the year of 1921, and each succeed- ing year while any of said bonds are outstanding and unpaid, there shall be computed and ascertained what rate of tax, based upon the latest approved tax rolls of said City, will be required to fully make, raise and produce in each of said years a sum of money necessary to pay all interest accruing and becoming due in said year and to provide a sinking fund equal to one- thirtieth of the principal of said bonds and a tax at such rate as shall be found necessary (said tax in any year, however, not to be less than the tax of 2.22 cents as aforesaid) shall be levied, assessed and collected in each of said years, and at the time other city taxes are levied, assessed and collected, and the proceeds from said taxes shall be applied to the purposes. named. (9) The fact that there is an urgent public need for additions to and repairs to city hospital in said City for the preservation cf the health of the community, creates an emergency and public necessity that the rule requiring ordinances to be read on three separate days be suspended, and said rule is hereby suspended and this ordinance shall take effect and be in force from and after its passage and it is so ordained. 94 Passed this 22nd day of October, 1920. BECOND RESOLUTION . Resolution ordering the improvement of that part of Ninth Street abutting Lots 1 and 2 Block 28 Floral Heights Addition, in the City of Wichita Falls, Texas. Be it resolved by the Board of Alderman of the City of Wio hita Falls, texas, that the above described streets shall be improved in th. following manner, to-wit: 1. That the said street shall be graded, excavated or filled. 2. That new curb be built or reset old curb and that said streets be paved between said limits and said curb lines, according to the plans and specifications to be furnished therefor by the City Engineer d the City of Wichita Falls, Texas. 3. That the said raodway shall be paved with one of the foil owing material , and bids be taken therefor, towit.: (a) Concrete. 97 Bids shall be taken for concrete curbs, and said work of improvement shall be done with such of said materials and under such met o s and plans as may be selected by theBoard of Alderman after the bids 92 are received. 4. That the cost of the said improvement shall be paid as follows: to-wit: (a) The City of Wichita Falls, Texas, shall pay the whole cost of paving the intersections of said streets, named to be paved, with the other streets and alleys. (b) The remaining cost of ouch improvement shall be paid as follows, to-wit; The owners of property, abutting on said streets, anamed to be paved, shall pay the whole cost of installing concrete curbs in front of their respective properties and of the remaining cost, the city of Wichita Falls, shall pay one-fourth and the owners of such abutting property three fourths. That the proportion of the costs herein named to be paid by the onwers of abutting property shall be paid in three equal install- ment as follows: one third cash, on the acceptance of the imp}Cvement by the City of Wichita Falls, one third in one year from the date of said acceptance, and one third in two years from said date. That the said deferred payments shall bear interest at 8 per cent per annum from said date of acceptance, Provided that said owners of abutting property shale privile.~e of paying the said assessments in whole or in cart before maturity, with accrued interest to the date of payment. That the proportion of said costs payable by the owners of said abutting property shall be assedsed against the said owners and ag- ainst their said property in accordance with the terms of the General Laws of the State of Texas, and in accordance with what is known as the "front foot plan or rule,"as the frontague of the property on the said x streets named to herpaved; provided that if the application of this rule, would in the opinion of the Board of Aldermen in particular cases, be un just er unequal, it will be the duty of said Board of aldermen to assess and apportion said c:;st in such proportion as it may deem just and equit- able, baying in view the special benefits in enhanced value to be rec- eived by each owner of said property, so as to produce a substantial equality of benefits by, and burdens imposed upon each owner. That no assessments shall be made against any such owne r or his property until after notice had been given such owner and a hearieg as provided by the General Laws of the State of Texas, and provide$ that no assessment shall be made against any owner or his property in excess to the benefits to such property in enhanced value thereof by said imp- rovement. That the Engineer of the City of Wichita Falls is hereby directed at once to prepare specifications and file the same with the Beard of Aldermen for each of the hereinabove described pavements or improve- ments. That, in the specifications prepared, provisions shall be made for requiring all contractors to give a maintenance bond for a term of not longer than five years from the maintenance of the payments here- inabove described. That such specifications shall require the bidder to make a bid upon the various above named pavements or materials of improvements; with a maintenance bond as herein provided. The said specifica*ions shall also state the amount of the construction bond required to be given as well as the method by which it is proposed to pay the cost of the said pavement; said method being in accordance with this resolution.
