Min 11/08/1920 CITY HALL? November 8th, 1920. The Board ofAldermen met in regular session on the above date for the transaction of the business of the City with Mayor W.D. Cline presiding and Aldermen Curlee, Bralley, Bonner, Shepherd, McDowell, add City Clerk Thorburn in attendance. Moved by Alderman McDowell that the easements for sewer line given by J.S. Fore and P.P. Langford be accepted and ratified, which motion was seconded by Alderman Bonner and carried. Moved by Alderman McDowell that the wood paving in the down town district be repaired, and that Street Commissioner Ourlee and City engineer Montgomery be authorized to glahead with the work at approximate cost of $20,000.00 to $25,000.00, which motion was seconded by Alderman Shepherd and carried. ORDINANCE NO. 331. "An ordinance for the licensing and regulation of "Automobiles for Hire" and providing penalties for the violation thereof, and declaring an emergency" was on the motion of Alderman Curlee, seconded by Alderman Bonner, placed on its first reading by the following vote: Yeas. Aldermen Curies, Bonner, Bralley, Shepherd, McDowell. Nays. None. The ordinance was then read by the City Clerk and Alderman Curlee moved that the rules requiring ordinances to be read on three separate days be suspended, which motion was seconded by Alderman Bonner and carried. Moved by Alderman Curlee, seconded by Alderman Bonner that Ordinance No. 331 be passed on its second reading. Yeas. Aldermen Curlee, Bonner, Bralley, Shepherd, and McDowell. Nays. Norge. Moved by Alderman Curlee, seconded by Alderman Bonner that ordi- nance No. 331 be finally passed. Yeas. Aldermen Curlee, Bonner, Bralley, Shepherd, and McDowell. Nays. None. ORDINANCE NO. 332 "An ordinance making it unlawful for any person, or persons, to congregate or stand upon any street or sidewalk in the City of Wichita Falls, Texas, in such a manner as to oostruct pedestrians, providing for a penalty, and creating this ordinance an emergency measure; was on the motion of Alderman Ourlee seconded by Alderman Bonner, passed on its first reading by the following vote: Yeas. Aldermen Jurlee, Bonner, Bralley, Shepherd, and "oDowell. Nays. Alone. The ordinance was then read7by the Mayor, and Alderman Curlee moved that the rules requiring ordinances to be read on three separate days be suspended, which nation was seconded by Alderman Bonner and carried. Moved by Alderman Bonner that Voelker and Dixon be instructed to draw up plans and get bids for construction of a Fire Station at Buchanan and Avenue H, plans to be substantially same as those presented to Council at this meeting, which motion was seconded by Alderman Curlee and carried. A ldermen Curlee, Bonner, °ralley, Shepherd, and McDowell. Nays. None. RESOLUTION NO. 1. Be it resolved by the Board ofAldermen of the City of Wichita L." Falls, Texas, that it is hereby declared to be a public necessity to curb, pave, and excavate the following: On Eighth Street; from Eas$ property line pf Bluff St. to West line of Brook St. On Ninth Street; from West property line of Denver St. to one hundred feet West of West property line of Taylor St. On Grant Street; from one hundred feet North of North property line of Ave. D to the center of the intersection at Ave. H. On Ave. A; from South property line of Tenth Street to the South property line of Eleventh St. To build new curb or reset old curb according to the plan and specifications made by the City Engineer, of Wichita Falls; Texas, and on file in the office of the City Secretary, of Wichita Falls, Texas. To pave said street between said limits and curb lines accord- ing to the plans and specifications of the Ctty jingineer of the City of Wichita Falls, Texas. , Be it further resolved that the City Engineer be instructed to speedily prepare a preliminary estimate of the cost of the said improvement and present same to the Board of Aldermen for their approval and that the City Clerk make the proper publication of these resolutions. i k « log . • • SECOND RESOLUTION Resolution ordering the improvement of the following streets On Eighth St; from East property line of Bluff St. to West line of Brook St. On Ninth St; from West property line of Denver St. to one hundred feet West of West property line of Taylor St; On Grant St4 from one hundred 'feet North of North property line of Ave. D. to the center of the intersection at Ave. H; On.Ave; from South property line of Tenth St. to the South property line of Eleventh St. Be it resolved by the Board of Aldermen of the City of Wich- ita Falls, Texas, that the above described streets shall be improved in the following manner, to-wit; 1. That the said streets shall be graded, excavated or filled. 2. That new curb shall be built, or reset old curb and that said streets be paved between said limits and said curb lines, according to the plans and specifications to be furnished therefor by the City Engineer of the City of Wichita Falls, Texas. 3. That the said roadway shall be paved with one of the fol- lowing materials, and bids be taken therefor, to-wit: (a) Cement Concrete (b) Asphaltum Concrete (c) Bitulithic (a) Uvalde Rock Asphalt (e) Sheet Asphalt Bids shall be taken for concrete curbs, and said work of improvement shall be done with such of said materials and under stale methods and plane as may be selected by the Board of Aldermen after the bids are received. 4. That the cost of said improvements shall be paid as fol- lows; The owners of property abutting on said streets shall pay the whole cost of installing concrete curbs in front of their respective properties, and three-quarters of the cost of the paving in proportion to their frontage;•and the City of Wichita Falls shall pay one fourth of the total cost of such paving. That the proportion of the costs herein named to be paid by the owners of abutting shall be paid in three eausl inst- allments as follows: one third cash, on the acceptance of the improve- ment by the City of Wichita Falls, one third in one year from the date of said acceptance, and one third in two years from said date. That the said sums payable by property owners shall bear interest at eight (W) per cent per annum from said date of acceptance provided that said owners of abutting property shall have the prhvi- lege of paying the said assessments in whole or in part before matur- ity, with accrued interest to the date of payment, and default in pay- ment of any installment shall at option of holder and owner of assess- cant mature all unpaid installments. That the proportion of said costs payable by the owners cf• said abutting property shall be assessed against the said owners and against their said property in accordance with the terms of the General Laws of the tate of Texas, and in accordance with what is known as the "front foot plan or rule", as the frontage of the property on the said streets named to be paved; provided that if the applidation of this rule, would, in the opinion of the Board of Aldermen to assess and apportion said cost in such proportion as it may deem just and equit- able, having in view the special benefits in enhanced value to be re- ceived by each owner of said property so as to produce a substantial equality of benefits by, and burdens imposed upon each owner. That no assessments shall be made against any such owner or his property until after notice has been given such owner and a hearing as provided by the General Laws of the State of Texas, and provided that no assessment shall be made against any owner or his property in excess to the benefits teesuch property in enhanced value thereof by said imp- rovement. That the Engineer of the City of Wichita Falls is hereby dir- ected at once to prepare specifications and file the same with the Board of Aldermen for each of the hereinabove described pavements or improve- ments. That each street or portion thereof mentioned herein shall be considered a separate improvement, contracts let, hearings held, bene- fits and assessments etc determined accordingly. 11)5 That, in the specifications prepared, provisions shall be made for requiring all contractors to give a maintenance bond for a term of not longer than five years for the maintenance of the pavements herein- above described. That such specifications shall require the bidder to make a bid upon the various above named pavements or materials of improvements; with a maintenance bond as herein provided. The said snecifications shall also state the amount of the construction bond required to be given, as well as the method by which it is proposed to pay the cost of the said pavement said method being in accordance with this resolution. THIRD RESOLUTION. Be it resolved by the Board of Aldermen of-the City of y Wichita Falls that specifications presented to the Mayor and Board of Alder- 1- men by the City Engineer and prepared by him for the improvement of portions of Eighth Street, Ninth Street, Avenue A., and Grant Street, insaid City having been given consideration by the Board of Alderman.;be and the same are hereby approved and adopted as the specifications for the improvement v of said portions of said streets. #################### ORDINANCE 316. "An ordinance directing the City Secretary to advertise for bids for the improvement of portions of 8th Street, Ninth Street, Avenue A, and Grant Street, and declaring an emergency". was on motion of Alderman Bonner seconded by Alderman Curlee put on its first reading and passed by following vote. Yeas:- Bonner, Bralley, McDowell, Shepherd, Curlee. Naves:- None. Moved by Alderman Curlee that the rule requiring ordinances to be read on three separate days be suspended, which motion was seconded by Alderman Bonner and carried. Moved by Alderman McDowell that this ordinance be passed on its second reading which motion was seconded by Alderman Curlee and car- ried by the following vote. Yeas:- Bonner, Bralley, Curlee, McDowell, Shepherd. Hayes;- None. Moved by Alderman Curlee that ordinance 316 be put on its third and final reading, which motion was seconded by Alderman Bonner and carried by the following vote. Yeas: Alderman McDowell, Bonner, Bralley, Curlee and Shepherd. Hayes: None. The Ordinance Follows: 1{16 AN ORDINANCE DIRECTING THE CITY SECRETARY TO ADVERTISE FOR BIDS FOR THE IMPROV WENT OF PORTIONS OF EIGHTH STREET, NINTH STREET, AVENUE 'A', AND GRANT STREET,AND DECLARING AN W RGENCY. BE IT ORDAINED by the Board of Aldermen of the City of Wichita Falls, that, WHEREAS, the Board of Aldermen have heretofore ordered the improvement of portions of Eighth Street, Ninth Street, Avenue 'A' and Grant Street by resolution, and the City Engineer has in accordance with instructions prepared and filed plans and specifications for such improvement, and same have been adopted. I. That sealed bids for the making and constructing of the improvements on said streets as defined in the resolution ordering same and in accordance with plans and specifications therefor, be received at the office of the office of the City Clerk in Wichita Falls, Texas, until Mond- ay, December 6th, at 7:30 P•M. and then publicly opened. II. That the City Secretary be and is hereby instructed to at once advertise for sealed bids or proposals for the constructing of said improvements. Such advertisement to appear or be inserted in the Wichita Daily Times, a newspaper of general oircnAation in the City of Wichita Falls, and shall run at least twice and shall appear the first time at least fif- teen (15) days before the date for receiving bids. • All bids shall be made subject to the terms of the general laws of the State of Texas and the provisions of the oharter of this city, and the right shall be reserved to rejaect any and all bids. III. That the condition of the portions of the streets to be improved endangers the safety of persons and property and constitutes an urgent public necessity demanding the suspension of the rules and provisions of law requiring the readingof this ordinance on three (3) separate days, and the reading of this ordinance on three (3) separate days is hereby by unanimous vote of all the members of the Board dispensed with and this ord- inance shall take effect from and after its passage.
