Curlee pre- siding and Aldermen BralleyA Shepherd, Bonner and City Clerk Thorburn in att- endance. - Bids for the following pavement were then opened and dis- cussed in detail. On eighth Street; From East property line of Bluff Street t o West line of Brook Street; On Ninth Street:- From west property line of Denver Street to 100 feet West of crest property line of Taylor Street; On grant Street:- Fron 100 feet North of North property line of Ave. D to the center of the interseotion at Ave H. On Avenue A:- r'rom South property line of Tenth Jtreet to the South property line of 11th Htreat;. (� It was then moved by Aldermen Bonner that the contract be (given to the 'Texas Bitulithia Company \\ which motion was seconded by Alderman Bralley and carried. Moved by alderman Bonner that H. O. Thomas be permitted to open a Grocery Store and Meat Market on Lot No. 14 Block 243 original townsite of the City which motion was seconded by Alderman Bralley and parried. The Board of Aldermen were then petitioned to order the following street paved. On Ohio Avenue:- All that unpaved protion from middle of Block between 10th and llth Street to the rtailroad crossing near 12th street, AndAlderman Bonner moved that the following resolutions be passed which motion was seconded by Alderman Bralley and carried by the foll- owing yea and nay vote; Yeas : Aldermen Shepherd, Bonner, Bralley. Mayes:- None. RESOLUTION ONE BE it resolved by the Board of Aldermen of the City of Wichita Falls, Texas, that it is hereby declared to be a public necessity to curb, pave, and excavate the following: On Ohio Avenue:- All that unpaved protion from middle of Block between 10th and llth Street to the xailroad crossing near 12th Street. To build new curb or reset old curb according to the plan and specifications made by the City Engineer, of Wichita Falls, Texas, and on file in the office of the City Secretary, of Wichita Falls, Texas. To pave said street between said limits and curb lines acc- ording to the plans and specifications of the City Engineer of the City of Wichita Fails, Texas. • Be it further resolved that the City Engineer be instructed to speedily prepare a preliminary estimate of the cost of the said improvement and present same to the Board of Aldermen for their aeproval and that the City Clark make the proper publication of these resolutions. • • S. /1 4 RESOLUTION TWO Resolution ordering the improvement of the following street. On Ohio Avenue:- All that unpaved portion from middle of Blook between 10th and llth Street to the Railroad crossing near 12th Street. Be it resolved by the Board of Aldermen of the City of Wieh- ita Falls, Texas, that the above described streets shall be improved in the following manner, to-wit: 1. That the said street shall be graded, excavated or filled. 2. That new curb shall be built, or reset old curb and that said streets be paved between said limits and said curb lines, according to the plans and specifications to be furnished therefor by the City Engineer of the City of Wichita Falls, Texas. 3. That the said roadway shall be paved with one of the fol- lowing materials, and bids be takentherefor, to-wit; (a) Cement Concrete Bids shall be taken for concrete curbs, and said work of improvement shall be done with such of said materials and under such methods and plans as may be selected by the Board of Aldermen after the bids are received. 4. That the eostof said improvements shall be paid as fol- lows; The owners of property abutting on said streets shall pay the whole cost of installing concrete curbs in front of their respective properties, and three- quarters of the cost of the paving in proportion to their frontage- and the City of Wichita Falls shall pay one fourth of the totalcost of such rav- ing. Th,t the proportion of the costs herein learned to be paid by the owners of abutting property shall be paid in three equal installments as follows: One third cash, on the acopptance of the improvement by the City of Wichita Falls, one third in one year from the date of said acceptance, and one third in two years from said date. That the said sums payable by property owners shall bear interest at eight (8%) per cent per annum from said date of acceptance prov- ided that said owners of abutting property shall have the privilege of paying the said assessments in whole or in part before maturity, with accrued interest to the date of ayment, and default in payment of any installment shall at option of holder and owner of assessment mature all unpaid installments. That the proportion of said costs payable by the owners of said abutting property shall be assessed against the said owners and against their said property in accordance with the terms of the General Laws of the State of Texas, and in accordance with what is known as the "front foot plan or rule",as the frontage of the property on the said streets named to be paved providing that if the application of this rule, would, in the opinion of the Board of Aldermen to assess and apportion said nest in such proportion as it may deem just and equitable, having in view the special benefits in enhanced value to be received by each owner of said property so as to produce a sub- stantial equality of benefits by, and burdens imposed upon each owner. That no assessments shall be made against any such owner or his property until after notice has been given such owner and a hearing as provided by the General Laws of the State of Texas, and provided that no ass- essment shall be made against any owner or his property in excess to the bene- fits to such property in enhanced value thereof by said improvement. That the Engineer of the City of Wichita Falls is hereby directed at once to prepare specifications and file the same with the Board cf Aldermen for each of the hereinabove described pavements or improvements. That each street or portion thereof mentioned herein shall be considered a separate improvement, contracts let, hearings held, benefits • and assessments etc. determined accordingly. That, in the specifications prepared, provisions shall be made for requiring all contractors to give a maintenance bond for a term of not longer than five years for the maintenance of the payments hereinabove described, That such specifications shall require the bidder to make a bid upon the various above named pavements or materials or improvements; with a maintenance bond as herein provided. 11 The said specifications shall also state the amount of the construction bond required to be given, as well as the method by which it is proposed to pay the cost of the said pavement; said method being in accordance with this resolution. The City Engineer then presented specifications which were approved and following resolution then passed by the following vote on the motion of Alderman Bonner seconded by Alderman Shepherd. Yeas: Alderman Bonner, Shepherd, Bralley. Hayes: None. RESOLUTION THREE Be it resolved by the BOARD of Aldermen of the City of Wichita Falls, that the spooifioations here presented to the Board of Alder- men by the City Engineer, and prepared by him for the im-rovement of the hereinabove described streets, as heretofore defiaed,having been carefully considered by the Board of Aldermen be, and the same are hereby approved and adopted as the specifications for the improvements'of the sat d street. Be it further resolved by the Board of Aldermen that the City Secretary be, and is hereby instructed, to at once advertise for sealed bids for the construction of said improvements provided by the said specifi- cations; such advertisement to appear or be inserted in the Wichita Daily Times paper, a raper of general circulation in the Cigy of Wichita Falls, all b bids to be made subject to the terms of the General Laws of the State of Texas in such oases made and provided. Said bids shall be filed with the City Secretary, and shall be opened at a public meeting of the Board of Aldermen. Moved by Alderman Curlee that the contract No. 37 signed and executed by the Mayor on the 29th November 1920 with the Highland Irrigation end Land Co for the return of $19983.00 with interest from Jan 1st 1980, same being amount advanced by the Highland Irrigation and Land Co for the install- ation of Sewer System in Highland Heights Addition, be approved and ratified in all respects, which motion was seconded by Alderman McDowell and carried. ORDINANCE NO. 336 "An Ordinance granting the right privilege and franchise to Leroy S. Sheurer, L. T. Burns and W. E. Fitzgerald, to lay, build, construct operate and maintain a spur track from the main line of the Wichita Valley, Railway Company, leaving its main line somewhere near Walnut Street and extend- ing along the West side of W. 4. Fitzgerald's lots, the same being lots 9 and 10 Block No. 23, Barwise and Jalonick Addition; Thence along the West side of L. T. Burns Lot No. 1 of said Block 23; Thence across Elm Street and along the West side of Leroy R. Soheurer Lot 10 of Block 16 of said Addition and to maintain same for ten years, Was on motion of Alderman Bonner seconded by Alderman Bralley put on its first reading and passed by the following yea and nay vote: Yeas:- Aldermen. Shepherd, Bralley, Bonner, Nayea; None. Moved by Alderman Bonner that whereas on or abolztc$he let of Aug. 1920 the City sold out of the padnd according to law one span of mules ► 1LTM 1 for One Hundred and Three dollars, and that the charges against same due the City were $19.00, and that whereas the Block 818 Water Co., has made claim and established said claim to the satisfaction of this Board of Aldermen, it is therefore moved that the sum of $"84.00 be returned to said Block 818 Water Company and that the City Clerk be hereby authorized to issue warrant for same which motion was seconded by Alderman Bralley and carried. Bids for the construction of a new fire station at Buchanan and Ave H w re then ope and Alderman Bonner moved that the contract be awarded to y� d , he being the lowest bidder, pro- vided he makes e necessary bond which motion was seconded by Alderman Bralley and carried. Bids for the Electrical work on above Fire Station were then opened and Alderman &ralley moved that the contract be awarded to the Nunn Electric Co., they being the lowest bidder which motion was seconded by Alderman Shepherd and carried. Bids for plumbing work on the above named Fire station were then opened and no bid accepted. ORDINANCE 337. "An Ordinance providing for changing the meeting place of the Board of Aldermen of the City of Wichita Fails from the City Hall to the basement of the Morgan Building, same being Room No. sad occu- pied by the Water department of theCity of Wichita Falls, 3 xas'r. was on motion of Alderman Bralley seconded by Alderman Shepherd put on its first reading and passed by the following yea and nay vote.
