The Board of Aldermen of the City of Wichita Falls, met in
regular session on the above date with the following

The City Engineer presented to the Board a list of streets
to be re-named to avoid duplication, and also proposed names for
said Streets and Alderman Curies, moved that the new names for said
Streets be approved and that the City Attorney be instructed to
draw up en Ordinance changing the names of said Streets,
which motion was seconded by Alderman Bralley and carried.
Moved by Alderman Shepherd that the funds collected from
taxes for the Library Fund be turned over to the Library Board to
be disbursed by its Treasurer H. L. Hunter, and that Mr Hunter make
statement of expenditures to the Board each month, but the Board of
Aldermen reserves the right to cancel this arrangement and have
said Funds turned back to the City Treasurer at any time it sees
fit,
which motion was seconded by. Alderman Curlee and carried.
Moved by Alderman McDowell that the City Clerk be instructed
to issue warrant to J. J. Simon for $1171.06, refund far money
advanced the City to install sewerage system in Block 260,
which motion was seconded by Alderman Curlee and carried,
Moved by Alderman Curlee that the City Attorney be instructed
to take necessary legal action to open a crossing at the Railroad
on Broad Street into the 3Ably Taylor Addition,
which motion was seconded by Alderman Shepherd and carried.
Moved by Alderman Curlee that Sanitary Commissioner McDowell
be authorized to purchase an Incinerator,
which motion was seconded by Alderman Shepherd and parried.
Moved by Alderman Curlee that the Contract for building side-
walks be given to McDonald he being the lowest bidder,
which motion was seconded by Alderman Shepherd and carried.

"AN ORDINANCE ordering the improvement of portions of Ave. A,
Eighth Street, Grant Street and Ninth Street in the City of Wichita
Falls, Texas, designating the materials and methods of improvement
and providing for the construction thereof by contract, and providing
for the payment of the cost of such improvements, levying assessment s
therefor and fixing the terms and times of »ayment, and the rate of
interest thereon, and providing for the isszance of assignable certif-
icates, and declaring an emergency".

Moved by Alderman Curlee seconded by Alderman McDowell that
this ordinance be placed on its first reading.

Hayes:- None.
Moved by Alderman Curlee that the rule requiring ordinances
to be read on three separate days be suspended.
Motion seconded by Alderman McDowell.

Hayes: None.
Moved by Alderman Curiae that this ordinance be put on its
second reading.
Motion seconded by Alderman McDowell.

Moved by Alderman Curlee that this ordinance be put on its
third and final reading which motion was seconded by Alderman McDowell
and carried by following vote:-

A petition was then presented asking that the Council order
in sidewalks on the East side of Baylor Street between 7th and 9th
Street and Alderman Bralley moved that the following two, resolutions
be adopted,
which motion was seconded by Alderman Curlee and carried by
the following vote:-
Yeas:- Bralley, Bonner, Curiae, Shepherd, McDowell.
Nayes:- None.
RESOLUTION NO. 1.
BE IT RESOLVED by the Board of Aldermen of the City of Wichita
Falls, Texas, that it is hereby declared to be a public necessity to
build, erect and construct sidewalks and driveways in front of the
following described property situated in the Citty of Wichita Falls,
Texas, said property being described as follows:

Said sidewalks and driveways shall be built, erected and con-
structed, strictly in accordance with the plans and specifications
prepared and made by the City Engineer and on file in the office of
the City Clerk of Wichita Falls,Texas.
Be it further resolved that the City Engineer speedily prepare
a preliminary estimate of the cost of said improvements and present
same to the Board of Aldermen for their approval and that the City
Clerk make the proper publication of these resolutions.

RESOLUTION NO. 2.
RESOLUTION ORDERING ERECTION AND CONSTRUCTION OF CERTAIN SIDE-
WALKS AND DRIVEWAYS IN FRONT OF THE FOLLOWING PROPERTY:

IR THE CITY OF WICHITA FALLS, TEXAS.
BE IT RESOLVED by the Board of Aldermen of the City of Wichita
Falls, i'exas, that the above described sidewalks and driveways shall
be improved in the following manner, to-wit:
That the said sidewalks and driveways shall be built erected
and constructed in strict accordance with the plans and specifics»
tions to be furnished therefor by the City Engineer of the City of
Wichita Fails, Texas, and shall be of concrete material. Bids shall
be taken for said work and said improvements shall be done with said
concrete material and under such methods and plans as may be sdleo-
ted by the Board of Aldermen after the bids are received.
That the entire cost of said improvements shall be paid by
the owners of property which abut, on said sidewalks and are in
front of same. Said amount shall be paid, one half in cash upon the
completion and acceptance of said work by the City, and the balance
in thirty days therefrom, which deferred payments shall bear Eight.
(8%) per cent interest per annum from date until paid.
That the costs payable by the owners of said abutting property
shall be assessed against the saidownars and against their said
property in accordance with the terms of the General Laws of the
State of Texas, and in accordance with what is known as the "front
foot plan or rule," as the frontage, of the property of each owner
is to the whole frontage of the property of each owner is to the
whole frontage of property on the said streets named to be paved;`
provided that if the application of this rule would, in the opinion
of the Board of Aldermen in particular cases, be unjust or unusual
it will be the duty of said Board of Aldermen to assess and app-
ortion said cost i,n such proportion as it may deem just and equitable
having in view the special benefits in enhanced value to be received
by each owner of said property, so as to produce a substantial equ-
ality of benefits by, and burdens imposed upon, each owner.
That no assessments shall be made against any such ows r or
his property until after notice has been given such owner and a
hearing is provided by the General Laws of the State of Texas, and
provided that no assessment shall be made against any owner or' ie
property in excess to the benefits to such property in enhanced
value thereof by said improvement.
That the Engineer of the C`ty of Wichita Falls, Texas is here-
by directed at once to prepare specifications and file the same with
the Board of Aldermen for each of the hereinable described pavemehts
w improvements.
That, in the specifications prepared, provisions shall be made
for requiring all contractors to give a maintenance bond fob a term -
of not longer than five years, for the maintenance of the _
hereinable described.
That such specifications shall a uire,.the bidder to make a
bid upon the various above named r materials o-€-•-:impro've-
msnta; with a maintenance bond as herein provided.
The said specifications shall also state the amount of the
construction bond required to be given, as well as the method by
which it is proposed to pay the cost of the said pavement; said
method being in accordance with this resolution.
The Board of Aldermen then adjourned.
