The Board of Aldermen of the City of Wichita Falls, Texas, met in
regular session on the above date with the following present:

Moved by Alderman Curlee that the "Hearing"of the property holders
on Ohio Avenue and Brook Street, originally set for 14th March and then post-
poned until the 21st March be again postponed until Thursday the 24th day of
Maroh 1921, at 3P. M. in the Council Chamber,
which motion was seconded by Alderman Bonner and carried.

Moved by Alderman Bonner, seconded by Alderman Curlee that the foll-
owing Resolution be adopted,
whioh motion was carried by following vote:-
Yeas: Shepherd, Bralley, Bonner, Curlee.
Hayes: Drone.
"Be it resolved by the Board of Aldermen of the City of Wichita
Falls, Texas;-
That whereas, the Board of Aldermen of the City of Wichita Falls,
Texas, has heretofore ordered the property abutting:-
On Lucile Street:- From East property line Duval Street to 192 feet
from West property line Duval Street, improved by raising, grading and filling
same and installing concrete curbs and gutters and paving with concrete, and
Whereas by Resolution of the Board of Aldermen, adopted on the 14th Feb

1921, it was ordered that a hearing to all property owners abutting on
said portion, of said Street, and all others interested be held in the
Council Chamber in the Morgan Building at 7:30 P. M. on the 14th day of
March and that notice thereof be given, and
WHEREAS, due notice of the time and place of such hearing
was given and such hearing held, and all parties, their agents and att-
orneys and all others desiring to be heard were fully and fairly heard
and at such hearingea the following protests were made:-

protesting against he cos-t of such improvement
(1)
That all protests and objections, whether herein specifically
mentioned or not, be and they are hereby over-ruled.
(2)
That the Board finds from the evidence before it that no
property will be damaged by means of, or as a result of any of said
improvements.
(3)
The Board further finds from the evidence before it that the
proper rule of apportionment of the costs of such improvements is that
applied and shown on the estimates, reports and statements of the City
Engineer, filed on the 14th February 1921, and examined and approved by
the Board, and that such produces and effects substantial equality and
justive between the various lots and parcels of land shown and effected
thereby and the respective owners thereof, and the Board further finds
from the evidence that each naroel or lot of land abutting on said por-
tion of Lucile Street will be benefitted in enhanced value by means of
such improvements on said portion of Licile Street in an amount in excess
of the portion of coats to be assessed against same as shown on said esti-
mates reports and statements of the City Engineer.
That said sums be assessed against said lots or parcels of
property and against the owners thereof, aid the City Attorney is here-
by directed to prepare form of Ordinance levying such assessments in
accordance with the dharter and laws in force in this City and in accord-
ance with the ordinances, resolutions and other proceedings of the City
applicable thereto.
That said hearing be and it is hereby closed as to all part-
ies and as to all said improvements.
That this resolution take effect from and after its passage.

ORDINANCE 344 t2
"An Ordinance amending section three of Ordinance 257 entitled
"An ordinance giving and granting unto the Wichita Falls Traction Co.,
its successors, assigns and lessees the right to operate, construct and
maintain a street oar line over and along certain streets of the City of
Wichita r'alls, Texas, and repealing so much of Ordinances 108 and 187
of the City of Wichita Falls, Texas as requires the Wichita Falls Tract-
ion Co., its successors, assigns and lessees to pave any part of the
streets of Wichita Falls, Texas, occupied by said Street Railway belong-
ing to Wichita Falls 'fraction Co., and so much of said ordinances as
requires the payment of a gross receipts tax of two per cent to said City
when its population reaches twenty five thousand and providing that a
gross receipts tax of two per cent shall be paid by said Wichita Falls
Traction Co., its successors, assigns and lessees, when its net earnings
exclusite of all taxes paid, shall anoint to eight per cent on the amount
of its actual investment.
Moved by Alderman Bonner that Ordinance 344be put on its
third and final reading,
which motion was seconded by Alderman Shepherd and defeated
by following vote:

"AN ORDINANCE DIRECTING THE CITY CLERK TO ADVERTISE FOR BI➢S FOR
THE IMPBOVEIENT OF OHIO AVENUE FROM 6TH STREET TO FRONT STREET".
Moved by Alderman Curlee that. this Ordinance be placed on its first
reading.
which motion was seconded by Alderman Bonner and carried by following
vote:-
Yeas: Curlee, Shepherd, Bonner, Bralley.
Mayes: None.

Moved by Alderman Curiae, that the Mayor be authorized to sign and
execute the easements for Sanitary Sewer across the Fort Worth and Denver Ry
Co., and the Missouri Kansas & Texas Ry. Co's tracks,
which motion was seconded by Alderman Bralley and carried.

On request of property owners on Brook Street, and Ohio Avenue,
Alderman Curlee moved that the hearing of property owners on Ohio Avenue, and
Brook Street be further adjourned until March 2tth, 1921, at 3:00 P. M. at
Council Chamber in the Morgan Building.

Mr Boone, Attorney for Fort Worth & Denver Ry. Co., as well as cer-
tain other property holders on Ohio and Brook, requested an adjournment of the
hearing on Ohio Avenue, until Staurday March 26th 1921, and Alderman Curiae
moved that the Meeting be adjourned until 3 P. M. Saturday March 26th, A. D. 1921.
which motion was seconded by Alderman Bonner and carried.
The Council then adjourned until Saturday at 3 P. M. March 26th,A. D.
