Moved by Alderman Reed that the Spot Cash Grocery Co., be permitted
to operate a Grocery Store at 1108, Thirteenth, and that P. R. MoLemore be per-
mitted to operate a Bakery & Grocery Store on Lot 8 Blk. 4 Floral Heights Addit-
ion to City of Wichita Falls, Texas, under the conditions as shown by following
contracts,

PROVIDING FOR A PENALTY".
was on motion of Alderman Shepherd, seconded by Alderman Curlee,

Blocks 34 and 35, Barwise & Jalonio Addition for a "Tourist Park", for consider-
ation of Eight Thousand one hundred and twenty dollars ($8120.00) to be paid as
follows:- Four thoasand dollars cash. ($4000.00)
Note on or before one year from date, Two Thousand and Forty Dollars,
($2040,00)
Note on or before two years from date, Two Thousand and Eighty Dollars
($2080.00)
Notes drawing six per cent per annum be now ratified and approved and
the City Clerk authorized to issue warrant for $;4000.00 and the Mayor

RESOLUTION DECLARING THE NECESSITY OF IMPROVING SUNDRY PORTIONS OF
STREETS, STATING THE NATURE OF SLICE IMPROVEMENT AND THE METHOD BY WHICH IT IS
PROPOSED THAT PAYNENI BE MADE THEREFOR, AND DIRECTING THE CITY ENGINEER TO HAVE
PLANS, PROFILES, SPECIFICATIONS AND ESTIMATES OF THE PROPOSED IMPROVEMiENTS PRE-
PARED:
BE IT, AND IT IS HEREBY RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS: THAT,
I.
It is necessary that Ohio Avenue, from the South property line of
Sixth Street to 80 feet North of the North property line of Front Street, and
Indiana Avenge, from the South property line of Front street to the North prop-
erty line of Sixth Street; and, the North side of Sixth Street, from the West
property line of Ohio Avenue to the West property line of Indiana Avenue; and
Fifteenth Street, from the West property line bf Lamar Street to the center line
of Grace Street; and, Elizabeth Street from the center line of Grace Street to
1 foot West of the West property line of Marshall Street; and, Holliday Street,
from the South property line of Fifteenth Street to the North property line of
Seventeenth Street; and, Filmore Street, from the South property line of Tenth
Street to the North property line of Avenue F; be improved by raising,grading,
filling and paving the same, and installing concrete, curbs and gutters, and that
same be improved with one of the following methods and materials, to-wit:
(a) Warrenite Bitulithic
(b) Uvalde Rock Asphalt.
(c Concrete
(d Asphaltic Concrete.
(e)
with concrete or crushed stone foundation,or other stable and permanent found-
ation.

II.
The City Engineer is hereby direoted to have plans, profiles, speci-
fications and estimates embracing each of the foregoing materials and plans of
improvement prepared, and to file the same with the Board of Aldermen, the City
Engineer being so direoted, there being no City Manager.
III.
The said improvements shall be paid for in the following manner,
to-wit:
The benefitted and abutting property, and the owners thereof, shall
be assessed and pay for all of the oast of installing curbs and three-fourths
of the remaining oast of such improvements, and the City of Wichita Falls, shall
pay the remainder.
The sums payable by the benefited property and the owners thereof shall
be payable in three equal installments, the first of which shall be due on or be-
fore thirty (30) days after the completion and acceptance by the city of such
improvements, the second shall be due on or before one (1) year after such com-
pletion and acceptance, and the third on or before two (2) gears after said com-
pletion, and acceptance. The entire amount of such sums shall bear interest
from the date of such completion and acceptance and until paid at the rate of :a
per annum payable annually, but such Property, and the owners thereof, shall
have the privilege of paying any or all of such installments at any time before
maturity, and the failure to pay any installment upon the maturity thereof shall
at the option of the owner and holder of the certificate of special assessment
issued in evidence thereof, mature the entire amount then unpaid; s,nd the sums
payable by the respective lots or parcels of pronerty abutting upon the said imp-
rovement, and benefited thereby, shall be assessed against such lots or parcels
and against the owners thereof, and shall be a personal liability of suoh owner
and a first and prior lien and charge against such pronerty, superior to all
other liens, claims and charges and demands of whatsoever kind, excepting only
State, County and Bunioipal taxes.
No assessment shall be levied against any lot or parcel of land or the
owner thereof, in excess of the special benefits to such lot or parcel of land
in enhanced value thereof by means of eab.h improvement, and no assessment shall
be levied until after the notice and hearing as providedin the Charter and Laws
in force and effect in this city, and in the ordinances and proceedings of the
Board of aldermen applicable thereto.
IV.
Upon the completion and acceptance of suoh improvements, if same shall
have been performed by contract, then certificates in evidence of the assessments
levied against the respective lots or parcels of property, and the owners there-
of shall be issued to the contractor or party performing and exeepting the work -
of such improvement and containing recitals lawful and properly applicable there-
to, and the said improvements shall be executed, and the said matters filed,said
notice and hearing ordered given, and ordinance levying the assessment, and any
other matters with reference to said improvement shall be done and performed in
the manner and form provided by the Charter and Laws in force and in effect in
this city, and the proceedings, ordinances and resolutions of the Board of Alder-
men.
V.
Each portion of street herein ordered to be improved shall be and is
a distinct unit of improvement, separate and distinct from that of each and every
ofsher portion of street, and this resolution is intended to have, and shall have
the same effect as if a separate and distinct resolution had been passed and ad-
opted for each a c h portion of street, and separate acceptances of work,eeparate
assessments and separate proceedings shall be had for each such portion of street
and if contracts be let, separate contracts for each suoh Portion of street shall
be made and separate bonds made accordingly.
VI.
This resolution shall take effect from and after its passage.

TO THE HONORABLE MAYOR, AND BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS:
In compliance with the resolution of the Board of aldermen with ref-
erence to the improvement Ohio Avenue, from the South property line of Sixth
Street to 80 feet North of the North property line of Vront Street; Indiana Ave-
nue from the South property line of r'ront Street to the North property line of
Sixth Street; North side of Sixth Street from the West property line of Ohio
Avenue to the West property line of Indiana Avenue; Fifteenth Street from the
West property line of Lamar Street to the center of Grace Street; Elizabeth Street
from center line of Uraoe Street to 1 foot West of the West pronerty line of
Marshall Street; Holliday Street, from the South pronerty line of Fifteenth Street
to the North property line of Seventeenth Street; Filmore Street, from the South
property line of Tenth Street to the North property line of avenue F; I have
prepared and hand you herewith plans, profiles, specifications and estimates of
the proposed improvement, the same embrces the different materials, plans and
methods of improvement set forth and specified in the said resolution.
The specifications herewith are the same for each street and may be
regarded and acted upon the same as if distinct sets were filed for each portions
of street. Separate specifications for each street would be only duplicates of
those herewith handed you.

RESOLUTION APPROVING AND ADO'TING PLANS,PROFILES, SPECIFICATIONS,
AND ESTIMATES OF THE PROPOSED IMPROVEMENT OF PORTIONS OF SUNDRY STREETS IN THE
dITY OF WICHITA FALLS, TEXAS, AND DIRECTING THE CITY CLERK TO ADVERTISE FOR
COMPETITIVE BIDS FOR THE h`AVTNG AND CONSTRUCTING OF SUCH IMPROVELIEFTS. .
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS
TEXAS:
WHEREAS, by resolution passed on the 23rd day of Hay, A. D., 1921,
the Board of Aldermen of the City of Wichita Falls, declared the necessity of
improving portions of Ohio Avenue, Indiana Aveneu, the North side of Sixth Street
Fifteenth Street, Elizabeth Street, Holliday Street and Filmore Street in said
City, by raising, grading and filling same, and paving materials and in one of
the manners and methods stated in the said resolution, and gave the method by
which it was proposed that payment be made therefor, and directing the City Eng-
ineer to have plans, profiles, specifications and estimates of the proposed imp-
rovement prepared; and,
WHEREAS , the said City Engineer has prepared such plans, profiles,
specifications and estimates and has filed the same with the Board of aldermen,
and the same have been inspected and examined and corrected, where necessary:
I.
That the said plans, profiles and specifications and estimates, be
and they are hereby adopted and approved as those under, by, and in accordance
with which the said improvements shall be made and constructed.
II.
That the City Clerk be add he is hereby directed to advertise for
competitive bids for the making and constructing of the said improvements, in the
manner and for the length of time and in the form required and crop*ided by the

City Charter and laws in force and in effect at this time, and by the ordinanoes
and proceedings of this Board, and such bids will be receiveduntil and shall be
opened on the 6th day of June 1921 at 8 o'clock, P. M., and all bids shall be
made in the form and in the manner, and accompanied by certified cheek and by the ..
guarantee providOd'°and required by the said specifications.
III.
Any bid made will be regarded as a senarite bid for each street and
as a bid for separate contract for each street, but bids by so stating may be con
fined to any one or more streets.
IY.
This resolution shall take effect from and after its passage.
The Board of Aldermen then adjourned.
