The Board of Aldermen of the City of Wichita Falls, Texas, met
in regular session on the above date with the following present:-

ORDINANCE 373
"AN ORDINANCE GIVING AND GRANTING TO THE WICHITA FALLS TRACTION CO
ITS SUCCESSORS, ASSIGNS, AND LESSEES, TEs RIGHT, TO EXTEND, CONSTRUCT AND OPER-
ATE A STANDARD-GUAGE CAR LINE OR LINES ON,OVER, ACROSS AND UPON THE FOLLOWING
DESCRIBED AND NAMED STREETS IN TEE CITY OF WICHITA FALLS, TEXAS, TO-WIT:
(a) Beginning at a podtnt where Ninth Street intersects with Broad
Street; Thence in an Easterly direction along Ninth Street to a point where
it intersects with Ohio Avenue.
(b) Beginning at a point where Eighth Street intersects with Ohio
Avenue; Thence in an Westerly direction along said Eighth Street to a point
Where it intersects with Indiana Avenue.
(o) Beginning at a point where 13th Street intersects with Broad
Street; Thence in a Westernly direction along 13th Street to a point where it
intersects with Clark Street; Thence along Clark Street in a Southernly direct-
ion to a point where it intersects with Collins Street.
Providing that said tracks shall be laid in conformity wi th the fran-
chise heretofore granted to 3. A. Kemp, and Frank Kell on the 27th day of Jany.
1910, and all of the amendments thereto, and the provisions and conditions of
said franchise and amendments thereto are expressly made applicable to this
ordinance, except however, as otherwise provided in this ordinance."
Was on motion of Alderman Curlee, seconded by Alderman Shepherd planed
on its first reading and passed by the following vote:-
Yeas:- Bralley, Reed, Curlee, Shepherd.
Nayes: None.

Moved by Alderman Curiae that Notice of Ordinance 373, be arranged
for by City Attorney and publication be made for Public hearing to be held
July 5th, 1921, at 1.00 P. M.,
which motion was seconded by Alderman Shepherd, and carried.

ORDINANCE 372
"AN ORDINANCE PROVIDING FOR THE COT,T,FCTION AND DISPOSAL OF TRASH
AND GARBAGE, PROVIDING FOR CERTAIN FEES THAT MAY BE CHARGED FOR HAULING SAME
AND REQUIRING ANY ONE SO ENGAGED TO GET A PERMIT AND GIVE A. BOND AND PROVIDING
FOR A PENALTY AND AN EMMRGENCY".
was on moti-0n of Alderman Cnrlee, seconded by Alderman Shepherd,
placed on its second reading and passed by the following vote:

Moved by Alderman Curlee "That, Whereas petition has been received
from the owners of property on Harrison Street between 7th & 8th Street asking
that sidewalks be ordered in on both sides of Street, that sidewalks are here-
by ordered put in and the following Resolutions approved".
Motion carried by following vote:-
Yeas: Reed, Bralley, Curlee, Shepherd.

BE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls
Texas, that it is hereby declared to be a public necessity to build, erect and
construct sidewalks and driveways in front of the following desoribed property
situated in the City of Wichita Falls, Texas, said property being described
as follows:
Berrison Street, both sides, between 7th and 8th Street.
Said sidewalks and driveways shall be built, erected and constructed,
strictly in accordance with the plans and specifications prepared and made by
the City Engineer and on file in the office of the City Clerk of Wichita Falls,
Texas.
Be it further resolved that the City Engineer speedily prepare a
preliminary estimate of the cost of said improvements and present same to the
Board of Aldermen for their aprroval and that the City Clerk make the proper
publication of these resolutions.

RESOLUTION ORDERING ERECTION AND CONSTRUCTION OF CERTAIN SIDEWALKS
AND DRIVEWAYS IN FRONT OF TBE FOLLOWING PROPERTY:
Harrison Street, both sides, between 7th and 8th Street.
IN THE CITY OF WICHITA FALLS, TEXAS.
BE IT RESOLVED by the Board of Aldermen of the City of Wiohita Falls,
Texas, that the above described sidewalks and driveways shall be improved in
the following manner, to-wit:
That the said sidewalks and driveways shall be built erected, and
constructed in strict accordance with the plans and specifications to be furn-
ished therefor by the City Engineer of the City of Wichita Falls, Texas, and
shall be of concrete material. Bids shall be taken for said work and said
improvements shall be done with said concrete material and under such methods
and plans as may be selected by the Board of Aldermen after the bids are rec-
eived.
That the entire cost of said improvements shall be paid by the owners
of property whid3h abut, on said sidewalks and are in front of same. Said amount
shall be paid, one half in cash upon the completion and aooeptance of said wokk
by the City, and the balance in thirty days therefrom, which deferred payments
shall bear eight (8%) per cent interest per annum from date until paid.
That the costs payable by the owners of said abutting property shall
be assessed against the said owners and against their said property in accord-
ance with the terms of the General Lawsof the State of Texas, and in accordance
with what is known as the "front foot plan or rule," as the frontage, of the
property of each owner is to the whole frontage of the property of each owner
is to the whole frontage of property on the said streets named to be paved;
provided that if the application of this rule would, in the opinion of the Board
of Aldermen in particular cases, be unjust or unequal it will be the duty of
said Board of Aldermen to assess and apportion said cost in such proportion as
it may deem just and equitable having in view the special benefits in enhanced
value to be received by each owner of said property, so as to produce a sub-
stantial equality of benefits by, and burdens imposed upon, each owner.
That no assessments shall be made against any such owner or his
property until after notice has been given such owner and a hearing is pro-
vided that no assessment shall be made against any owner or his property in
excess to the benefits to such property in enhanced value thereof by said imp-
rovement.

That the Engineer of the City of Wichita Palls, Texas, is hereby
directed at once to prepare specifications add file the same with the Board of
Aldermen for each of the hereinabove described pavements or improvements.
That in the specifications prepared, provisions shall be made for
requiring all contractors to give a maintenance bond for a term of not longer
than five years, for the maintenance of the improvements hereinabove described.
That such speoifioations shall reqire the bidder to make a bid upon
the various above named improvements or materials, with a maintenance bond as
herein provided.
The specifications shall also state the amount of the construction
bond required to be given as well as the method by which it is proposed to
pay the cost of said pavement; said method being in accordance with this res-
olution.

Moved by Alderman Curlee,that in as much as it is noessary to act
on certain paving matters at the earliest opportunity, that the Board of
Aldermen adjourn until 10 A. M. Saturday June 18th, 1921.

Moved by Alderman Curlee that the report and recommendation of the
City Engineer that the paving on 100 feet on Ninth Street, west .of Buciahan
a portion of Lucile, and a portion-of Brook Street, be accepted and approved
and that the said paving is hereby accepted by the City of Wichita Falls,
Texas, and that the Mayor and City Clerk be authorized to issue paving certif-
icates to the contractors.
which motion was seconded by Alderman Shepherd, and carried.
