The Board of Aldermen of the City of Wichita Falls, Texas, met •in regular session on the above date with the following present:- W. D. Cline, Mayor W. S. Curiae I J. B. Fitts T Aldermen R. E. Noble resigned and Alderman Fitts moved that this nomination be ratified and approved. Motion seconded by Alderman Curlee and carried. ###############H##### Moved by Alderman Curlee that it be declared a public necessity to curb and pave Burnett Street from S. P. L. Tenth Street to the Wichita Valley tracks. Motion seconded by Alderman Fitts and carried by the following vote:- Yeas: Curlee, Fitts, Shepherd. Nayes: None. ## r;##########f ###### -'. RESOLUTION RESOLUTION DECLARING THE NECESSITY OF IMPROVING BURNETT STREET FROM SOUTH PROPERTY LINE TENTH STREET TO THE WICHITA VALLEY TRACKS, STATING THE NATURE OF SUCH IMPROVEMENTS AND THE METHOD BY WHICH IT IS PROPOSED THAT PAYMENT BE MADE THEREFOR, AND DIRECTING THE CITY ENGINEER TO HAVE PLANS, PROFILES, SPECIFICATIONS AND ESTIMATES OF THE PROPOSED IMPROVEMENTS PREPARED. BE IT, AND IT IS HEREBY RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: I. It is necessary that the following portions of Street, to-wit: Burnett Street from South Property Line Tenth Street to Wichita Valley tracks, be improved by raising, grading, filling and paving the same and instal- ling conorete curbs and gutters, and that the same be improved with one of the following methods and materials, to-wit: (a Concrete (Reinforced) (b Brick (c Warrenite-Bitulithie (d) Uvalde Rock Asphalt And one of such portions of Burnett. Street may be improved with one of said materials, and the other portion with another of the said materials, or both portions may be improved with the same material; and bids shall be rec- eived and advertised for on both portions and on each portion; and each portion of such street shall constitute a separate unit of improvement, and the under- taking of the contractor as to each such portion or unit shall be separate and independent, or separate contracts for each such portion may be let. II. The City Engineer is hereby directed to have plans, profiles specific- ations and estimates embracing the foregoing materials and plans of improvements prepared, and to file the same with the Board of Aldermen, the City Engineer being so directed, there being no City Manager. III. The said improvements shall be paid for in the following manner,to-wit: The benefited and abutting pro erty, and the owners thereof shall be assessed and 'pay for all of the cost of installing curbs and three-fourths of the remaining cost of such improvements, and the City of Wichita Falls shall pay the remainder. . , t The sums payable by the benefited property and the owners thereof shall be payable in five equal installments, the first of which shall be due on or before thirty (30) days after the completion and acceptance by the City of such improvements, . 372 , and the second shall be due on or before one (1) year after Bush completion and acceptance, and the third on or before two (2) years after said completion and acceptance, and the fourth on or before three (3) years after said completion and acceptance,and the fifth on or before four (4) years after such completion and acceptance. The entire amount of the sums shall bear interest from the date of such completion and acceptance and until paid at the rate of :"• per annum, payable annually, but such property, and the owners thereof, shall have the privilege of paying any or all of such installments at any time before maturity, and the failure to pay any installments at any time before maturity, and the failure to pay any installments upon the maturity thereof shall at the option of the owner and holder of the cer- tificate of special assessment issued in evidence thereof, mature the entire amount then unpaid; and the sums payable by the respective lots or parcels of p property abutting upon the said improvements, and benefited thereby, shall be assessed against such lots or parcels and against the owners thereof, and shall be a personal liability of such owner and a first and prior lien and charge against such property, superior to all other liens, claims and charges and de- mands of whatsoever kind, excepting only State, County and Municipal taxes. No assessment shall be levied against any lot or parcel of land or the owner thereof, in excess of the special benefits to such lot or parcel of land in enhanced value thereof by means of such improvement, and no assessment shall be levied until after the notice and hearing as provided in the Charter and Laws in force and affect in this City, and in the ordinances and proceedings of the Board of Aldermen applicable thereto. IV. Upon the completion and acceptance of such improvements, if same shall have been performed by contract, then certificates in evidence of the assessments levied against the respective lots or parcels of property, and the owners there- of, shall be issued to the contractor or party performing and executing the work of such improvement and containing recitals lawful and properly applicable there- to, and the said improvements shall be executed, and the said matters filed, said notice and hearing ordered given, and ordinance levying the assessment, and any other matters with reference to said improvement shall be done and performed in the manner and form provided by the Character and laws in force and in effect in this City, and the proceedinbe, ordinances and resolutions of the Board of Alder- men. V. This resolution shall take effect from and after its passage. # ########## # Moved by Alderman Curlee that the plans, profiles, specifications and estimates of proposed improvement on Burnett Street be approved and that the following Resolution be adopted. Motion seconded by Alderman Shepherd and carried by following vote:- Yeas: Curlee, Shepherd, Fitts, Hayes: Bone. # vim##r########' ####### RE S O LUT ION RESOLUTION APPROVING AND ADOPTING PLANS, PROFILES, SPECIFICATIONS AND ESTIMATES OF THE PROPOSED IMPROVEMENT OF BURNETT STREET FROM SOUTH PROPERTY LINE TENTH STREET TO ,WCHITA VALLEY TRACKS, IN THE CITY OF WICHITA FALLS, TEXAS AND DIRECTING THE CITY CLERK TO ADVERTISE FOR COMPETITIVE BIDS FOR THE MAMING AND CONSTRUCTING OF SUCH IMPROVEMENTS. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS: THAT Zq WHEREAS, by resolution passed on the nth day of February, A. D. 1922, the Board of Aldermen of the City of Wichita Falls,cjeclared the necessity of improving Burdett Street from South property line, tenth Street to Wichita Valley Tracks, by raising, grading and filling same, and paving same and installing con- orate curbs and gutters with the materials and in the manners and methods stated in the said resolution, and gave the method by which it was proposed that payments be made therefor, and directing the City Engineer to have plans, profiles, spec-_ ificatione and estimates of the proposed improvement prepared; and, WHEREAS, the City Engineer has prepared such plans, profiles, specifi- cations and estimates and has filed the same with the Board of Aldermen, and the same have been inspected and examined and corrected, where necessary; 37'3 • • I. That the said plane, profiles, and specifications and estimates, be and they are hereby adopted and approved as those under, by, and in accordance with which the said improvements shall be made and constructed. 2. That the City Clerk be and he is hereby direoted to advertise for competitive bids for the making and construction of the said improvements, in the manner and for the length of time and in the form required and provided by the City Charter and Laws in force and in effect at this time, and by the ord- inances ant proceedings of this Board, and such bids will be received until and shall be opened on the z day of 1922, at o'clock P.M and all bids shall be made in the form and in manner and accompanied by certif- ied check and by the guarantee provided and required by the said specifications. 3. This resolution shall take effect from and after its passage. # # H Moved by Alderman Fitts that W. S. Curlee be authorised to offer $2,000.00 for the two lots needed by the City to open Broad Street into Sibley Taylor Addition. Motion seconded by Alderman Shepherd and carried. Moved by Alderman Curlee that in the event the above mentioned lots could not be bought for $2,000.00 that the City Attorney be instructed to file condemnation proceedings on said lots. Motion seconded by Alderman Fitts and carried. Moved by Alderman Curlee that the Wichita County Water Improvement Diatrict No. 1 be granted a franchise to run an electric power transmission line within the limits of the City of Wichita Falls, as follows:- February 23rd, 1922. To the Honorable The Mayor and City Council City of Wichita Falls, Texas Gentlemen: Your petitioner, the Wichita County Water Improvement District No. 1, respectfully requests your permission to build an electric power transmission line within the limits of the City of Wichita Falls, as follows:- BEGINNING at the plant of the Wichita Falls Electric Company, and on the land privately owned by this company, at or near the intersection of the south line of Twenty-First Street with the west property line of maid company. Thence westerly along the south line of said Twenty-first to the intersection of said line with the south line of Sibley Avenue; Thence westerly with the south line of Sibley Avenue to the east line of Holliday road, Thence across Holliday road to the south line of Ervay Street, Thence with south line of Ervay Street to the south line of the Wichita Valley Railroad, and across said railroad right of way to the south line of Railroad Street; Thence with south line of Railroad Street which is the north line of. Wichita Valley Railroad right of way, westerly to the west line of Harrison Street Thence with the north line of said Wichita Valley Railroad right of way to the west city limits of the city of Wichita Falls. Said electric power line is necessary to be built by said District for the purpose of furnishing power for use in the pperation of the hydraulic dredge which will construct the main embankment of the storage dam of said District across Big Wichita River about 40 miles west of the City of Wichita Falls. 374 Said power line will have a voltage of 38,000 volts and be built on cedar poles within the city limits of Wichita Falls, not less than 40 feet in length, and so much longer as may be necessary to give proper Clearance over telephone and other wire lines, spacing not exceeding 200 feet apart. Said line is to be of first elate standard construction using three • aluminum wires, mounted in triangular configuration. The District agrees to construct said line in accordance with such rules and regulations as your council may issue. Owing to the fact that the District must being the construction of this power line at an early date, the prompt action of your honorable council is respectfully solicited. • very respectfully WICHITA COUNTY WATER IMPROVEMENT DISTRICT No.1 ################# ORDINANCE 392 "AN ORDINANCE ORDERING THE IMPROVEMENT OF A PORTION OF INDLANA STREET . VIDING FOR THE CONSTRUCTION THEREOF BY SONTRACT, AND PROVIDING FOR THE PAYMENT OF THE COST OF SUCH IMPROVEMENTS, LEVYING ASSESSMENT THEREFOR, AND FIXING THE TERMS AND TIMES OF PAYMENT AND THE RATE OF INTEREST THEREON AND PROVIDING FOR THE ISSUANCE OF ASSIGNABLE CERTIFICATES". was on motion of Alderman Shepherd seconded by Alderman Fitts placed on its third and final reading and passed by the following vote:- Yeas: Curlee, Shepherd, Fitts. Hayes: None. ############# ORDINANCE, 393 "AN ORDINANCE REGULATING THE SALE OF PETROLEUM PRODUCTS PROHIBITING THE SALE OF SUCH PRODUCTS EXCEPT AS SPECIFIED PROVIDING FOR AN INSPECTION OF SAID PRODUCTS: METHODS OF TESTING THEREOF LEVYING FEES AND PROVIDING A PENALTY". was on motion of Alderman Curlee, seconded by Alderman Fitts placed on its second reading and gassed by the following vote:* Yeas: Fitts, Curlee, Shepherd. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS TERAS,'.THAT 375 u -.-- An Election is hereby called on the Fourth day of April A. D. 1922 for the purpose of electing a Mayor and also for the purpose of electing two Aldermen which are designated as Place No. 1, Public Utility Alderman and Place o. 2, Street Alderman, for said City to serve for the ensuing two years and sand election shall be held in accordance with the laws of the State of Texas. and Ordinances and Charter of the City of Wichita Falls, Texas, made and provided in such cases. To the Mayor and Board of Aldermen, City of Wichita Falls, Texas. Gentlemen:- We have bid upon specifications and contract for the improvement of Eleventh Street from Lamar Street to Grace Street. It is agreeable to us that the contract be modified so as to eliminate the blocks between Lamar Street and Austin Street, leaving the contraot to cover the area from Austin Street to Grace Street.
