Min 04/10/1922 Morgan Building Wichita Falls, Texas April 10th 1922 • The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date with the following present:- W. D. Cline, Mayor J. B. Fitts J. F. Reed i W. S. Curlee 4 W. N. Bonner R. E. Shepherd 0 Geo. W. Thorburn, City Clerk ####4###4###### Moved by Alderman Curlee that the Whitehill Construction Co. be permitted to use 10 feet on 8th Street in front of the General Hospital for washing gravel. Motion seconded by Alderman Shepherd and carried. ######f######M# ORDINANCE 405 "AN ORDINANCE ORDERING THE IMPROVEMENT OF A PORTION OF ELEVENEi STREET DET7EEN THE WEST PROPERTY LINE OF AUSTIN STREET AND THE EAST $BOPEYTY LINE OF GRACE STREET DESIGNATING THE MATERIALS AND METHODS OF IMPROVEMENT, AND PROVIDING FOR THE CONSTRUCTION THEREOF BY CONTRACT,AND PROVIDING FOR THE PAY- MENT OF THE COST OF SUCH IMPROVEMENTS LEVYING ASSESSMENT THEREFOR, AND FIXING THE TERMS AND TIMES OF PAYMaTT, AND THE RATE OF INTEREST THEREON, AND PROVIDING FOR THE ISSUANCE OF ASSIGNABLE CERTIFICATES". Was on the motion of Alderman Curlee seconded by Alderman Shepherd placed on its first reading and passed by the following vote:- Yeas: Reed, Fitts, Bonner, Shepherd, Curlee. Nayes: None. • Moved by Alderman Curies that the rules requiring ordinances to be read on three separate days be suspended and an emergency declared. Motion seconded by Alderman Shepherd and carried by the foll- owing vote:- Yeas: Reed, Fitts, Bonner, Shepherd, Curlee. Nayes: None. Moved by Alderman Reed that Ordinance 405 be placed on its second reading. Motion seconded by Alderman Curlee and carried by the follow- ing vote:- Yeas: Reed, Bonner, Shepherd, Fitts, Curlee. Nayes: None. Moved by Alderman Curlee, that Ordinance 405 be placed on its third and final reading; Motion seconded by Alderman Shepherd and carried by the foll- owing vote:- Yeas: Reed, Fitts, Bonner, Shepherd, Curlee. Nayes: None. ############### Moved by Alderman Curlee that the following Resolution be ad- opted:- Motion seconded by Alderman Shepherd and passed by the follow- ing vote:- Yeas: Reed, Bonner, Fitts, Curlee, Shepherd. . Nayes: None. ################## RESOLUTION WHEREAS, contract In writing between City of . ichita Falls,and West Texas Construction Company, for the improvement of the following street in said City, to-wit: 40►6 r Eleventh Street, from the West Property line of Austin Street to the East property line of Grace Street, together with construction bonds and maintenance bonds required thereby, are this day presented to the Board of Aldermen for adoption and approval; and, WHEREAS, the bid of West Texas Construction Company for the making and construction of the improvements provided for in the said contracts has after due advertisement and notice, been made and upon the opening of the bids said contract was awarded to the said Company; and WHEREAS, it is deemed necessary to set aside and provide for the payment of all that portion of the cost required in the said contract to be paid for by the City of Wichita Falls: Therefore, be it resolved by the Board of Aldermen of the City of Wichita Falls, that there be and is hereby set aside and appropriated out of the funds available for that purpose, the sum of ,":12,868.23 to pay and de- fray all that portion of the cost of improving said portion of Eleventh Street, to be paid for by the City of Wichita Falls: The said contract and the construction bond and maintenance bond, be and the same are hereby approved and adopted, and the Mayor is here- by authorized to exenute and sign the said contract, in the name of the City. That this resolution shall take effect from and after its passage. Approved and passed this day of Larch 1922 Signed:- W.D.Cline, Mayor ATTEST:- City Clerk The Board of Aldermen then proceeded to canvass the election returns for election held April 4th 1922 and when this was completed Alderman Bonner moved that the following resolution be adopted:- Motion seconded by Alderman Curlee and carried by the follow- ing vote:- Yeas: Reed, Fitts, Shepherd, Curlee, Bonner. Nayes: None. ############## That Whereas, at a regular meeting of the Board of Aldermen of the City of Wichita Falls, Texas, held at its regular meeting place in the basement of the Morgan Building in said City, on the 10th day of April A. D. 1922, at which a quorum was present, came on to be considered the returns of the City Election held on the 4th day of April 1922, for the purpose of elect- ing a Mayor and two Aldermen for the City of Wichita Falls, and, Whereas it appearing after canvassing the returns of said election that it was duly and legally held in all respects, that the returns thereof were in due form and legally made, and that there-were cast at said election 2730 votes, and that For Mayor, Frank Collier received 1979 votes, J. W. Stone, " 552 votes, 0. B. Kelley, " 170 votes,— Bobby Burns, IT 1 vote For•Alderman Place No. One Burton A. Stayton, received 1466 votes, J. B. Stokes, " 1220 " J. J. Manley " 2 " For Aldermen Place No. Two, N. M. Clifford received 1137 votes, D. M. Perkins, " 997 " Nat Inge, " 544 " B.Z Lambs " 1 " H. L. McGregor " 1 " And it appearing that Frank Collier received the greatest number of votes cast at said election for Mayor, that Burton A. Stayton rec- eived the greatest number of votes cast at said election for Aldermen Place No. One, and that N. Y. Clifford received the greatest number of votes cast at said election for Aldermen Place No. Two, 407 Therefore be it Resolved by the Board of Aldermen of the City of Wichita Falls, Texas, in regular session assembled, that Frank Collier was duly and %egally elected Mayor of the City of Wichita Falls, at said Election, that Burton A. Stayton was duly and elected Alderman Place No. One of said City at said Election and that N. M. Clifford was duly and legally elected Aldermen Place No. Two of said City at said Election, and that said election was in all respects legally held in accordance with the laws of the State of Texas, the Charter and Ordinances of said City. ################### Frank Collier, Burton Stayton and N. M. Clifford then took the oath of office and took their places at the Council table in place of W. D. Cline, W. S. Curlee, and W. N. Bonner. ################### Mr. Curlee and L. E. Whtiham then took up a matter connected with Indiana Avenue paving with the Board of Aldermen and Alderman Fitts moved that this be referred to the new Street Commissioner N. M. Clifford for a re- port and recommendation on same. Motion seconded by Alderman Reed and carried. #############,:ry rr# Mayor Collier then appointed Harry Nayldr C. H. Reid C. C. Willard ,� as a committee to investigate the per cent of fire damage at �O - ru'K% ################ Mayor Collier then appointed R. E. Shepherd as Mayor Pro-tem ############### A petition from certain hotel operators and proprietors was then read, and Alderman Fitts moved that this petition be filed with the City Clerk and that it be acted on at the next regular meeting. Motion seconded by Alderman Reed and carried. ############## �y I, Isbell, the County Engineer discussed with the Board of Aldermen the� iag of the Henrietta Road and the opening up of a road from Lamar Street hro' the Gulf Pro. Co's property and Alderman Shepherd, moved that the County Engineer,City Engineer, and the Gulf Production Co., Engineer meet and work out a plan to get an opening into Lamar Street. Motion seconded by Alderman Fitts and carried. ############### Moved by Alderman Reed that the Mayor and Finance Commissioner R. E.
