An Ordinance granting a franchise to the Wichita Falls,
Traction Co., to extend their service through Scotland addition was oonsid-
ered and generally discussed but no action was taken.

Moved by alderman Fitts that Judge Chauncey be appointed
as City Reoorder.
Motion seconded by Alderman ±teed, and carried.

Moved by Alderman Fitts that an Auto mechanic be employed
to take care of City cars in the Police, Inspection, and Engineering Depart-
ments.
Motion seconded by Alderman Shepherd and carried.

Moved by Alderman Shepherd that the Water Co., be authorised
to expend ?350.00 to make a small extension to a few residents near Cemetery.
Motion seconded by Alderman Fitts, and carried.

Moved by Alderman Shepherd that it be declared a public
necessity to build, erect and construct sidewalks, curbs, gutters, and drive-
ways, in front of Lots 11 and 13 of Block 62, Floral Heights Addition, and
that the following resolutions be adopted;-
Motion seconded by Alderman Fitts and carried by the foll-
owing vote:-
Yeas: Heed, Fitts, Shepherd, Stayton, Clifford.
Hayes: None.
RESOLUTION # 1.
BE IT RESOLVED BY the Board of Aldermen of the City of Wich-
ita Falls, Texas, that it is hereby declared to be a public necessity to build,
erect and construct, reconstruct or repair sidewalks, curbs, gutters and drive-
ways in front of the following described property situated in the City of Wich-
ita Falls, Texas, said property being described as follows:
Lots Nos. 11 and 13 of Block 62, Floral heights Addition
to the City of Wichita Falls, Texas.
Said sidewalks, curbs and gutters and driveways shall be
built, erected and constructed, strictly in accordance with the plans and
specifications prepared and made by the City Engineer and on file in the off-
ice of the City Clerk of Wichita Falls, Texas.
BE IT FURTHER RESOLVED that the City Engineer speedily pre-
pare a preliminary estimate of the cost of said improvements and present same
to the Board of Aldermen for their approval and that the City Clerk make the
proper publication of these resolutions.
RESOLUTION # 2.
RESOLUTION ORDERING ERECTION AND CONSTRUCTION OF CERTAIN
SIDEWALKS AND DRIVEWAYS IN FRONT OF THE FOLLOWING PROBERTY:-
Lots Nos. 11 and 13 of Block 62, Floral Heights Addition
to the City of Wichita Falls, Texas.
BE IT RESOLVED by the hoard of Aldermen of the City of Wichi-
ta Falls, Texas, that the above described sidewalks, curbs and driveways shall
be improved in the following manner, to-wit:

That the said sidewalks, curbs and gutters and driveways,
shall be built erected and constructed, reconstructed or repaired in striot
accordance with the plans and specifications to be furnished therefor by the
City Engineer of the City of Wichita Falls, Texas, and shall be of concrete
material. Bide shall be taken for said work and said improvements shall, be
done with said concrete material and under such methods and plans as may be
selected by the Board of Aldermen after the bids are received.
That the entire cost of said improvements shall be paid by
the owners of property which abut on said sidewalks and are in front of same.
Said amount shall be paid, one half in eaeh upon the completion and acceptance
of said work by the City, and the balance in thirty days therefrom, which de-
ferred payments shall bear Eight (8%) per cent interest per annum from date
until paid.
That the costs payable by the owners of said abutting pro-
perty shall be assessed against the said owners and against their said prop-
erty in accordance with the terms of the General Laws of the State of Texas,
and in accordance with what is known as the "front foot plan or rule", as the
frontage, of the property of each owner is to the whole frontage of the prop-
erty of each owner is to the whole frontage of property on the said sidewalks
named to be improved; provided that if the application of this rule would,
in the opinion of the Board of Aldermen in particular oases, be unjust or un-
equal, it will be the duty of said Board of Aldermen to assess and apportion
said cost in such proportion as it may deem just and equitable, having in
view the special benefits in enhanced value to be received by each owner of
said property, so as to liroduoe a substantial equality of benefits by, and
burdens imposed upon, each owner.
That no assessments shall be made against any suoh owner
or his property until after notice has been given such owner and a hearing
is provided by the General Laws of the State of texas, and provided that no
assessment shall be made against any owner or his property in excess to the
benefits to such property in enhanced value thereof by said improvements.
That the Engineer of the City of Wichita Falls, Texas, is
hereby directed at once to prepare specifications and file the same with the
Board of Aldermen for each of the hereinabove described improvements.
That, in the specifications prepared, provisions shall be
made for requiring all contractors to give a maintenance bond for a term of
not longer than five years, for the maintenance of the improvements herein-
above described.
That such specifications shall require the bidder to make a
bid upon the above lamed sidewalks and driveways and curbs and gutters or
material of improvements; with a maintenance bond as herein provided.
The said specifications shall also state the amount of the
construction bond required to be given, as well as the method by which it is
proposed to pay the cost of the said improvement; said method being in accord-
ance with this resolution.
RESOLUTION # 3.
Be it resolved by the Board of Aldermen of the City of
Wichita Falls, that specifications presented to the Mayor and Board of Alder-
men by the City Engineer and prepared by him for the improvement of Lots Noe.
11 and 13 of Block 62, Floral Heights Addition to the City of Wichita Falls, Tex-
as, in said City having been given consideration by the Board of Aldermen, be
and the same are hereby approved and adopted as the specifications for the
improvement of said portions of said streets.

Moved by Alderman Shepherd that in order to carefully
consider a franchise asked for by the Wichita Traotion Company and on
whioh it is necessary that they have an answer before the first of June, the
Board of Aldermen adjourn until 7:30 P. M. Wednesday May 31st 1922.
Motion seconded by alderman Stayton and carried.
The Board of Aldermen then adjourned until 7:30 P. M. May
31st, 1922.
