On above date the Board of Aldermen met in regular session and the following business was transacted to-wit:- The following officers answered to roll call: A. H. Britain Mayor. J. F. Reed Alderman. J. A. Richolt J. 7. Bradley J. L. Lea, Jr. I[. J. Gardner " is City Clerk W. A. McCarty, City Attorney Horace Mutt, and City Marshal J. B. Nail in attendance. PERMIT TO Motion was made by J. F. Reed and seconded by J. L. Lea, Jr. that WICHITA the 'Wichita Battery Company, a firm composed of W. S. Willis and BATTERY CO. J. P. Donaldson, be granted permission to remove their gasoline REMOVAL tank from its present location under the sidewalk at No. 707 Scott GASOLINE Avenue to their new location at No, 704 Scott Avenue, such removal TANK. and installation to be done under the supervision of City Engineer, L. C. Hinckley, and upon the condition that the said Wichita ta'; Battery Company agrees to save the City harmless from any and all damages caused from such removal and the installation of such tank under the sidewalk. Motion carried. ' i PERMIT TO Motion was made by J. A. Richolt and seconded by J. L. Lea, Jr. that NAYLOR, HAM- during the erection of the J. J. Perkins-C. W. Snider Building at MACK & NOEY the corner of Eighth Street and Scott Avenue, that the Contractors, TO USE POR` Naylor, Hammack & Noey, be granted the rignt to store material and TION EIGHTH use fifteen feet of Eighth Street immediately in front of said STREET & building, and thirty feet on Scott Avenue immediately to the side SCOTT AVENUE. of said building upon the condition that the said Naylor, Hammack F. Noey shall agree to save the City harmless from any damage or damages caused from the use of the street for sucn purposes. Motion carried. PERMIT TO Motion was made by J. W. Bradley and seconded by J. F. Reed that WICHITA FALLS 'Wichita Falls Lodge No. 655, A.F.&.A.Ir. be granted permission to LODGE #635 use three feet of the alley immediately to the rear of the A.F.&.A.M. Masonic Temple in the construction of anaerial stairway into TO CONSTRUCT the basement of its building, said building being situated on STAIRWAY IN Lot No. 8 in Block No. 185 of the City of Wichita Falls, Texas, ALLEY. according to the original Plat of said City, and the alley running through said block. Said alley not to be used a greater distance than three feet immediately from the property line of said lot, the said Lodge to properly safe guard said stairway with guard rails, gate and cover, and all such construction to be dong under the supervision of City Engineer, L. C. Hinckley, and upon the condition that the said Wichita Falls Lodge Ifo. 635, A.F.&.A.M. agrees and binds itself to save the City harmless from any and all damages daused from the stairway being placed in said alley. Motion carried. PAVINIG BROOK Motion was made by J. A. Richolt and seconded by M. J. Gardner AVENUE OR- that the Petition of property owners on Brook Avenue praying DEPED. that Brook Avenue be paved from the South side of Tenth Street to a point two hundred feet South of the South line of Eleventh Street be granted, and that the Board of Aldermen order the paving of Brook Avenue as aforesaid, the same to be done with concrete paving forty feet in width and upon the usual terms and condi- tions set out in the Resolution heretofore adopted by said Board. Motion carried. PERMIT TO Motion was made by J. F. Reed and seconded by J. A. Richolt that I. H. ROBERTS during the construction of pavement on Ohio and Scott Avenues that TO STORE I. H. Roberts be granted permission to store sand on the West side SAND OM of Lamar Avenue between Thirteenth and Fourteenth Streets, said LA`,MAR STREET, sand to be stored as near the curb as can reasonably be done, and the said Roberts to properly safe guard travel on said street at night by maintaining proper lights on such sand, and upon the further condition that the said I. H. Roberts agrees and binds himself to save the City harmless from any and all damages caused therefrom. Motion parried. ALLOWANCE TO Motion was made by J. Bradley and seconded by M. J. Motion carried. • N0. 14. HOSPITAL Motion was made by J. 11: Bradley and seconded by J. F. Reed that BILLS AL- , the following bills covering the City's one-half of expenses for LO7FDt the Niehita General Hospital be allowed. Mulford Company 22•86 Lewis Manufacturing Company 66.93 Physician's Record Company 2.38 AUDIT PRO- Ifotion was made by J. F. Reed and seconded by J. L. Lea, Jr, that VIDED Mayor A. H. Britain be authorized to have A. E. Myles audit the HOSPITAL accounts and expenditures of the City on account of the 7ichita ACCOUNTS. General Hospital, provided the County would also authorize the said ILyles to audit its like accounts with such Hospital and the County would pay one-half of the expenses of such audit. Motion carried. BILLS ALLOWED. Motion was made by J. F. Reed and seconded by H. J. Gardner that all accounts that were approved by the Finance Committee be al- lowed. Motion carried and total bills allowed by the Board of Aldermen was the sum of Thirteen Hundred Ninety Seven and 84/100 ($1397.84) Dollars. Total allowed during the month of January for salary, labor, interest on bands, etc. Nine Thousand One Hundred Twenty Four and 70/100 ($9,124.70) Dollars. SEWJ BILL :lotion vine made by J. F. Reed and seconded by J. 7. Bradley that ALLO'7ED,ETC. the Atidat of the Texarkana Pipe Company for four cars of sewer pipe be allowed and warrant drawn to pay the same, and the City Clerk be instructed to write said Company for bill of the fifth car of sewer pipe which had been received by the City. Illation carried. SEnR Motion was made by J. W. Bradley and seconded by J. L. Lea, Jr. REFUND. that the following sewer refunds be allowed, to wit: L. and J. L. Zihlman at 904 Austin, 304 Fourth Street, and 151b Fifteenth Street, Two and 25/100 ($2.25) Dollars. Motion carried. PENALTY J. J. Perkins in writing made the following representation and REMITTED. request to the Council: That he owned Lot ito. 15 of Clift' Subdivision of Block No. 1, Bellevue Addition to the City of Nichita Falls, anfi that J. H. Cloud owned Lot No. 19 of the same Subdivision and that the said Cloud had erroneously paid the s` taxes on Lot No. 15 for the years 1914 and 1915, when he had intend- ed to pay on Lot No. 19. The said Perkins proposed to pay the 1914 and 1915 taxes on Lot Ito. 19 of said Subdivision, provided the City was willing to remit the One (. 1.00) Dollar penalty for the year 1914. Motion was made by Ii. J. Gardner and seconded by J. F. r' • Reed that the request of the said J. J. Perkins be granted and that the One (.1.00) Dollar �penalty on said Lot No. 1.3 for the year 1914 be remitted upon his paying said taxes. Motion carried. ACCEPTANCE Motion was made by J. V. Bradley and seconded by J. A. Richolt that HOOD & LADDER:Iayor A. H. Britain and Fire Chief J. L. McClure be authorized to TRUCKPRO- formally accept the new Hook & Ladder Truck from the American VIDED FOR. La France Compeny,when said truck should be fully tosted,and wnen in their opinion said truck was made to fully comply with the con- tract and specifications with reference to such purchase, and that upon such acceptance warrant be issued for the cash payment, and that the Mayor be authorized to execute the notes provided for under said contract.
