Min 02/27/1919 Wichita Falls, Texas,February 27th, 1919 The Board of Aldermen of the city of Wichita Falls, Texas, met in regular session on the above date for the transaction of the business of the city, with Mayor J.B. Marlow, presiding and with the following officers present, Aldermen, J.F. Reed, J.L. Lea Jr., J.M. McFall, C.E. McCutcheon, and LI. Bundy, City Atty Mathis, City Clerk Walkup, City Marshall Smith, and acting City Engineer Donald, in attendance. R.E. Huff, C.B. Felder, and N.G,Blacklock and associates came before the Board of Aldermen and dideussed the plans of opening streets and alleys through Block 26 Jalonic Addition to the city of Wichita Falls, and after considerable discussion, Alderman McFall moved that the Board go on record to assist Blacklock and associates anyway possible to procure said streets and alleys and in case of failure to arrive at any agreeab►e understand- ing, the city would endeavor to under take condemnation proceedings to open said streets and alleys, which motion was seconded by Alderman Lea, and carried. ORDINANCE 257 AN ORDINANCE GIVING AND GTANWING UNTO THE WICHITA FALLS TRACTION COMPANY? ITS SUCCESSORS' ASSIGNS AND LESSEWTHE RIGHT TO OPERATE CONSTRUCT AND MAINTAIN A STRF,ET CAR LINE OVER AND ALONG CERTAIN STREETS OF THE CITY OF WICHITA FALLS ,TEXAS , AND REPEALING SO MUCH OF ORDINANCES NOS. L108 AND 187 OF THE CITY OF WICHITA FALLS, TEXAS, AS REQUIRES THE WICHITA FALLSTRACTION COMPANY, ITS SUCCESSORS ASSIGNS AND LESSEES TO PAVE OR GRADE ANY PART OF THE STREETS OF WICHITA FALLS OCCUPIED BY SAID STREET RAILWAY BELONGING TO THE WICHITA FALLS TRACTION COMPANY AND SO MUCH OF SAID ORDINANCES AS REQUIRES THE 2AYMENT7OP A GROSS RECEIPTS TAX OF TWO PER CENT TO SIAD CITY WHEN ITS POPULATION REACHES TWENTY FIVE T HOUSAND AND PROVIDING THAT A GROSS RECEIPTS TAX OF TWO PER CENT SHALL BE PAID BY SAID WICHITA FALLS TRACTION COMPANY? ITS SUCCESSORS; ASSIGNS, AND LESSEES WHEN ITS NET EARNINGS, EXCBUSIVE OF ALL TAXES PAID, SHALL AMOUNT TO EIGHT PER CENT ON THE AMOUNT OF ITS ACTUAL INVESTMENT, was on motion of Alderman Lea, seconded by Alderman McCutcheon put on its first reading and passed by the following Yea and Nay Votes, Alderman Lea, yea, Alderman McFall Yea, Alderman McCutcheon Yea, Qf9d Alderman Bundy yea. Mayor Marlow then declared ORDINANCE 257 passed on its first reading by the unanimous vote of all the Aldermen of the city present, voting Yea 0 0 o C,W,Ives,Representing Selden Brook Construction Company,and the Westlake . Construction Company,and the Fort Worth and Denver City Railway Company, Came before the Board and asked that the said Railway company be permitted to construct a temporary track or siding on and across Michigan Avenue 8ommincing it 4th street add runs in a north westerly direction across Block 144 and across 3rd street and block 105 across main street and part dfDBlock 90 for the purpose of unloading and storing materials fot the said constructions companies, for the erection of buildings at the corners 8th street and Scott Ave, this permit t,o be in affect until the said buildings atthe corner ok Seett Ave and 8th street are completed. White- upon Alderman McFall moved that said request be granted under the us- ual provisions to wit: That the said Railway Company and the said Cons- truction Companies their legal represenatives, Administrators, s.:cessors, and assigns shall hold the city harmless from any damages that maybe caused by the construnction and maintainance of said track and sliding, and Var t he storage of said material which motion was seconied.bg Alderman Bundy and carried. Alderman McCutcheon moved that Street Supt. Dobson, and sanitary officer Morgan be permitted to raise th e wages of all men working for them, .25c per day, said raise to commence the 1st day of match,which motion was seconded by Alderman Lea and carried. Alderman McCutcheon tended his resignation as Alderman to take effect upon the election and gualificatinn of his sucessor At the next general election, whereupon Alderman Lea moved that the resignation be accepted with regrets, which motion was seconded by Alderman McFall and carried. Alderman Reed moved that the City Clerk be instructed to order ant election to be held in the City of Wichita Falls, Texas, on. the first Tuesday in April 1919, the same being the first day of April, A.D. 1919. for the purpose of electing three Alderman for full terms, as provided in the City Charter, also for the election of one Alderman to fill out the unexpired term of C.E. McCutcheon (resigned) and also for the election of City Engineer, to fill out the unexpired term of: M.M. Cook, (resigned( also for the election of City Tax Assessor and collector, to fill out the unexpired term of H.F. Robertson (resigned), and that the Po11IA*4g Tier ens be appointed election officers to hold said election. At the City Hall Box. J.B. Fitts Presiding Judge, T.W. Allen Jude, J.J. Manley, C.G. Phillips and Albert Fitts Clerks, At the Court House Box: Geo Simmons Presiding Judge, F.H. Denison Judge, W.P; McFall, L.P. Webb, and ' .J. Bullock Clerks. Which mention was seconded by Alderman McCutcneort; and::carried. l i H.L. Hunter came befo_e the boardand presented a petition signed by himself and six others, asking that Denver Ave be paved from 1Uth f street to 11th street. Whereupon Alderman McCutcheon imovedt•,d that the petition be received and filed, which motion was seconded by Alderman McFall and carried• The board of Aldermen then adjourned.
