The Board of Aldermen of the City of Wichita Falls,
Texas met in regular session on the above date to transact the
business of the City with Mayor J. B. Marlow presiding and the
following officers present; Alderman Curlee, McFall and Aeed
and City Clerk Thorburn.
Moved by Alderman Curlee that Kitt Cowan be permitted
to use 16 feet of 4th street for storing materials and build-
ing warehouse necessary for erection of 4th. Baptist Church whirl
motion was seconded by alderman McFall and carried.
The Western Union Telegraph Company, through it's
representatives, asked permission to place their underground
plant along 8th Street from the F. W. & D. C. right of way to
the point 242 feet West of Soott Avenue on line with Alley and
extending North 122 feet, and in the Alley South 122 feet.
Moved by Alderman Curlee, that the Western Union Tele-
graph Company be granted permission as requested, and that let-
ter and print presented, be made a part of the record, which mo-
tion was seconded by Alderman treed and carried.
Moved by Alderman Dr. Reed that A. E. Britain be aut-
horized to sell the City's Interest in lots 2,3, 4, and 5 of
Blook 16 B & J addition at same price he sells his own interest
which motion was seconded by Alderman M'CFall and parried.
The Council then went into executive session to cons-
ider matters authorized by the City Charter to be considered
in Executive Session and then the Council went out of Execut-
ive Session.
Moved by Alderman McFall that t. A. Pitts be awarded
contract to build new fire station in McGregor Park at his price
of (010988.00) provided said J. A. Pitts give necessary Bond,
also that the Texas Electric Company be awarded contract for wit
ing`seme at their price of(0174.00) which motion was seconded by
Alderman Curiae and carried.
Moved by Alderman Curlee that the City pay for the re-
pair of all private water lines when same have been broken and t
torn out by the Street department when grading streets, which
motion was seconded by Alderman McFall and carried.

The Board of Aldermen u--,on motion duly made, seconded
and unanimously carried, proceeded to examine and canvass
the result of the election held, on towit: the 30th.day of
March, A. D. 1920, at the us al polling 'laces in the city
• of Wichita Falls, Texas, for the purpose of determining
whether or not the charter proposed by the charter commission
heretofore elected by the qualified voters of said city, towit:
on January 15, 1920, should be adopted; said returns were
thereupon duly opened, examined and canvassed, and showed
the following results:

Thereupon motion was duly made by Alderman Reed, and
seconded by Alderman Curlee, that the canvass of the result
of said election showed for the adoption of said nronosed
charter 1243 votes, and against the adoption of the nronosed
charter 244 votes, and that more than a majority of the
qualified voters voting at said election, on, towit: March
30th. 1920, having voted in the affirmative that said charter
was and is in all things duly and legally adopted. Said
motion was thereupon submitted to the yea and nay vote of
the Board of Aldermen; and unanimously carried by the follow-
ing votq,towit:

Alderman Curlee Yea.
Alderman McFall Yea.
All of the aldermen voting yea, Mayor Marlow then declared
the said motion adopted andtthatAhe-propoaed charter at said
election had been and was duly and legally adopted by the
vote of more than a majority of the qualified voters voting
at said election, and that said ch,.rter was and is the duly
adopted charter of the City of Wichita Falls, Texas.

RESOLUTION.
Whereas on November 11th, 191°, the beard of Aldermen
of the city of Wichita Falls, Texas, duly enacted and adopted
Ordinance No. 271, providing for the submission to the quali$i-
ed voters of the city of eichita Falls, 'texas, the question:
"Shall a commission bbe chosen to frame a new charter?" for
said city, and calling a special election to be held at the
usual polling places therein set out in said city, on towit:
January 15th, -l92o, by the qualified voters of said city, at
which election said question and proposition, "Shall a com-
mission be chosen to frame a new charter?" for the said city
of Wichita Falls, Texas, should be submitted for tetermination
and at said election furth83• providing for the election of
fifteen members w`:ose duty it was (provided a majority of the
qualified voters voting on such election should vote in the
affirmative) to frame a new charter for said city as provided
• by Chapter iro. 147, page 307 of the General Laws of Texas,
approved April 7th, 1913, all of which will more fully appear
by reference to said Ordinance Col Itr of record in Vol.
page of the Ordinance Records of said city, and
WHEREAS said election was in all things duly and legally
held in said city at the time and polling places provided for in
said ordinance, and at which election said proposition was
submitted to the qualified voters of said city, and at said
election candidates for charter commission were likewise duly
submitted to the qualified voters of said city, and at which
election more than a majority of the qualified voters voting
at said election, voted in the affirmative on said proposition,
"Shall a commission be chosen to frame a new charter for the
city of v.ichita sells, Texas?" , and the following named fifteen
persons were duly elected by a majority of said qualified voters
voting at said election, as a charter commission to so frame

AND WHEREAS thereafter, the Board of Aldermen duly
canvassed the result of said election and declared the
result thereof, towit- that a majority of said rualified voters
had voted in the affirmative on said ,ro osition and th:t the
above named fifteen persons were duly elected as a charter
commission to so frame a new charter for said city, and
WHEREAS thereafter said charter commission, composed of
the above named fifteen persons, duly and legally framed a new
charter for the said city of Wichita Falls, Texas, and duly
reported and submitted said charter to the Board of Aldermen of
the city of Wichita Falls, Texas, and fixed the time of said
election to be held in said city, on, towit l the 30th. day of
March , A. D. 1920, and which said charter was duly received
and by said Board of Aldermen, and said board of aldermen
thereupon duly and legally called an election to determine
whether or not said proposed charter should be adopted upon
the date fixed by said charter commission, towit: March 30th,
1920, and
WHEREAS said date so fixed by said charter commission
for said election, and upon which said election was called by
said board of aldermen was not less than forty da: s nor more
than ninety days after the completion of the workof said
charter commission, and
WHEREAS not less than thirty days prior to such election
the board of aldermen of said city caused the city clerk of
said city to mail a copy of the proposed charter to each
qualified voter in said city, as appears fromtthe tax col-
lectors rolls of Wichita County, Texas, for the year ending
January 31st, 1920, preceding said election, and
WHEREAS thereafter, on, towit: March 30th, 1920 an
election was duly and legally held in said city of Wichi a Falls,
Texas, at the usual polling places therein, and at the polling
places provided for in the call for said election by said
board, and at which election more than a majority o{f the quali-
fied voters voting at said election voted for the Adovtion
of said proposed charter as the charter of said city, and
:HEREAS thereafter, or Anril 2nd.1920, the board of
aldermen of the city of Wichita Falls, Texas, at a regular
meeting of said board, duly and legally canvassed the
result of said election and declared the result thereof,
towit: that 1243 votes had been cast for the adoption of said
charter, and that more than a majority of the qualified
sg' voters voting at said election, having voted for the adoption
of said charter, that said charter was and is duly

adopted as the,charter of said city, and
WHEREAS all things prerequisite to and in adoption of
said charter have been duly and legally enacted, passed and
adopted, and
WHEREAS said proposed charter of said city has been
duly and legally adopted as the city chart r of the city of
Wichita Fall&, Texas:
NOW, THEREFORE, BE IT RESOLVED by the Board of
Aldermen of the city of Wichita Falls, Texas, that said
charter hereinabove referred to, be, and the sa me is here
now declared duly and legally enacted and adopted as the
city charter of the City of Wichita Falls, Texas.
Be it further resolved that this resol tion be forth-
with spread upon the minutes of the Board of Aldermen as
required by law.
WHEREAS at a regular meeting of the Board of Aldermen
of the city of Wichita Falls, Texas, held on the 18th. day
of March, 1920, it was ordered by said Board that a general
election be held in said city on the 6th day of April, 1920,
for the purpose of electing a mayor, city clerk, city attorney
city tax assessor and collector, city health officer, city
marshal, city engineer, city recorder, and three alermen, and
WHEREAS at an election held in the cityof Wichita Falls,
Texas, on, towit: March 30th. 1920, a new city charter was
adopted for said city, wherein all elective office were abolish-
ed save and except for mayor and members of the Board of
Aldermen, the result of said election h,ving been duly can-
vassed and declared at a regular meeting of the Board of
Aldermen held on the 2nd. of April 1920, and
WHEREAS at said election to be held on April 6th, 1920,
the only officers who can be duly and legally elected thereunder
are the following: Mayor, and three members of the Board of
Aldermen:
SOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen
of the city of Wichita Falls, Texas, that the action of said
Board of Aldermen on, towit: 18th day of Larch, 1920, as
aforesaid, in so far as it called for an election to be held
for the following named offices so abolished by the new city
charter, be and the same is here now abrogated, rescinded and
annulled, towit: City clerk, city attorney, city tax assesor,
and collector; city healthofficer, city marshal, city
„ engineer, city recorder.
