Min 06/10/1920 JUNE 10th, 1 9 2 0. The Board of aldermen of the City of Wichita Falls, Texas, met in tegulat session for the transaction of the business of the City, with Mayor W.D. Cline presiding, and Aldermen Bonner, McDowell, Bralley, Curlee, and City Clerk Thorburn in attendanoe. Mr Huey, and a Committee representing the residents of Scotland Addition appeared before the Council with a petition for Street grading and drainage, and Public Utilities, and Alderman McDowell moved that the City Secretary be instructed to request the Wichita Falls Water Company, by letter, to install two Fire Plugs in Scotland Addition and the installation of same be given preference over any other instal- lations in prospect, which motion was seconded by Alderman Bralley and carried. Moved by Alderman Bonner that the Wilhelm Moulder Auto Company be permitted to install a Gasoline Filling Station at 601 Indiana under the usual provisions,to-wit: That the said Wilhelm Moulder Auto Company, their successors and assigns, legal representatives, and administrators, hold the City harmless from any damages that may arise from the said Gasoline Filling Station, and that the Installation be made under the supervision of the City Engineer and that same be removed at any time oh request of ahe City Council, which motion was seconded by Alderman Curlee and carried. Moved by Alderman Curlee that the Magnolia Refining Company be permitted to install a Gasoline Filling Station at 1000 Scott under the usual provisions, tit-wit: That the Magnolia Refining Company, their successors, assigns, legal representatives, and administrators,hold the City harmless from any damages that may arise from the said Gasoline Filling Station and that the installation be made under the supervision of the City Eng.a ineer and that the same be removed at any time on request by the City Council, which motion was seconded by Alderman McDowell and carried. Moved by Alderman Curlee that the Bills for two pieoes, Stutz Fire Apparatus amounting to Sixteen Thousand ($16,000.00) Dollars be paid by City Secretary, which motion was seconded by Alderman McDowell and carried. Moved by Alderman Curlee that the City Secretary be allowed to employ an extra clerk for next few months at a salary of Eighty ($80.00) Dollars per month, which motion was seconded by Alderman McDowell and carried. Moved by Alderman McDowell that 0. Spencer be permitted to open a Grocer$ Store at Fifteenth Street, when and after he has secured the necessary seventy-five per cent signatures to petition required by Ordinance and complied with the law in all respects, which motion was secon- ded by Alderman Bonner and carried. Moved by Alderman McDowell that one Ford Car be bought for the police Department and two Ford Cars be bought for the Engineering Department, which motion was seconded by Alderman Curlee and carried. RESOLUTION -WHEREAS. the Board of Aldermen of the City of Wichita Falls, Texas have concluded and agreed between the said City and the North Texas Gas Company, with respeot to the matters hereinafter referred to, and are desirous that said' agreement shall be put in due and legal form and become the Act of the Board. of Aldermen and binding as well, on the North Texas Gas Company, Therefore BE IT ORDAINED by the Board. of Aldermen of the City of Wichita Falls, Texas, that the Mayor and City Secretary of the City of Wichita Falls, Texas, are hereby empowered and directed tb execute in due and legal form and manner, the following contrast, which has been agreed upon between the parties, to-wit: STATE OF TEXAS ) WICHITA COUNTY This memorandum of agreement made and entered into on this the 10th day of June, A.D. 1920, by and between the City of Wichita Falls, Texas, a municipal corporation, party of the first part, and the North Texas Gas Company, a corporation, party of the second part,WITNESSETH: 1. It is agreed that the North Tomas Gas Company, party of the second part, subject to the terms and conditions hereinafter set forth, shall be authorized to charge the sum of seventy-five (75) cents gross per 1000 cubic) feet for natural gas for domestic purposes, less the discount of ten per cent for prompt payment of monthly bills now prevailing under the rules of said North Texas Gas Cpmpany, making the net rate of sixty-seven and one-half (674) cents per thousand cubic feet for domestic use, which rate shall apply for a period of twelve months from and after the date when either of the following contingencies shall have occurred: When the North Texas Gas Company has secured by lease or purchase the pipe line for gas from the City of Wichita Falls to the Walters field in the State of Oklahoma; or when said North Texas Gas Company has built, or caused to be built from Keys filed in Oklahoma a pipe line from the Magnolia Gas wells situated about nine miles East of said Keys' field, it being, however, expressly provided that the increased rates herein authorized shall not be effective at any time prior to September 1st, 1920. From and after the expiration of the twelve months period above named, the rates shall become effective, the basis of charges shall be the said gross sum of seventy.,five cents per thousand cubio feet plus three cents for every additional" cent over the, average sum of five cents per thousand cubic feet paid for gas by the Lone Star Gas Company in the field, less discount of ten per cent; it being, however, expressly provided that in no event shall the net cost to the consumer making prompt payment under the existinggrules of the North Texas Gas Company be more than seventy-five cents per thousand cubic, feet for domestic use for the • period of two years after the expiration of the above period of one year, and provided further that in no event shall the prioe of gas for domestic purposes exceed One Dollar (4.00) net, per thousand cubic feet during the life of the present french**e granted by the City of 'Wichita Falls to the North Texas Gas Company. 2. It is further agreed that in order to determine the cost of gas to the Lone Star Gas Company in the field under the above pro- vision, that the coat shall be determined at fixed periods of six months each and shall be based upon the actual average cost of the gas purchased by the Lone Star Gas Company during the proceeding six months, and that the price for the nest six months shall be based upon such actual average price for the preceding six months. 93 3. The North Texas Gas Compere y as a condition upon which the rates above stated shall become effective, agrees to make an extension of its mains in the City of wichita Falls, and to construct additional mains as follows: At least seven thousand feet of additional ten inch line and twelve thousand two hundred feet of additional eight inch line. 5xoept as herein specifically provided, existing contracts between the City of Wichita Falls and the North Texas Gas Company and all ordinances regulating the supply and distribution of gas to the citizens of Wichita Falls shall remain in full force and effect. The City of Wichita Falls here non agrees in con- sideration of the premises, that it will in due season pass, enact and decree any and all ordinances or regulations in legal form which may be necessary or expedient to carry out the terms of this contract or to grant and guarantee to the North Texas Gas Company the rights hereby agreed to be conferred, and such other ordinances or regulations as may be ne- cessary for the mutual protection of the rights of the parties as fixed by this contract. 4. This contract shall exist and remain in force until the expiration of the franchise of the North Texas Gas Company. "AN ORDINANCE TO REPEAL ORDINANCE NO. 123 PASSED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ON JANUARY 14th, 1910, AND APPROVED JANUARY 17th, 14.0, REVOKING ALL LICENSES GRANTED UNDER SAID ORDINANCE AND PROVIDING FOR REFUNDING ANY UNEARNED PDRTION. OF SAME; was on motion of Alderman Curlee, seconded by Alderman Bonner, placed on its third reading by the following yea and say vote. ORDINANCE # 288. "AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO " TAMPER WITH, USE, DISTURB, OR DRAW, OR TAKE WATER FROM ANY PUBLIC FIRE HYDRANT IN'THE CITY OF WICHITA FALLS, TEXAS. THE FIRE DEPARTMENT` IS EXCEPTED. RESOLUTION Be it resolved by the Board of Aldermen of the City // y'of Wichita Falls, Texas, that the following named freeholders, N.O. Monroe (W flJuJ.W. Thomas, and J.M. Saber, all of whom are resident,citizens of the 'City of Wichita Falls, Texas, be and are hereby appbented members of the Board of Equilization and shall constitute said Board of Equilization of the City of Wichita Falls, Texas for the year 1920 to equalize the property values of all the property assessed for taxes for the City purposes by the City of •ichita Fails, Texas, and to perform such other duties as may be required of them by the laws of the State of Texas and the Constitution and the Charter and Ordinances of the City of WichitarFalls, Texas. Said members of the Board of Equalization shall take the oath that is required under article #7573 of the R.S. of Texas. The Board of Aldermen then adjourned.
