in regular session on the above date with the following present:-

No protests being heard on an application filed under prov-
isions of Ordinance f by Mrs Florence Calvert and Mrs. Louise Raymond the
following motion•was pit in order:
Moved by Alderman Shepherd that Mrs Florence Calvert and
Mrs Louise Raymond be granted permission to conduct a cafeteria in the Cunn-
ingham building located on Block 12, Lot 5, Bellevue Addition under the usual
provisions to-wit:-
That the said Mrs Florence Calvert and Louise Raymond,their
successors and assigns, legal representatives and administrators shall hold the
City of Wichita Falls, Texas, harmless from any damages that may arise from the
operation of said cafeteria, and they shall cease to operate said business when
so ordered by the Board of Aldermen of the City of Wichita Falls, Texas.
Motion seconded by Alderman Clifford and carried.
No protests being heard on an application filed under pro-
visions of Ordinance #4tq, by J. D. Marcum, the following motion was put in
order:-
Moved by Alderman Clifford that J. D. Marcum be granted a
permit to erect a business building and operate a grocery store on Lot 8,Block 1
McBride Addition under the usual provisions to-wit:-
That the said J. D. Marcum their successors and assigns,
legal representatives and administrators shall hold the City of Wichita Falls,
Texas, harmless from any damages that may arise from the operation of said
grocery store, and they shall cease to opeate said business when so ordered by
the Board of Aldermen ekf the City of Wichita Falls, Texas.

Traction Company for a continuation of the Six (64) cent street car fare for
a period of two years ffom expiration date outlined in Ordinance #295 the foll-

Moved by alderman Fitts, that the,✓year 1920 taxes assessed
against Lot 2, Block 83 be reduced by the amount of ;33.25 due to error in
rendition and that 0. G. Stephens be issued a warrant to refund over payment
of this amount.

1922 presented by Tax Collector Anderson carrying real estate values to the
amount of : 24,851,870.00, personal property values, $9,754,810.00, the tax
rate at $1.55 making the revenue accruing 536,403.54, be accepted and approved.

City Clerk at a salary of : 250.00 per month, to replace Geo. W. Thorburn,eff-

mission to reinstall an underground filling station tank at the corner of 10th
,. and Scott Streets under the usual provisions to-wit:-
That the said W. M. Priddy, his successors and assigns, legal
representatives and administrators shall hold the City of Wichita Falls, Texas
harmless from any damages that may arise from the operation of said filling sta-
tion tank, installation be done under the supervision of the City 3ngineer,and
they shall cease to operate said business when so ordered by the Board of Alder-
men of the City of Wichita Falls, Texas.

RESOLUTION
RESOLUTION ACCEPTING THE IMPROVEMENTS ON INDIANA STREET,
FROM ITS INTERSECTION WITH THE SOuTH PROPERTY LINE OF TENTH,$TREET, TO ITS
INTERSECTION WITH THE SOUTH PROPERTY LINE OF THIRTEENTH STREET AND DIRECTING
TEE MAYOR AND CITY CLERK TO ISSUE CERTIFICATES OF SPECIAL ASSESSMENT LEVIED
AGAINST TEE VARIOUS eo'fS OR TRACTS OF LAND AND THE OAERS THEREOF ABUTTING
UPON SAID PORTION OF SAID STREET.
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS:
WHEREAS, the Board of Aldermen of the City of Wichita Falls
has heretofore ordered that Indiana Street, from its intersection with the South
Property Line of Tenth, to its intersection with the south property line of
Thirteenth Street, be improved by raising, grading and filling the same and in-
stalling concrete curbs and gutters and paving same, and after due notice and
hearing special assessments were levied against the various lots and tracts of
land and the owners thereof abutting upon the said portion of said street,and
contract for the making and construction of the said improvements was entered
into with the West Texas Construction Company; and,
WHEREAS, the said West Texas Construction Company has fully
performed its said contract and the said improvements have been made and con-
structed in accordance with the said contract and the specifications therefor,
and to the entire satisfaction of this Board:
1.
That the said improvements on said portion of said street
be and the same are hereby accepted and the said Test Texas Construction Company
and the sureties on its construction bond, are hereby released of any further
obligation for or on account of the contract or bond for the making and constr-
ucting of the said improvements.
11.
That this resolution does not and shall not in any wise affect
the bond of the said company for the maintenance of the said improvements, but
such maintenance bond shall and does remain in full force and effect.
111.
That the Mayor and City Clerk be and they are hereby auth-
orized, instructed, and directed to issue to the West Texas Construction Com-
pany certificates of special assessment in evidence of the various assessments
levied against the respective lots and parcels of land abutting upon the said
portion of said street, and the owners thereof, and against which special ass-
essments have been levied, reciting the description of such property, the amount
of the assessments against same, the owner thereof, the terms of payment there-
of, the rate of interest, the date of completion and acceptance of the said
improvements, the lien of the said assessment and the personal obligation and
liability of the owner of the property and reciting that all proceedings with
reference to making such improvements have been regularly had in compliance
with the law, the Charter of Said City, and the terms of the certificate, and
that all prequisities to the fixing of a lien and claim of personal liability
evidenced by the certificates have been performed,and containing other appro-
priate and pertinent recitals, and in accordance with the contract with the said
company and the law in forde in this city, and the proceedings of this Board.
IV.

This resolution shall take effect from and after its passage.
