Basement Morgan Bldg., The Board of Aldermen of the City of Wichita Falls, met in regular session on the above date with the following present:- Frank Collier, Mayor R. E. Shepherd 0 B. M. Clifford J. F. deed 0 Aldermen J. B. Fitts Burton Stayton 0 W. E. MoBroom, City Clerk E. M. Mann, City Attorney. The minutes of the previous meetings were read and approved. #######0 ############# Representatives of the Wichita Falls Traction Company presented a petition for a temporary franchise to construct a street oar line from the Kemp Blvd line at the junction of avenue G, east from that point to the in- tersection of Jones Street, thence south on Jones Street to the Junior College site, A protest was filed by property owners affected by the proposed route of the line and after hearing the ar#uments of sides a further hearing was set for 10 o'clock A. M. January 10, 1923. ###############74#### Moved by Alderman Shepherd that a warrant payable to a. F. Kerr Clerk 78th District Court be drawn covering the court costs in the injunction suit of 0. L. Olds vs City of Wichita Falls, Texas, amounting to $19.80. Motion seconded by Alderman Clifford and carried. #####r ############# The following recommendation was read:- 1/8/23 To The honorable Mayor and Board of Aldermen, City. Gentlemen:- This is to certify that the pavement on Eleventh Street from the West property line of Austin Street to the east property line of Grace street has been constructed and completed by the West 'Texas Construction Company in accordance with the plans and specifications. . I, therefore, recommend that the above mentioned pavement be accepted by your honorable Board of Aldermen. Yours truly, (Signed) F. M. RESOLUTION RESOLUTION ACCEPTING THE IMPROVEMENTS ON ELEVENTH STREET, .FROM ITS INTERSECTION WITH THE WEST PROPERTY LINE OF AUSTIN STREET, TO ITS INTERSECTION WITH THE EAST PROPERTY LINE OF GRACE STREET AND DIRECTING THE MAYOR AND CITY CLERK TO ISSUE CERTIFICATES OF SPECIAL ASSESSMENT LEVIED AGAINST THE VARIOUS LOTS OR TRACTS OF LAN➢ AND THE OWNERS THEREOF ABUTTING UPON SAID :"ORT10N OF SAID STREET BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS: WHEREAS, the Board of Aldermen of the City of Wichita Falls has heretofore ordered that Eleventh Street, from its intersection with the West Property Line of Austin Street, to its intersection with the East Property Line of Grace Street, be improved by raising, grading and filling the same and in- stalling concrete curbs and gutters and paving same, and after due notice and hearing special assessments were levied against the various lots and tracts of land and the owners thereof abutting upon the said portion of said street, and contract for the making and construction.of the said improvements was entered / into with the West Texas Construction Company; and, O WHEREAS, the said West Texas Construction Company has fully per- formed its said contract and the said improvements have been made and constru- cted in accordance with the said contract and the specifications therefor,and to the entire satisfaction of this Board: 1. That the said improvements on said portion of said street be and the same are hereby accepted and the said West Texas Construction Company, and the sureties on its construction bond, are hereby released of any further ob- ligation for or on account of the contract or bond for the making and constr- acting of the said improvements. 1I. That this resolution does not and shall not in any wise effect the bond of the said company for the maintenance of the said improvements, but such maintenance bond shall and does remain full force and effect. III. That the mayor and City Clerk be and they are hereby authorized, instructed, and directed to issue to the West Texas Construction Company cer- tificates of speciale;assessment in evidence of the various assessments levied against the respective lots and parcels of land abutting upon the said portion of said street, and the owners thereof, and against which special assessments have been levied, recitint the description of such property, the amount of the assessments against same, the owner thereof, the terms of payment thereof, the rate of interest, the date of completion and acceptance of the said improvements, the lien of the said assessment and the personal obligation and liability of the owner of the property, and reciting that all proceedings with the owner of the property, and reciting that all proceedings with reference to making such imp- rovements have been regularly had in compliance with the law, the Charter of said City, and the terms of the certificate, and that all prequisities to the fixing of a lien and claim of personal liability evidenced by the certificates have been performed and containing other appropriate and pertinent recitals, and in acc- ordance with the contract with the said company and the law in force in this city and the proceedings of this hoard. Iv. This resolution shall take effect from and aftek its passage. Passed and approved, this day of 1923. a. D. Moved by ALDERMAN Fitts that Ordinance No.427 be placed on its second reading. Motion seconded by Alderman Clifford and carried by the following vote:- Yeas: Shepherd, Stayton, Fitts, Clifford, heed. Nayes: None. oU� Moved by Alderman Mitts that the year 1922 valuation on Lot 2, Block 26, Jalonick be reduced from 01,000.00 to 4400.00 and the taxes amount to 49.30 be remitted due to error of tax assessor in placing value on unrendered tax roll. Motion seconded by Alderman Clifford and carried. ######################## Moved by Alderman ±teed that the request of Sadler & Haworth to erect an electric sign at 616 Ohio be not granted. Motion seconded by alderman Fitts and carried. ###################### Moved by Alderman Shepherd that the City Attorney, City Engineer, and City Electrical Inspector be instructed to draft an amendment to Ordinance 348, covering the erection of flat electrical signs.
