ORDINANCE NO.429
AN ORDINANCE GIVING AND GRANTING TO THE WICHITA FALLS TRACTION
COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT TO EXTEND, CONSTRUCT
AND OPERATE A STANDARD-GUAGE CAR LINE OR LINES ON, OVER, ACROSS AND UPON THE
FOLLOaING DESCRIBED AND NAMED STREETS IN THE CITY OF WICHITA FALLS, TEXAS,TOWIT:-
BEGINNING AT A POINT WHERE KEMP BOULEVARD INTIRSECTS WITH "G"
STREET, THENCE IN AN EASTERLY DIRECTION ALONG "G" STREET TO BELL STREET, THENCE
IN A NORTHERLY DIRECTION ALONG BELL STREET TO "E" STREET, THENCE IN AN EASTERLY
DIRECTION ON "F" STREET TO THE INTERSECTION OF HARRISON, THENCE NORTH UN HARRISON
TO THE INTERSECTION OF COLLINS, RAKING CONNECTION -ITH THE PRESENT LINE AT COLL-
INS AND HARRISON.
PROVIDING THAT SAID TRACKS SHALL BE LAID IN CONFORMITY WITH THE
FRANCHISE HERETOFORE GRANTED TO J. A. KEMP AND FRANK XELL ON THE 27TH DAY OF
JANUARY, 1909, AND ALL OF THE AMENDMENTS THERETO AND THE PROVISIONS AND CONDIT-
IONS OF SAID FRANCHISE AND AMENDLIENTS THERETO ARE EXPRESSLY TIDE APPLICABLE TO
THIS ORDINANCE, EXCEPT, HOWEVER, AS OTHERWISE PROVIDED IN TEES ORDINANCE.
Moved by Alderman Clifford that Ordinance No.429 be passed on
its third and final reading and be adopted as read.
mOion seconded by Alderman Stayton and carried.
The public hearing granted property owners on Travis Street bet-
ween 11th and 12th Streets was called and after protests were fully heard the
following motion was put in order.
Moved by alderman Shepherd that the hearing be continued until
4 P. M. February 26, 1923. Said hearing to be held in the Basement of the Morgan
Building in the City of Wichita Falls, Texas.

Moved by Alderman Stayton that the hearing of protests relative
to the placing of electric light poles in the streets in the Southland Addition
be continued until 4 P. Y. Monday February 26th 1923.

Moved by Alderman Clifford that Woody Hines Oil Company be rer-
mitted to break the curb and pave the triangle adjoining their filling station at
the corner of 16th & Lamar, provided said paving is done under the supervision
of the City Engineer.

Moved by Alderman ntayton that Mrs. Emma Idou be granted permission
to construct a store building and operate a grocery and drug store on the reat
of lot 1, Block 18, Jalonick Addition.

We, the undersigned owners of property abutting upon Burnett
Street, desire that the improvement of that portion of said Street between the
South line of Eleventh Street and the South line of Thirteenth street, be proc-
eeded with by West Texas construction company under its contract with the City
of wichita Falls, notwithstanding such improvements cannot at this time be pro-
ceeded with on that portion of said street between the South line of Thirteenth
Street and 236 feet S. of S. P. Line of Eighteenth Street, and we, and each of
us, do agree that upon the completion of the said improvements between the said
South line of Eleventh Street and the South line of Thirteenth Street the pro
rata part of the cost assessed against our respective properties and against our-
selves and covered by contracts executed therefor shall be and become due and
payable upon the same terms and conditions as if the improvements upon the entire
street had been completed at that time. and we do further agree that the uity
may thereupon issue to West Texas uonstruction Company certificates in evidence
of the assessments levied against the property abutting upon such completed por-
tion and the owners thereof; and we do further agree that such assessments and
such certificat s and any and all contracts heretofore executed by us shall be
as fully and as absolutely binding and enforceable as if the contract for the
improvement of said street had on inally provided for and required such improve-
ments to be made only unon that portion between the South Line of Eleventh Street
and the South line f Thirteenth Street, ,,rovided such - ork is started in faith
on or before February 19,1923.
In witness whereof we have hereunto set our hands this the 3rd day
of February 1923.

Moved by alderman Shepherd that the Lace Gash Grocery be permitted
to install a curb filling station in front of their grocery store located on the
west corner of Sixteenth and noliday Streets, under the usual provisions to-wit:
That the said uase uash Grocery, their assigns, administrators,
agents and attorneys will hold the uity of 7ichita Falls, hartless from any dam-
age that may arise from the operation of said filling station and will remove
said filling station when so ordered by the Board of aldermen.
