July 11, 1955 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 8:00 otciock P.M. with the following members present: Lloyd C. Moved by Alderman Banner that the Minutes of the regular meeting held June 27th be and the same are hereby approved. Motion seconded by Alderman Cox and carried. M. Rugeley, Dir. Public Works, and award the bid to the lowest bidder, Morgan Motor Co., at the net bid price, less trade-in allowance, of $4148.60. Ar Y` The request of Mr. Phillips for permission to leave 2 airconditioners at 101 Lake St.. which were installed contrary to the regulations governing such installations, was discussed the Council, whereupon the following motion was made: Moved by Aldermai Banner that Mr. Phillips be given two weeks to install the air- nditioners in accordance with regulations acceptable to Mr. Davis, Bldg. Inspector, other- . se to remove the airconditioners altogether. Motion seconded by Alderman Cox and carried. The request for extension of grazing land leases at Lake Kickapoo with Roy Brown and J. R. Parkey &Son from Aug. 1, 1955, to July 31, 1956, came on for consideration, there- upon the following motion was made: Moved by Alderman Hyatt that the Mayor appoint a committee to investigate and determine if the present price per acre is acceptable to the City, and if not, what price should be charged, and report back to the Council. Motion seconded by Alderman Banner and carried. 556 Mayor Lloyd C. Thomas appointed Aldermen Banner, Hyatt and Cox, as a committee of -- three, to derve in the above stated capacity. Attorney Elmer Parish sought passage of a proposed ordinance amending the present Alcoholic Beverage Ordinance so as to permit grocery stores to sell beer for off—premise consumption. The matter was discussed by the Council, whereupon the following motion was made: , Moved by Alderman Hyatt that the Mayor appoint a committee to confer with the local Liquor Control Board as to the advisability of passing the proposed change in the i Alcoholic Beverage Zoning ordinance. Motion seconded by Alderman Cox and carried. Mayor Thomas appointed AldermatReichmuffi, Cox &Banner as a committee to serve in the above stated capacity. RESOLUTION NO. 277 BE TT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: THAT Mr. F. M. Rugeley, Director of Public Works, prepare plans and specifications, . together with an estimated cost, both to the City and to adjacent property owners, of paving that portion of Thirteenth (13th) and Fourteenth (14th) Streets, lying between the East Property Line of Scott Avg and the West Property Line cf Indiana Avenue,, and that the same be presented to the Board of Aldermen at its next regular meeting for further consideration. Moved by Alderman Reith moth that Resolution No. 277 be and the same is hereby fJ adopted and passed as read. ORDINANCE NO. 1730 AN ORDINANCE CHANGING THE NAME OF A PORTION OF AUGUSTA LANE AND ALAMO DRIVE IN EDGEMERE ADDITION TO THE CITY CF WICHIT A FALLS, TO "NORRIS ROAD," THE AREA BEING MORE XPARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE. Evens for the City to terminate the lease agreement "with Acme Junk Co. at the earliest possible moment and determine ownership and boundary lines of certain properties lying between the banks of Wichita River. The subject was discussed whereupon the following motion was made: Moved by Aldermen Reidhmuth that the City Attorney be and he is hereby directed to determine the necessary procedure to comply with the above request. Motion seconded by Alderman Banner and carried. III 558 The matter of the curfew recently pit into effect at SAFB was discussed, there- upon the following motion was made: Moved by Alderman Banner that the Council go on record as asking for an executive session with the Commanding General and Provost Marshal at SAFB this week, for the purpose of working out a favorable solution to te curfew situation. Motion seconded by Alderman Hyatt and carried. The following written report on delinapit tax suite was submitted by the City Attorney. 559 After considerable discussion, the following motion was made: Moved by Alderman Hyatt that the Mayor appoint a committee to confer with the County Sheriff with reference to serving delinquent tax citations for the City. Motion seconded by Alderman Reichmuth and carried. Mayor Lloyd C. Thomas appointed all of the members of the Council to serve in the above stated capacity. v�= Moved by Alderman Cox that the Board of Aldermen authorize personal tax adjustments As set forth in the following schedule, attached hereto and made a part of the records hereof. Motion seconded by Alderman Banner and carried. r Moved by Alderman Hyatt that the Board of Aldermen does hereby agree to enter into a contract with E. E. Cloer to reimburse him for water and sewer mains in Dittoe Heights Addition upon the same basis and terms that similar additions and Housine Developers are reimbursed, when and at such time as contracts acceptable to the City are nrenared, and to authorize and empower the City Manager, or the Mayor, to execute the same for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Banner and carried. The Committee consisting of Aldermen W. E. (Bill) Reichmuth and Rov C. Thomason,City ManagebATE: July 8, 1955 FROM: J.Walter Friberg,City Attorney suBJECT: DELINQUENT TAX SUITS COMMENT: As you know, we have filed some 1212 delinquent tax suits for personal property taxes, the vast majority of these suits being for ad valorem taxes on automobiles. Out of the above number, the Clerk of the Court has issued process on 981 cases. 149 cases have been dismissed because the taxes have been paid and in three cases default judgments for the tax have been taken and no further action is due until execution is issued. The Sheriff's Office has served only 63 citations and there were returned "not served" 167 citations. From the above, the conclusion is inescapable that our"bottle neck" on tax suits is in the lack of service of process. Mr. Clyde Elder, the Constable, has declined to serve any citations in this matter and has likewise instructed his deputy not to serve any tax citations. We have two alternatives: 1. Join the Sheriff in a request to the Commissioners Court to permit him to have additional help to take care of this volume of business, or 2. For us to employ, on a fee basis, one or two persons to act as process server in these cases only. To do the latter ww would probably have to obtain the appointment by one of the Constables outside of Wichita Falls, of two deputies who, of course, would be paid on a fee basis making no additional cost to the City; (it might be hard to obtain this kind of help) Under all the circumstances, it is absolutely essential that this process be served or our tax collection program will completely "bog down", as the public is now waiting until service is had before they make any effort to voluntarily pay their taxes. I will thank you to advise me whether or not we should carry on with the program of tax collections as they now exist, or whether we should follow one of the two methods above suggested in attempting to get service of process in these cases, and if so, which one.
