May 9, 1955 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 8:00 o'clock P.M., with the following members present: Lloyd C. Thomas Mayor Roy W. ..(B Hyatt Reichmuth Jack G. Banner 1 Aldermen Dr. E. Aubrey Cox Elie E. Lam Gene Liepold Geo. T. Henderson City Clerk J. Walter Friberg City Attorney The Invocation was given by Rev. Phinis A. Lewis, Pastor Assembly of God Church. Moved by Alderman'Cox that the Minutes of the regular meeting held Anril 25, 1955, be and the same are hereby approved. Motion seconded by Alderman Banner and carried. Moved by Alderman Lam that the Minutes of the meeting of the City Traffic 3' Commission held April 27, 1955, be and the same are hereby anproved and ratified, cony of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Liepold and carried. Moved by Alderman Banner that the Minutes of the meeting of the City Planning K Board held April 29, 1955, be and the same are hereby approved and ratified, copy of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Cox and carried. Attorney Graham Purcell requested a re-hearing of J. H. York's Taxicab Annlica- tion, thereupon the following motion was made: Moved by Alderman Liepold that a re-hearing of J. H. Yorks annlication to operate 20 taxicabs upon the streets of the City be held at the next regular Connell meeting on May 23rd. Motion seconded by Alderman Banner and carried by the following vote: Yeas: Aldermen Hyatt, Reichmuth, Banner and Liepold. Nays: Alderman Cox. Alderman Lam not voting. Moved by Alderman Banner that the Board of Aldermen authorize the execution of a cr'...Quit Claim Deed to Ray R. As advertised, bids for purchase of 13,000-ft, '81,4890'ft:-6", 104 ft. 8"Machined overall in half lengths, arjd 15 ft. 8" machined overall in quar. lengths, all Class 150 Asbestos or Transits pipe, were opened by the City Clerk and read aloud by John P. Ruhmann, ' Dir. Utilities. The bids were as follows: 4X Morrison Supply Co. (fob Wichita Falls) $36,196.68 Net 30 days Bailey Meissner " " " 36,196.68 e " Moved by Alderman Liepold that the Board of Aldermen accept the recommendation of John P. Ruhmann and award 50% of the above bid to Bailey Meissner Co. and 50% to Morrison Supply Co., since both bids were identical. Motion seconded by Alderman Banner and carried. Alderman Banner reported that open privies were being used in certain sections of the City, which constituted a health hazard to the entire City, whereupon the following motion was made: Moved by Alderman Banner that a Committee be appointed to confer with Dr. Terry of the Health Unit and the Health Department of the State of Texas, for the purpose of remedina the unsanitary conditions. After it was explained to Alderman Banner that ordinances governing such conditions had already been passed, Alderman Banner withdrew the motion. In accordance with the request of Kenneth Johnson, at a previous meeting, the Public Hearing relative to the assessment of automobiles for city taxes was held, at which time Attorney Kenneth Mohnson dwelt at length upon the advisability of seeking other methods and additional ways of taxing personal property other than the present method of heavy taxation on automobiles. Attorney Johnson presented a petition bearing approximately 3200 signatures requesting discontinuance of assessing automobiles for taxation. Moved by Alderman Banner that the Mayor appoint a committee from the Council to confer with Kenneth Johnson and his Citizens Tax Committee gvou)b, the City Tax Assessor and Collector, together with other interested taxing agencies, in an effort to devise some method of taxing automobiles satisfactory to all parties concerned, and report back to the Council. Motion seconded by Alderman Lam and carried. Mayor Lloyd C. Thomas appointed the entire City Council to serve in the above stated capacity. Moved by Alderman Banner, in accordance with bids opened April 25th, for purchase a of 20,000 lbs. Ingot Iron that the Board of Aldermen accept the recommendation of John P. 2. Ruhmann, Dir. Utilities, and award the bid to the lowest bidder, Gachman Metals Co. at the bid price of $3176.00, fob Wichita Falls. Motion seconded by Alderman Liepold and carried. 40, Moved by Alderman Banner, in accordance with bids opened April 25th for purchase of 3290 lbs. of brass and copper goods, the Board of Aldermen accept the recommendation of John P. Ruhmann, Dir. Utilities, and award the bid to the lowest bidder, Bailey Meissner Co.," at the bid price of $6199.0$, fob Wichita Falls. Motion seconded by Alderman Lam and carried. 532 Moved by Alderman Lam that the Board of Aldermen authorize Chance Order No. 2 y for Sherman Machine& Iron Works, changing the specifications for 8 railroad crossings from Cement Asbestos pipe to Heavy Cast Iron Pipe, thus increasing the cost in the amount of approximately $266.40. yMotion seconded by Alderman Reichmuth and carried. 4 Moved by Alderman Reichmuth that the Board of Aldermen authorize the issuance of a 'permit to Continental Oil Co. to install one-1000 pal. underground gasoline storage tank, between the curb and sidewalk, at their service station at llth & Brook, provided the same fis installed in accordance with regulations and requirements of the Director of Public works, F. M. Rugeley, It is distinctly understood and agreed that this Permit shall expire 18 months from date hereof and the City may cause removal of the same at expiration date, or at any time thereafter, by giving 30 days advance notice in writing. Motion seconded by Alderman Hyatt and carried. • • Moved by Alderman Hyatt that the request of the City Manager for authority to enter into contracts with city employees for use of their personal autos at a cost, not to exceed '165.00 per month, in lieu of rent cars, be deferred for further study, and that the Mayor appoint a committee of two to study the matter, and investigate the rent cars now in use. Motion seconded by Alderman Banner and carried. Moved by Alderman Reichmuth that the Board of Aldermen annrove and authorize the leasing of a tract of land to Wichita County Water Improvement District No. 1, on the Seymour 'Highway adjacent to the Park Department Building, for the purpose of erecting an office building thereon, subject to the approval of the Park Board as to the amount of land to he leased, the type of building, and the term of the lease; further to authorize and empower Mayor Lloyd C. Thomas, or the City Manager, to execute the said Lease for and on behalf of the City of Wichita Falls, texas, Motion seconded by Alderman Cox and carried. Moved by Alderman Hyatt that the application of the Dudley Shows to operate a 4'Carnival in the City Limits be and the same is hereby denied and refused. • Motion seconded by Alderman Lam and carried, with Alderman Reichmuth voting No. • ORDINANCE NO. 1723 AN ORDINANCE AMENDING ARTICLE TEN (10) OF SECTION XII, OF THE °Li1.MBERS' CODE 4'OF THE CITY OF WICHITA FALLS, TEXAS THE SAME BEING ORDINANCE NO. 1688, BY ADDING THERETO AS FOLLOWS: Moved by Alderman Reichmuth that Ordinance No. 1723 be and the same is hereby approved and passed as read. Motion seconded by Alderman Cox and carried by the following vote: Yeas: Aldermen Hyatt, Reichmuth, Banner, Cox, Lam'and Liepold. Nays: None. • A' Moved by Alderman Lam that the Board of Aldermen approve and authorize payments on Water Main Contracts, as follows: To Mrs C. A. Gillaspia $30$.58, due May 1st on a water main reimbursement contract dated 8-13-51. To Hairston Best Lbr. Co. 1326.70, due May let on a water main reioabarbement contract dated 8-2-51 covering J. w. Thomas Subd., further, to direct the City Clerk to draw checks for each of the above stated. Motion seconded by Alderman Hyatt and carried. Moved by Alderman Liepold that the Plat of Survey of the S-2 1/2 acres of Block 17 of Ed Woodall Subd. #1 of Wichita Falls Suburban Farms, Wichita County, Texas, be and . the same is hereby approved and adopted, copy of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Banner and carried. Moved by Alderman Liepold that the Board of Aldermen approve payment to Joe E Ward, Engineer, the sum of $4365.00, being payment due for Engineering services for plans and specifications on $145,500.00 for water tower, and direct the City Clerk to draw a check for the same payable out of Water Improv. Bond Fund, Ser. 1955. Motion seconded by Alderman Hyatt and carried. ORDINANCE NO. 1724 AN ORDINANCE CLOSING AND ABANDONING THAT PORTION OF LINDA LANE, IN SUNNYSIDE HEIGHTS ADDITION LYING BETWEEN LOT ONE (1) IN BLOCK FOURTEEN (14) AND LOT TNENTY EIGHT (28) IN BLOCK THIRTEEN (13) OF SAID ADDITION, THE SAME BEING MORE FULLY DESCRIBED IN THIS ORDINANCE, AND DECLARING AN EMERGENCY. Daniel that, in keeping with past policy this request be denied. Motion was seconded by Harry Wheat and passed unani- measly. 6. Alley Parking, Skaggs Drag Company. After discussion concerning parking and loading problems at above location, it was moved by Henry Thomason that this matter be referred to Capt. Moore for investigation, Motion was seconded by Titus Mitchell and carried unanimously. 7. Raelnset to Ingrease speed limit on a portion of Lake Park Drive. On the basis of speed checks by the Traffic Engineer, it was moved by Henry Thomason that the speed limit on Lake Park Drive between Barna Road and Weeks St., be increased to 40 M.P.H. Motion seconded by Harry Wheat and passed unanimously. 8. Request for traffic signal at 5th Street and Brook. On motion of Jack Christopher and seconded by F. M. Rugeley, the above request was denied. Motion carried unanimously. 9. Request for ioa410a sone at 10th & Indiana. The above request by Hilliard Furniture Company was granted, with the proviso that the zone be located for mutual use of owners, along the south side of 10th Street, from Indiana west to the alley. Motion by C. C. Daniel, seconded by Jack Christopher and passed. 10. Request for stop sign on Hampstead at Taft. After discussion, and consideration of traffic volume counts, it was moved by Titus Mitchell that the request be denied but that warning sign be erected on Hampstead at this intersection. Further, that two- way stop sign be erected on Harrison at Hampstead Lane. Motion was seconded by Henry Thomason and passed unanimously. II. School Traffic, Parking. Upon motion by Henry Thomason and seconded by Harry Wheat, the Commission recommended unanimously that a survey be conducted by the Engineer concerning parking, ingress and egress, and related traffic problems at the Wichita Falls High School and Zundelowits Junior High School.
