February 14, 1955 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 8:00 o'clock P.M., with the following members present: Lloyd C. Moved by Alderman Liepold that the Minutes of the regular meeting held January 24, 1955, be approved. Motion seconded by Alderman Cox and carried. • ' Moved by Alderman Willis that the Board of Aldermen approve and ratify the Minutes of the Planning Board dated Feb. 11, 1954, which reads as follows: "Mr.W. B. Hamilton submitted a plat of the extension of the 7th Supplement, Country Club Estates, for approval by the Board. After considerable discussion, Mr. Tom Foley moved that the plat be approved. The motion was seconded by Mr. Erle White and approved unanimously by the Board." Motion seconded by Alderman Liepold and carried. e Moved by Alderman Willis that the Riskxmixkke Extended Section of the Seventh ° Supplemental Dedication Plat to Country Club Estates First Section, an addition to the City of Wichita Falls, Texas, be and the same is hereby approved and adopted. Motion seconded by Alderman Meissner and carried. Moved by Alderman Cox that the Board of Aldermen authorize payment to L. Y. Aber- . nathy the sum of $370.60, being payment due Feb. 1, 1955, on a water main contract in Abernathy Addition dated May 12, 1952; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Willis and carried. Moved by Alderman Lam that the Board of Aldermen approve and authorize payment to the Wichita General Hospital the sum of $6816.18 for charity patients for the month of January and direct the City Clerk to issue a check for the same. Motion seconded by Alderman Cox and carried. Moved by Alderman Willis that the Board of Aldermen approve and authorize the execution of a contract by and between the Housing Authority of the City of Wichita Falls for installation of water taps and water meters at Westover Hills Project Tex-41121, Wichita Falls, Texas, and to authorize and empower Mayor Lloyd C. Thomas, or City Manager • 498 H. A. Thomason to execute the said contract for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Liepold and carried. Moved by Alderman Liepold that the Board of Aldermen authorize the execution x of a Release to Fidelity &Deposit Co. of Maryland, being payment in full of all liability for Claim No. 322-941 against William Robert Walkup in the amount of $2500.00 under Bond or Policy No. 28-97-925; further to authorize and empower.City Manager H. A. Thomason to execute the said Release for and on behalf of the City of Wichita Falls. • Motion seconded by Alderman Willis and carried. , As published in the Wichita Falls Record News, Ordinance No. 1713 came on for consideration. There being no opposition to passage of the same, the following motion was made: ORDINANCE NO. 1713 1 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE PRESENT TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, THE SAME LYING IN A SOUTHERLY DIRECTION FROM THE PRESENT LIMITS OF THE CITY OF WICHITA FALLS, ALL OF WHICH ARE FULLY DESCRIBED IN THIS ORDINANCE, AND DECLARING,AN EMERGENCY. (Edgemere South Addition.) Moved by Alderman Liepold that Ordinance No. 1713 be and the same is hereby approved and passed as read. Mr. Rice insisted that since this area had been taken into the city limits, the city should provide sewer mains for the area. Much discussion was had on the subject whereupon by common consent of the Council, the matter was referred to F. M. Rugeley, Director of Public Works, for study, with the idea of working out some satisfactory solution to the problem as to ways and means of financing such project. Moved by Alderman Meissner that the Board of Aldermen approve and ratify the appointments made by Mayor Lloyd C. Moved by Alderman Liepold that the Board of Aldermen grant the request of The ":." , Carnation Company of Texas to install chain link gates at both ends of the alley abuttine^"e their property in the 300 block of Ohio Street for the purpose of locking said gates at night, providing a night watchman is retained around the clock to provide access to both police and fire Departments. It is expressly understood that the said Carnation Company of Texas shall hold the City harmless from any damages whatsoever to any person or persons • or any property damage of any kind or nature. Moved by Alderman Lam that the Board of Aldermen authorize refunds to plumbers in the approximate amount of $1231.00 for Plumber's License fees collected in direct viola- tion of the State Law as indicated by the Attorney General; a schedule of $funds being attached hereto and made a part of the records hereof; further to direct the City Clerk to draw checks for such refunds. Motion seconded by Alderman Meissner and carried. 501 RESOLUTION NO. 269 RESOLUTION ACCEPTING THE PROVISIONS OF STATE HIGHWAY COMt1ISSION MINUTE ORDER THE STATE OF TEXAS Q *COUNTY OF WICHITA II Wichita Falls, Texas February 14, 1955 Motion made by Elie Lam and seconded by Gene Liepold that the Wichita Falls City Council accept the provisions contain-! in Minute Order No. 37392 passed by the State Highway Commission on December 3, 1954, for the improvement by the Texas Highway Department of the roads described below and that Wichita Falls and Wichita County agree to furnish all required right-of-way free of cost to the State; (Minute Order Page 502) For the construction of an Expressway System in Wichita Falls and Wichita County, as provided in Minute No. 37392, a copy of which is in our files and is made a part of this Resolution. The Work proposed is the construction of an Expressway System in and through Wichita Falls for the routing of U.S. 82 and 277, 281 and 287, and the construc- tion of an Industrial Route East of the Railroad tracks from U.S. 281 in the North part of the City to U.S. 287 and 82 East of Wichita Falls. VOTE on the motion was as follows: Yeas: R. P. Willis, Bailey Meissner, inlimcnoMixsasa, Dr. E. Aubrey Cox, Elie Lam and Gene Liepold. Nays: None. WHEREUPON the motion was declared carried. Rugeley Director of Public ?iorks FNR:bm MINUTE ORDER WICHITA COUNTY PAGE 1 of 3 PAGES DISTRICT NO. 3 WHEREAS, in WICHITA COUNTY and in the City of Wichita Falls the Highway Commission by previous action has provided for partial financing of an Expressway facility located within the City of Wichita Falls, and in addition by separate actions has authorized planning for the future development of U.S. Highway 82 and 287 from Wichita Falls to theClay County line, U.S. Highway 287 from Wichita Falls to the Wilbarger County line, and U.S. Highway 277 and 281 from Wichita Fals to the Oklahoma State line, and WHEREAS, it is the joint desire of the local officials and the Highway Department to integrate previous planning actions and establish an overall long range plan for the construction of needed highway facilities, such plan to serve in establishing a rutual. agreement on financial responsibilities and procedures necessary for the ultimate fulfillment of the plan, and WHEREAS, there is an immediate need for such an integrated plan in order that steps way be taken to protect and acquire rights of way within economical bounds, the local officials diaving indicated a desire to proceed immediately with such rights of way acquisition and protection, NOT, THEREFORE, IT IS HEREBY ORDERED that the State Highway Engineer tender to Wichita County and the City of Wichita Falls, the following proposal: The plan herein proposed shall provide for the ultimate development to Expressway standards of U. S. Highways 287 from the Wilbarger County line east toward Wichita Falls,. and U.S. Highways 277 from the Oklahoma State line South towards Wichita Falls, such highways Joining at a point near the north city limits for a common routing through the City in the general vicinity of Broad and Holliday Streets. The common route through Wichita Falls shall be developed to xpressway standards to include a two street dispersal system along Holliday and Broad. Streets from approximately Eighth street. to Seventeenth Street. The Expressway through the City will extend to a proposed intersection of U.S. Highway 281 and U. . Highway 82 and 287 at or near the southeast city limits and from this intersection the Expressway construction shall be continued along the routing of U.S. ighuray 281 is a southerly direction to connect with the present route of U.S.Highway 281 near the Archer County line and along the routing of U.S. Highways 8Z and 2e7 in a easterly direction to a connection with present U.S. Highway 82 and 287 near the Clay County line. The Expressway route through Wichita Falls shalt be supplemented by an Industrial Route located east of the r Wr a FwA0C Railroads and extending Prom ipresent SU.S. High- ways 82 and 287 southeast of Wichita Fal.lsto present U.S. Highway 281 in the northern part of the City. The following statement of responsibilities and procedures shall govern in the development of the plan. Furnish free of cost to the State and clear of obstructions and• encumbrances the following minimum right. of way widths, it being understood that ad- ditional widths will be required for special conditions such as Interchanges, grade separations and where rough terrain exists: (a) Cm the section of the Expressway route from the Dispersal System north to an intersection with present U.S.Highway 267, provide a desired minimum 250 right of way width, with an absolute minimum of 220 width being acceptable in the vicinity of Scotland Park if found necess- ary due to controlling topography. (b) Provide a minimum 100 right of way along the sections of !hoed and Holliday Streets which wi it ! constitute the Expressway Dispersal System and which i located between approximately Eighth reet and Seventeenth Streets. (c) Provide a minimum 3001 right of way width on the balance of the Fxeressway routes within the. City, metropolitan and rural areas.= (d) For -the Industrial Route east of the railroads. provide a usual width of 120' with a desirable minimum of I00' and absolute minks= of 90' for the sections constructed to urban roadway design, and a usual 170' width with an absolute minimum of 1201 for the sections constructed to surburban roadway design. 2. For the Industrial Route, execute the Highway Department's standard forms for construction and maintenance as required for usual highway projects within municipalities, and perform such work as Ls prescribed asAhe City's responsibility in Highway Commission policy minute order 20264 governing such joint City-State municipal highway projects. 3. Declare the portion of the Expressway routes lying within the corporate limits of Wichi&a Falls, a Freeway in accordance with the provisions of House ill 541, 52d Legislature, and execute the Highway Department's standard forms for con- struction and maintenance of Expressway projects, within incorporated cities and towns. 4. For the limits of the Dispersal System; pass and enforce ordinances providing for one way traffic operations and parallel parking on the individual streets, with the provision that parking will be prohibited as future traffic engineering studies may dictate. 5. Accept into the local road and street system all existing highway routes which can be relinquished by the State be- cause of the re-routing and re-location of highways as established by this plan. The Highway Department will: 1. By this action express its intent to develop to completion the ultimate plan, it being. understood that such work will be undertaken by increments based on availability of funds, traffic needs, and on continuous usuabie sections where all required right of way has bean acquired.. 2. Highway 287, a distance of 1.6 miles at an estimated cost of 0,800,000. This action cancels the original proposal for construction of this project as contained in, Uinute 29962 and as amended by Minute 34354, and supersedes the program item in the 1955-56 Consolidated Highway Program which provided partial financing of this section. For the remainder of the plan as herein outlined, proceed with surveys and prepare and release deeds to the local governmental agencies for acquisition of the required rights of way. It is understood that the Department's future participation in con- struction of the Industrial Route shall be in accordance with Com- mission policy for municipal highway projects as contained in Minute 20264. It is also understood that Expressway development extending to the Oklahoma State line shall remain subject to the provisions of TAnute 36699. This order and its acceptance by wichita County and the City of Wichita Falls shall be construed as a long range work plan intended to secure the orderly, economical and expeditious completion of the desired improvements. This order will become operative upon ac- ceptance by the proper officials of Wichita County and the City of Wichita Falls. If not accepted within 120 days it shall become automatically cancelled.
