January 10, 1955 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session ion the above date, in the Council Room of the Memorial Auditorium Bldg. at 8:00 o'clock P.M., with the following members present: Lloyd C. Moved by Alderman Willis that the Minutes of the regular meeting held December 27, 1954, be approved. Motion seconded by Alderman Liepold and carried. As advertised, bids for the sale of $1,700,000 Waterworks System Bonds were opened by the City Clerk and read aloud by the City Manager. Motion seconded by Alderman Willis and carried. The request of Buford Rice for free sanitary sewer line construction on Seymour ti Highway & Beverly Drive was discussed, whereupon the following motion was made: Moved by Alderman Meissner that the Board of Aldermen approve and authorize } sanitary sewer line extensions beginning at Harrell School and extending westward to Beverly Drive and the south side of Seymour Highway, providing the same is constructed on the usual reimbursement contract proceedure. Motion seconded by Alderman Hammond and carried. � 7 The request of Wichita City Lines, Inc. for certain changes in their franchise Agreement was, by common consent of the Council, deferred for further study. / • p Moved by Alderman Cox that the Board of Aldermen authorize the execution of a Contract with the Wicjata County Control and Improvement District No. 4 to furnish water to that District, upon the completion of their water system at rates previously agreed to by the City Council; further to authorize and empower Mayor Lloyd Thomas to execute a Contract with the said Wichita County Water Control and Improvement District No. 4 for and on behalf of the City of Wichita Falls. ti Motion seconded by Alderman Meissner and carried. . 1 Moved by Alderman Hammond that the Board of Aldermen approve and authorize the he continuation of an Agreement and Contract by and between the Board of Water Engineers of the State of Texas and the City of Wichita Falls upon the terms and considerations recited in the said Agreement and Contract and direct the City Clerk to draw a check in the amount of $2000.00 due and payable on or before January 15, 1955; further to authorize and empower Mayor Lloyd C. Thomas or City Manager H. A. Thomason to execute the said Agreement for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Liepold and carried. Moved by Alderman Hammond that the bid for the purchase of $1,700,000 Waterworks System Bonds be awarded to John Nuveen & Co. of Chicago, providing 50 bonds of this issue maturing in 1971 and 50 maturing in 1972 be sold to the City of Wichita Falls at par value. Motion seconded by Alderman Willis and carried unanimously. Moved by Alderman Liepold that the Board of Aldermen approve and authorize Egg payment to Treasurer of the United States, the sum of $1500.00, being payment for landing 1 fees at Kell Field from Dec. 21, 1954 to March 21, 1955, as per contract; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Willis and carried. Moved by Alderman Cox that the Board of Aldermen authorize the execution of F+ Supplemental Agreement No. 9 to Contract No. AF 41 (183)-19, transferring title to the idle'. 20 inch water supply line to Sheppard Air Force Base to the City of Wichita Falls and to authorize and empower Mayor Lloyd C. Thomas to execute same for and on behalf of the City 1 of Wichita Falls. Moved by Alderman Cox that the Board of Aldermen approve and adopt the Plat of j Second Revision of Lot 5, Block 1, a Revision of Ditto Heights, a subdivision of a portion of Block 4, Kemp & Newby Subd. of Cherokee Co. Four League Grant, Abstract No. 81, Wichita Falls, Wichita County, Texas; also adopt the Plat of Second Revision of Lot 3, Block 11 of a Revision of Ditto Heights, a Subdivision of a portion of Block 4, Kemp & Newby Subd. of Cherokee Co. Patton Sr. $1166.12, due Jan.'1, 1955, on water main contract dated 5/28/51, covering Patton Subd, To Hamilton Investment Co. $86.51, due Jan 4, 1955, on contract dated 1/4/52 for sewer mains in 6th Supplemental Addition , Country Club Estates Addn., further to direct the City Clerk to draw checks for each of the above stated amounts. AN ORDINANCE AUTHORIZING THE ISSUANCE OF $1,700,000 FIRST INSTALLMENT OF $3,000,000 WATERWORKS IMPROVEPNT BONDS; PRESCRIBING THE TERMS AND CONDITIONS THEREOF; MAKING PROVISION FOR THE PAYMENT OF PRINCIPAL AND INTEREST THEREON; AND DECLARING AN EMERGENCY. HE STATE OF TEXAS 1 UNTY OF WICHITA The Board of Aldermen of the City of Wichita Falls, Texas, convened in regular Aession at the regular meeting place within said City on the 10th day of January, 1955, with the following members present: to—wit: 488 Lloyd Thomas Mayor Dr. E. Cox made a motion that the ordinance be adopted as read. The motion was seconded by Alderman Jack Hammond, and carried by the following voter YEAS: Aldermen Cox, Willis, Hammond, Meissner, and Liepold. NAYS: None. The Mayor requested to be recorded as voting tYea.I The ordinance thus adopted follows: ORDINANCE NO. 1712 AN ORDINANCE AUTHORIZING THE ISSUANCE OF $1,700,000 FIRST INSTALLMENT OF $3,000,000 WATERWORKS IMPROVERS NT BONDS; PRESCRIBING THE TERMS AND CONDITIONS THEREOF; MAKING PROVISION FOR THE PAYMENT OF PRINCIPAL AND INTEREST THEREON; AND DECLARING AN EMER- GENCY. WHEREAS, at an election held in the City of Wichita Falls, Texas, on the 14th day of December, 1954, more than a majority of the duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation, voting at said election, voted in favor of the issuance of the bonds of said City in the amount of Three Million Dollars ($3,000,000.00) for the purpose of constructing improvements and extensions to the City+s existing waterworks system; and WHEREAS, said election was properly called and notice thereof given as required by law, and the Board of Aldermen have heretofore canvassed the results thereof and deter- mined the specific authority of the City to issue said bonds; and WHEREAS, this Board of Aldermen is of the opinion that it is desirable at this time to authorize the issuance, sale, and delivery of a first installment of said bonds in the sum of One Million Seven Hundred Thousand Dollars ($1,700,000.00), leaving the remaining One Million Three Hundred Thousand ($1,300,000.00) bonds to be issued, sold, and delivered as the City needs additional funds for constructing improvements and extensions to the City's existing waterworks system; Therefore BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Section 1: That the bonds of the City of Wichita Falls, Texas, be issued in the principal sum of One Million Seven Hundred Thousand Dollars ($1,700,000.00), to be known and designated as "CITY OF WICHITA FALLS WATERWORKS IMPROVEMENT BONDS, SERIES 1954", for the purpose of constructing improvements and extensions to the City's existing waterworks system, under and by virtue of the Constitution and laws of the State of Texas, particularly Chapters 1 and 7 of Title 22, Revised Civil Statutes of Texas, 1925, as amended, and the Charter of said City of Wichita Falls, said bonds constituting the first installment or series of bonds issued by the City of Wichita Falls out of an issue in the total principal amount of Three Million Dollars ($3,000,000), authorized by a vote of the duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation, voting at an election held within said City on the 14th day of December, 1954. Section 2. That said bonds shall be dated February 15, 1955, shall be numbered from One (1 to One Thousand Seven Hundred (1,700), both inclusive, aggregating One Million Seven Hundred Thousand Dollars ($1,700,000), and shill become due and payable serially on the 15th day of February of the years and in the respective amounts shown in the following schedule: Bond Noe. Both principal and interest on said bonds shall be payable in lawful money of the United States of America at The City National Bank in Wichita Falls, Wichita Falls, Texas, or at the option of the holder at the First National Bank in Dallas, Dallas, Texas, upon presentation and surrender of the bonds as they severally become due, or, as to the interest falling due on and prior to maturity, upon presentation and surrender of the interest coupons attached to said bonds as they severally become due. Section 4: That each of said bonds shall be signed by the Mayor and countersigned by the City Clerk, and the corporate seal of said City shall be impressed upon each of them. The facsimile signatures of the Mayor and City Clerk may be lithographed, engraved, or printed on the coupons attached to said bonds, and shall have the same effect as if they had been signed by said officers. Section 5: That the form of said bonds shall be substantially as follows: No. $1,000.00 UNITED STATES OF AMERICA STATE OF TEXAS COUNTY OF WICHITA CITY OF WICHITA FALLS WATERWORKS IMPROVEMENT BOND SERIES 1955 The City of Wichita Falls, in the County of Wichita, State of Texas, for value received, hereby acknowledges itself indebted to and promises to pay to bearer on the 15th day of February 19___, thO sum of One Thousand Dollars ($1,000), with interest thereon from date hereof at the rate of %per annum, interest payable February 15, 1956, and semi-annually thereafter on August 15th and February 15th of each year until the principal sum hereof shall have been paid. It is hereby certified, recited, and represented, that the series of bonds of which this bond is a part was authorized at an election held in the City of Wichita Falls, Texas, on the 14th day of December, 1954, and that all acts, conditions, and things necessary to be done precedent to and in the issuance of these bonds, in order to make them legal, valid, and binding obligations of said City, have been done, have happened, and have been performed in regular and due time, form, and manner as required by law; that due provision has been made for levying and collecting annually by taxation, an amount sufficient to pay the interest on these bonds as it falls due and to provide a sinking fund for the final redemption of said bonds at maturity; and that the issuance of these bonds of which this one is a part, together with all other indebtedness of said City, does not exceed any consti- tutional or statutory limitation. Marrs concerning approval of a small tract of land to be known as the Wm. H. Crawford Addition. This addition is located in the north part of the city and is in the city limits. This plat had been previously cleared by the Department of Public Works and the Park Department. By motions that are recorded in the minutes of this meeting, your Board has approved this plat and respectfully recommends approval by the Council. Cline: Herewith is a small Plat of six lots, lying in the Northeastern corner of the City, which belonged to Wm. H. Cranford , who died about two years ago. At that time, these lots had not been surveyed out, though he had contracted to sell what is now Lots 1 and 2 and been paid something on them. After I was appointed Administrator of this small estate, I found that before I could sell this plat of ground, I must have it surveyed, since it lies within the city limits . I had Mr . T. H. Clement survey it , and here is his map or Plat he gave me after surveying it . All I want to do is to get this approved, if possible so I can sell this plat of ground and get rid of it . I have had Mr . R#gely, the City Engineer to approve it , and also Mr • Ellis of the City Park Department approve it, and now I will thank your board or Commission to approve it. This addition is just within the city limits and I see no objectiop to approval of the layout. Our main concern was for the drain ditch easement on the fronts of Lots 1 through 4 and this easement has been indicated.
