Juge 14, 1954 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date in the Council Room of the Memorial Auditorium Building, at 8:00 o'clock P.M., with the following members present: mot Lloyd C. Walter Friberg City Attorney Moved by Alderman Willis that the Minutes of the regular meeting held May 24, 1954, be approved. Motion seconded by Alderman Hammond and carried. As advertised, bids for paving Sheridan Road, from Burlington to St. John, were opened by the CityClerk and read aloud by F. M. Rugeley, Director of Public Works. M. Rugeley, Director of Public Works, and award the bid for paving Sheridan Road, from Burlington to St. John Streets, to the lowest bidder, Virgil Stone for a consideration of $5067.51. Motion seconded by Alderman Hammond and carried. Moved by Alderman Cox that the Board of Aldermen approve and authorize the Park Department's portion of paving Sheridan Road in the amount of approximately $847.50 and direct the CityClerk to draw a check payable to the low bidder, for the said amount of $847.50. M. Rugeley, Director of Public Works, recommended that the paving of York St. be awarded to T. A. Litteken&Sons Inc., since the said T. A. Litteken & Sons, Inc. are doing all the inside paving for the Catholic Church located on York St., and the further fact that certain officials of the Catholic Church have requested the paving of York St. be awarded to the above stated firm, thereupon the following motion was had: �f, Moved by Alderman Lam that the contract for paving York St., from the east line of Colquitt St. to the west end of York St. be and the same is hereby awarded to T. A. Litteken & Sons, Inc. for a consideration of $11,198,03,--of which amount $997.07 is the Cityts regular portion. Motion seconded by Alderman Hammond and carried. + . Moved by Alderman Cox, that, in accordance with the recommendation of F. Rugeley, Dir. of Public Works, the bid of Myron Groseclose of Bethany, Okla., as K' submitted at a regular council meeting May 24, 1954, for paving 30 blocks for a con- sideration of $118,346.65, be, and the same is hereby rejected for reason, among other things, only one bid was received. Motion seconded by Alderman Liepold and carried. Moved by Alderman Lam that the Board of Aldermen authorize payment to Joe H. Farabee the sum of $222.45, being payment due June 1, 1954, on a water main contract entered into by and between Joe H. Farabee and the City of Wichita Falls Sept. 8, 1952, for water mains in Farabee Addition, and particularly described as Surrey Circle; further to direct the CityClerk to draw a check for the same. Motion-seconded by Alderman Willis and carried. Moved by Alderman Lam that the Board of Aldermen authorize payment to C. P. McGaha the sum of $2072.18, being the amount due June 1, 1954, on a water main contract entered into by and between C. P. McGaha and the City of Wichita Falls Sept. 11, 1950, for water mains in Southmoor Addition - C. P. McGaha tract; further to direct the City Clerk to draw a check for the same. Motion seconded by Alderman Willis and carried. ORDINANCE NO. 1689 AN ORDINANCE PROHIBITING ANY PERSON FROM ADVERTISING ANY PRODUCT OR SERVICES UPON PUBLIC STREETS OR ALLEYS IN THE CITY OF WIBHITA FALLS; PROVIDING EXCEPTIONS; PRO- VIDING PENALTY; AND DECLARING AN EMERGENCY. 427 Moved by Alderman Liepold that Ordinance No. 1689 be and the same is hereby approved and passed as read. Motion seconded by Alderman Hammond and carried by the following vote: Yeas: Aldermen Willis, Hammond, Cox, Lam and Liepold. Nays: None. 1441110.4 f ,/ Steve Marchand, Director of Civil Defense, made a verbal report to the Council, ' urging, in his opinion, the necessity of installing nine sirens for air-raid warnings ' at various points in the City, the cost of which would be $17103.50, one-half of which would be paid by the Federal Government and the remaining one-half by the City, providing the city's portion could not be raised through other means, whereupon City Manager, H. A. Thomson, was directed to confer with Mr. Marchand on this project. Mr. Leffard, local Mgr. of the Wichita City Lines, Inc. again requested can- cellation of the 2% gross receipts tax required by the City, thereupon the following motion was made: --- Moved by Alderman Liepold that the application of Wichita City Lines, Inc. 'f.athe City to cancel the 2% gross receipts tax being charged the said Wichita City, Lines, Inc. for use of the streets, be and the same is hereby rejected and denied. Motion seconded by Alderman Hammond and carried. aA3 Moved by Alderman Cox that the Board of Aldermen authorize an additional • expenditure of $3500.00 to make certain changes and additions to the Band Shell at Bridwell Park, as recommended by Mr. S. P. Ellis, Director of Parks, and that payment ' of same be made out of the Park Bond Improvement Fund. Motion seconded by Alderman Lam and carried. £r' Moved by Alderman Willis that the Board of Aldermen approve and adopt the Re-Plat of Blocks 9 through 18 and Lot 1, Block 35, and Block 31, Faith Village Unit 1, an addition to the City of Wichita Falls, Texas, copy of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Liepold and carried. 47 Moved by Alderman Lam that the Board of Aldermen authorize payment to Fort Worth &Denver Ry Co. the sum of $4373.12 for certain materials and the installation of traffic signals necessary to synchronize the Railway Crossing signals with the traffic signals on Kell Blvd., and direct that some be paid out of the Street Bond Improvement Fund cash. Motion seconded by Alderman Hammond and carried. As advertised, bide for purchase of 6" and 8" Cement Asbestos pipe (were opened by the City Clerk and read aloud by John P. Ruhmann, Director of Utilities. The bids were as follows: ' . Ruhmann recommended that the bid fob the above and foregoing pipe be awarded to Bailey-Meissner Co., thereupon the following motion was had: Moved by Alderman Hammond that the awarding of bid for purchase of 6" and 8" • ipe be delayed for a few days. 4 Motion seconded by Alderman Liepold and carried. 428 Moved by Alderman Hammond that, in accordance with bide received for purchase of 80,000 lbs. of Copperas, as listed on Purchase Summary dated June 11, 1954, and attached hereto and made a part of the records hereof, the bid be awarded to Chemical F Supply Co. for 80,000# Copperas for a consideration of $2230.00, less 1% discount 10 days. Boardman of this city is requesting the City Council for an order to the County Clerk authorising the recording of a plat of a subdivision of certain lands out of Block 17, Woodall Subdivision. • Some time in the past, the Oe eissioners Court has requested the Cour+m+r not to authorise the recording of any plat which would dedicate any new road or street of less than fifty feet in width. This particular plat in^ludse one street located 115.5 feet North of Borten Lane and emending west 421.$ feet from Olenwod Road to be forty feet wide. This will be a deed—end street and we wish to wave our width requirement on this street and ask the Council to authorise the recording of this plat with the width of this street to be forty feet. No. 1, was read to the Council, with no action taken due to the fact that Mrs Boardman has not to this date, presented such Plat. City Manager, H. A. Thomason, appointed Dr. Geo. Davis, Pastor of the First Christian Church, to serve on the Civil Service Commission, succeeding Leon Deaton, whose term expired Feb. 25, 1954; Dr. Davis' term to expire Feb. 25, 1957; thereupon the following motion was had: Moved by Alderman Liepold that the Board of Aldermen approve and ratify m the above and foregoing appointment of Dr. Geo. Davis, whose term shall expire Feb. : 25, 1957. Motion seconded by Alderman Cox and carried. Moved by Alderman Hammond that Mr. Bailey Meissner be and he is hereby e elected to serve on the Board of Aldermen of the City of Wichita Falls, Texas, as Alderman, Place No. 2, whose term shall expire at the next regular election to be held in April, 1955. Motion seconded by Alderman Willis and carried by the following vote: Yeas: Aldermen Willis, Hammond, Cox, Lan, Liepold and Mayor Lloyd Thomas. Nays: None. {,;.' Mayor Lloyd C. Thomas made the following appointments to serve on the City aaef Wichita Falls Planning Board: One Year Term, Elpiring June 14, 1955: Carl Estep Henry Mason Walter Cline Two Year Term, Expiring June 14, 1956: Earl White L. H. Estes, Jr. Three Year Term, Expiring June 14, 1957: Tom Foley Geo. W. Graham; thereupon the following motion was had: Moved by Alderman Cox that the Board of Aldermen approve and ratify the above and foregoing appointments made by Mayor Lloyd C. Thomas to serve on the City of Wichita Falls Planning Board. Motion seconded by Alderman Liepold and carried. Moved by Alderman Cox that the Board of Aldermen authorize tax refunds as follows: To Jeff Allen, the sum of $5.68 for personal taxes for year 1952, on one auto assessed in error due to Mr. Allen living out of the City Limits. To W. F. Hyder, the sum of $3.52 on account of double payment of personal taxes on one auto for year 1953. To Mrs C. E. Flourney, the sum of $41.92 on account of double payment for the year 1953; further, to direct the Tax Assessor& Collector, or the City Clerk to refund each of the above stated amounts. Motion seconded by Alderman Lam and carried. Moved by Alderman Willis that the Board of Aldermen approve and authorize transfer of E. P. Cab Company's Certificate of Convenience & Necessity to operate 8 taxicabs upon the streets of the City of Wichita Halls, to Wichita Cab Co. Inc. 4 certificates, and Cowden Cab. Co. 4 certificates. Motion seconded by Alderman Liepold and carried. 430 Moved by Alderman Lam that the Board of Aldermen authorize the execution of an Agreement with J. J. Lane for Concession rights at Spudder Ball Park, upon the terms and conditions recited in said Agreement; further to authorize and enpower City Manager H. A. Thomason to execute same for and on behalf of the City of Wichita Falls, Texas. Motion seconded by Alderman Hammond and carried. i I , • • • • • • 431 The above and foregoing instrument, which was received in the Office of the City Clerk May 27, 1954, and approved as to form by the City Attorney, J. Walter Friberg, May 28, 1954, was read to the Board of Aldermen by the City Clerk. The same was ordered filed in the Office of the Clerk. Mr. R. E. Cowden, Pres. of Cowden Cab Co. and Wichita Cab Co. respectively, requested certain changes in taxicab fares, wherein the charge would be 35 cents for the first one-bait'mile and an additional charge of 10 cents for each one-half mile, with a flat charge of 10 cents for each additional passenger. ✓ The matter was discussed by the Council, whereupon the following motion was made: Moved by Alderman Cox that the Mayor name a Committee to confer with Mr. Cowden relative to the proposed changes in taxicab fares, and that a Public Hearing of such proposed rate changes be set for the next regular meeting to be held June 28, 1954. Motion seconded by Alderman Willis and carried. D. H. Bolin, member of the Country Club Estates Police Patrol Assn., requested the City to equip one of the county's patrol cars, that is presently / patrolling the Country Club Estates area, with a radio, whereupon City Manager, H. A. Thomason stated he felt if the City complied with this request, the City should retain control of the monitoring of the same. The matter was discussed and referred to the City Manager for further consideration, and recommendation. i EvVL Moved by Alderman Hammond that the Board of Aldermen approve the plans submitted by John P. Ruhmann, Dir. of Utilities, for the construction of a 16" and 210 water main, beginning at Hampstead Lane &Holliday Streets and extending to Lawrence Street; further to authorize Mr. Ruhmann to advertise for bids on the same to be opened at a Council meeting to be held July 12, 1954. Motion seconded by Alderman Cox and carried. a Mayor Lloyd C. ThOnas designated June 25th through July 1st as City Clean-Up Y Week, and stated the Garbage Department would pick up extra garbage, tree trimmings, etc., without extra charge, providing the same was placed reasonably accessible to the Garbage trucks. Moved by Alderman Lam that the meeting be adjourned. Motion seconded by Alderman Hammond and carried. UNDER FLUORIDATION INITIATIVE PETITION: "BE IT RESOLVED THAT THE PROGRAM NOW IN EFFECT OF ADDING SODIUM FLURINE OR FLUORINE COMPOUNDS INTO THE DRINKING WATER OF WICHITA FALLS, TEXAS, KNOWN AS "ARTIFICIAL FLUORIDATION OF PUBLIC WATER SUPPLY", BE SUSPENDED AND ABOLISHED: The undersigned Committee for the petitioners under the initiative provisions of the. Charter of the City of Wichita Falls, Texas, and in accordance with the initiative petition heretofore filed and approved with respect to artificial fluoridation of the public water supply of the City of Wichita Falls, Tens, hereby respectfully request and require that the foregoing Measure, Resolution or Ordiance, be submitted to a Vote of the Electors of the City of Wichita Falls, Texas, at the next Municipal Election of the City of Wichita Falls, Texas, to be held by, in and for the said City of Wichita Falls, Texas.
