Min 03/22/1954 389 Wichita Falls, Texas Memorial Auditorium Building March 22, 1954 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Building, at 8:00 o'clock P.M., with the following members present: Kindel Faulk Mayor R. P. Willis 0 Lloyd C. Thomas Jack L. Hammond 1 Aldermen Dr. E. Aubrey Cox Elie E. Lam Henry D. Mason Q Geo. T. Henderson City Clerk H. A. Thomason City Manager J. Walter Friberg City Attorney Moved by Alderman Willis that the Minutes of the regular meeting held March 8, 1954, be approved. ,a Mr. B. B. Greever, representative of a committee previously appointed to ' draft a Building, Plumbing and Electrical Codes, made a report to the Council, asking that the report be accepted and the Committee discharged; thereupon Mayor Kindel Faulk requested the Committee to continue until such time as the Codes were finally approved, and directed that the Amendments to the Southern Building Code, Electrical, numbing and Gasoline Storage Codes be printed for distribution to whomsoever may desire the same, and that a Public Hearing on a proposed Ordinance adopting the above described Codes be held at a Call Meeting, Wednesday, March 31, 1954s at 8:00 o'clock P.M. and that due Notice of the same be published in the Record News. Mr. W. H. Gardner came before the Council to inquire what had been done with reference to a petition previously presented, requesting that a certain area lying north of the Continental Oil Co. Refinery, be taken out of the Corporate Limits. The matter was discussed whereupon Alderman Willis, City Attorney Walter Friberg and Tax Assessor Ben Armstrong were designated as a committee to confer with residents of that area to determine whether or not they really wanted to be out of the city limits after certain facts had been presented to them, and if found advisable, the City Attorney should prepare the necessary ordinance and present the same to the Council for further consideration. Next came on to be considered was canvassing returns of the Special Election held March 16, 1954. Returns from each precinct were officially opened by the City Clerk and read aloud by Mayor Kindel Phuik, and tabulated by Aldermen Mason and Hammond, thereupon the following Resolution was presented: RES0LUTION NO. 252 WHEREAS, at a regular meeting of the Board of Aldermen of the City of Wichita Falls,Texas, held in theMemorial Auditorium Building in said City on the 22nd day of March, A.D. 1954, at which time a quorum was present, came on to be considered the returns of the Special Election held on the 16th day of March, 1954,„for the proposed minimum salary of $275.00, per month for Firemen and Policemen, and for the Repeal of the Firemen's and Policemen's Civil Service Law as applied to the City of Wichita Falls under Authority of Article 1269m, as amended, of the Revised Civil Statutes of Texas, and, Nftme WHEREAS, after canvassing the returns of said election, it was found to be duly and legally held in all respects, and there were case at said election 8875 votes, with the following results: For the proposed minimum salary of $275.00 per month for Firemen and Policemen 5671 votes Against the proposed minimum salary of $275.00 per month for Firemen and Policemen 3153 votes For the repeal of the Firemen's and Policemen's Civil Service Law as applied to the City of Wichita Falls under authority of Article 390 1269m, as amended, of the Revised Civil Statutes of Texas 3088 votes Against the repeal of the Firemen's and Policemen's Civil Service Law as applied to the City of Wichita Falls under authority of Article 1269m, as amended, of the Revised Civil Statutes of Texas 5787 votes aw AND, it appearing that the greatest number of votes were case for the proposed minimum salary of $275.00 per month for Firemen and policemen, and the greatest number of votes were cast Against the Repeal of the Firemen's and Policemen's Civil Service Law as applied to the City of'Wichita Fans under authority of Article 1269m, as amended, of the Revised CivillStatutes of Texas; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That the minimum salary for Firemen and Policemen be set at $275.00 per month, and that the Civil Service Law for Firemen and Policemen continue in effect. Moved by Alderman Mason that Resolution No.252 be adopted and passed as read. Motion seconded by Alderman Thomas and carried by the following vote: Yeas: Aldermen Willis, Thomas, Hammond, Cox, Lam and Mason. Nays: None. Moved by Alderman Mason that the present Board of Aldermen go on record as recommending to the incoming Council that all City Employees be given an increase in salary commensurate, or in proportion to increases recently voted for Policemen and Firemen in the City election held March 16, 1954. Motion seconded by Alderman Hammond and carried. Bids for the purchase of motorcycles for the Police Department were opened by the City Clerk and read aloud by Mayor Kindel Faulk. The bids were as follows: {; Wichita Cycle Company $3426.85 Moved by Alderman Lam that the Board of Aldermen accept the bid of the Wichita Cycle Company for 2 - 1954 Harley-Davidson Police motorcycles, and 1 - 1954 Harley-Davidson Police Servi-Car, at $3876.85, less $450.00 trade-in allowance for 1 used Servi-car, City No. 87, at a net cost of $3426.85. Motion seconded by Alderman Hammond and carried. • Bids for the purchase of 5-6" and 10-8"Oats Valves were opened by the City 4 Clerk and read aloud by Mayor Kindel Faulk. The bids were as follows: Clowe & Cowan- Net 10th prox $1035.12 Morrison Supp.yCo. " 10th " 925.61 Amer. Standard Radiator &Sanitary Corp. Net 10th prox 886.80 Homer 0. Maxey& Co. " 10 days 955.85 Moved by Alderman Thomas that the above and foregoing bids be referred to John P. Ruhmann, Director Pablic Utilities, for study and recommendation and report back to the Council at the next meeting called for March 31, 1954. Motion seconded by Alderman Hammond and carried. 391 Moved by Alderman Hammond that, in'accordance with previous bids received for a band shell at Bridwell Park, the Board of Aldermen accept the bid of C. W. Taylor for Base Proposal No. 1, Alternate No. 1, at a cost of $14,91,5.00, being the lowest and best bid, and authorize H. A. Thomason, City Manager, to execute a contract for and on behalf of the City. Motion seconded by Alderman Mason and carried, with Aldermen Cox and Lem voting No. Moved by Alderman Lam that, in accordance with bids previously received for FM Radio Equipment, etc., the Board of Aldermen accept the recommendation of-Bob Brown, , City Radio Technicsm and award the bid to Motorola Communications &Electronics, Inc. for a price of $10,'269.76, and authorize H. A. Thomason, City Managers to execute a contract with the above named Firm, for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Hammond and carried. Moved by Alderman Thomas that, in accordance with bids previously received for paving the area around the Fire Department Drill Tower, And acting upon the /recommendation of F. M. Rugeley, Director of Public Works, the Board of Aldermen accept the bid of R. 0.Green at $2.20 per Sq. Yard, for Hot Mix Surfacing. Motion seconded by Alderman Cox and carried. As advertised, the Public Hearing.was held on Ordinance No. 1681. There being no opposition to the said Ordinance No. 1681, the following motion was had: Moved by Alderman Mason that the Public Hearing on Ordinance No. 1681 be closed. Motion seconded by Alderman Lam and carried, by the following vote: Yeas: Aldermen Willis, Thomas, Hammond, Cox, Lam and Mason. Nays: None. ORDINANCE NO.1681 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FATS, TEXAS, BY ANNEXING CERTAIN LANES ADJACENT TO THE PRESENT TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, THE SAME LYING IN A SOUTHERLY DIRECTION FROM THE PRESENT LIMITS OF THE CITY OF WICHITA FALLS, ALL OF WHICH LAMS ARE FULLY DESCRIBED IN THE BODY OF THIS ORDINANCE. (Unit 2, Hursh Addition) Moved by Alderman Mason that Ordinance No. 1681 be approved and passed as read. IZ) RESOLUTION NO.254 f` WHEREAS, the'City National Bank in Wichita Falls, Texas, Depository of the City of Wichita Falls, Texas, has deposited in-trust with the First National Bank in Dallas, the sum of$1,500,000.00 in U.S. 2-7/8% Treasury Notes, Series A 1957, due w 3-15-57 Nos. 922/926, at 100M ea $1,500,000.00 and, WHEREAS, the City National Bank of Wichita Falls, Texas, has requested release of the above described Treasury Notes, and WHEREAS, the City National Bank of Wichita Falls, Texas, agrees to substi- tute in lieu thereof the following: U.S. 2i% Tr. Bonds of 6-15-59/62 in the amount of 300,000.00 U.S. 2-3/8% Tr. Bonds due 6-15-58, in amount of 1,300,000.00 aggregating the sum of $ 1,500,000.00 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That The City Treasurer and the CityClerk of the City of Wichita Falls, Texas, be and they are hereby authorized to accept as security for the City of Wichita Falls, 4, Texas, $300,000.00 U.S. 2 Treasury Bonds of 6-15-59/62, and $1,200,000.00 U.S. 2-3/8% Treasury Bonds due 6-15-58, and surrender the above described Treasury Notes, Certificate Nmx No. 50899, aggregating the sum of $1,500,000.00 now on deposit with the First National Bank in Dallas. RESOLUTION NO.253 111 BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That the Wichita Cab Company and the CowdenCab Company, who operate certain taxicabs in the City of Wichita Falls, be allowed to deposit securities, or Building & Loan deposit certificates, or cash, with the City Clerk of the City of Wichita Falls in the amount of Ten Thousand ($10,000.00) Dollars, in lieu of Public Liability and Property Damage insurance on their taxicabs. Such security to be held by the City Clerk and in the event that a final judgment is obtained against either Company that is unpaid for ten (10) days, the City Clerk is authorized to pay such judgment out of such funds. 393 Moved by Alderman Mason that Resolution No. 253 be adopted and passed as read. Moved by Alderman Hammond that the Board of Aldermen approve and authorize payment to Wichita General Hospital the sum of$8759.79 for charity patients for the fmonth of February, 1954, and direct the CityClerk to draw a check for the"same. M. Rugeley, Director of Public Works. Motion seconded by Alderman Lam and carried. Moved by Alderman Cox that the Board of Aldermen authorize the issuance of a permit to Bramwell Construction Company, a division of Safeway-Stores, Inc., to v install an underground electrical conduit from the Safeway-Store at 1506 - llth St. across the alley to their new parking lot on 10th St., providing the same is installed in accordance with requirements of F. A. Thomason, to execute an Agreement for and on behalf of the City of Wichita Falls, with Randel-Presley Chevrolet Co. I Inc. for the purpose of leasing cars to the City of Wichita Falls. Motion seconded by Alderman Hammond and carried. Moved by Alderman Willis that the Board of Aldermen approve and adopt the Plat of the Second Supplemental Addition to Park Place Sdbdivisinn of Wichita Falls, Texas, a copy of which is attached hereto and made a part of the records hereof. Moved by Alderman Mason that the Board of Aldermen approve and adopt the recommendation of the City Traffic Commission, as follows: Install 4-phase parking meters in the area bound by 7th and 10th on Indiana; and Eighth and Ninth between Scott and Indiana; and Scott Street between 8th and 9th; all of which will allow 30 min. of parking tine for 5o, with a time limit of 2 hours. By the deposit of 1, 2, 3 or 4 coins, this will allow 30 min., one hour, hours, or 2 hrs, of parking. Motion seconded by Alderman Hammond and carried. Mr. G. H. Kirby again appeared before the Council to urge the City to assist in paving Railroad Ave. The matter was discussed favorably, whereupon the following motion was had: Moved by Alderman Mason that the Board of Aldermen authorize the paving of • Railroad Ave. from Taft Street to Monroe Street, at an approximate cost of $4136.00 to the City, including street grading, etc., providing the property owners in that area deposit with the CityClerk the sum of $4136.00 as their portion of said paving. Motion seconded by Alderman Lam and carried. lik The County Attorney, Mr. Castledine, appeared before the Council to explain. the deplorable situation now in progress relative to a picture being filmed in the City of Wichita Falls relative to an alleged dope ring among school children, and re- quested assistance from the City Council. Downing, and which is shown on the attached plat. Mr. Downing has complied with the requirement of the Park Board by forwarding a check for $300 to be used in improving a park which will serve the subdivision. The agreement was that Mr. Downing would have the choice of giving 1/3 acre of land or $300. If there are any further questions, please advise me.
