ORDINANCE WAIVING SECTION 27-30 OF THE CODE OF
ORDINANCES WITH RESPECT TO PLACING A SIDEWALK ON THE
SOUTH SIDE OF SEYMOUR HIGHWAY AND THE NORTH SIDE OF
KELL FREEWAY ADJACENT TO THE NORTH AND SOUTH LINES OF
LOT 1, BLOCK 13, BARTOSH SUBDIVISION
WHEREAS, it is the intent of the subject section of the
Code of Ordinances of the City of Wichita Falls, Texas to
provide for the proper and orderly development of land inside
the city limits and extraterritorial jurisdiction;
WHEREAS, the granting of a waiver with respect to Section
27-30, which requires the construction of sidewalks on all
streets with the construction of any building, would not be
contrary to this stated objective when applied to the south side
of Seymour Highway and the north side of Kell Freeway adjacent
to the north and south lines of Lot 1, Block 13, Bartosh
Subdivision.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Said requirements for sidewalk along the south side of
Seymour Highway and the north side of Kell Freeway adjacent to
the north and south lines of Lot 1, Block 13, Bartosh
Subdivision is hereby waived in the case of this development.

Per the minutes from 11/8/1996, this Ordinance was approved with amendments as
follows:
Moved by Councilor Martin that Ordinance No. 159-96 be passed. Motion seconded
by Councilor Hawkins.
Moved by Councilor Hawkins to amend the original motion by denying the waiver on
Kell and approving the waiver on Seymour Highway. Motion to amend was seconded
by Councilor Shine.
Motion to pass Ordinance No. 159-96 as amended carried by the following vote:
Ayes: Mayor Yeager, Councilors Johnston, Shine, Thompson, Daniel, Martin, and
Hawkins.
