COI'SORDINANCE NO. Z l %- AN ORDINANCE AMENDING ORDINANCE NO. 2101 CLOSING AND ABANDONING A PORTION OF AN ALLEY IN BLOCK 3 OF THE L. C. GRANT'S SUBDIVISION OF BLOCK 6 OF BELLEVUE ADDITION TO THE CITY OF WICHITA FALLS, TEXAS. WHEREAS, the Board of Aldermen did on August 10, 1964, close and aban- don a portion of an alley in Block 3 of the L. C. Grant's Subdivision of Block 6 of Bellevue Addition to the City of Wichita Falls, Texas; and, WHEREAS, said ordinance as passed and approved contained a typographical error which the Board of Aldermen desires to correct. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Section 1. That Section 1 of Ordinance 2101 be amended to read as follows. Section 2. That the West 290 feet of the 10 foot dedicated alley which runs between Denver Avenue and Baylor Street in Block 3 of the L. C. Grant's Subdivision of Block 6 of Bellevue Addition to the City of Wichita Falls, Texas, said 290 foot portion begins at the intersection of said alley with Denver Avenue and runs in an Easterly direction 290 feet to a point 10 feet West of the Southeast corner of Lot 7 and 10 feet West of the Northeast corner of Lot 18, and being that portion of the alley which lies between Lots 7 through 12, and Lots 18 through 13, be and the same is hereby closed and abandoned. That the West 300 feet of the 10 foot dedicated alley which runs between Denver Avenue and Baylor Street in Block 3 of the L. C. Grant's Subdivision of Block 6 of Bellevue Addition to the City of Wichita Falls, Texas; said 300 foot portion begins at the intersection of said alley with Denver Avenue and runs in an Easterly direction 300 feet to a point in the Southeast corner of Lot 7 and the Northeast corner of Lot 18, and being that portion of the alley which lies between Lots 7 through 12, and Lots 18 through 13, be and the same is hereby closed and abandoned. Dwyer, who owns the Roseland Apart- ments which are near the proposed location of a Safeway Store. In the plans and specifications submitted to the Planning Board, Safeway Stores expects to close the alley running from the location of the store and to put a portion of the store across the alley. Mr. Dwyer, as the owner of the Roseland Apartments, protests the closing of the alley and will take such action as he thinks may be necessary to prevent its closing. Very truly yours, Otis E. C. Grant Subdivision of Block 6, Bellevue Addition COMMENT: This property of Safeways proposed store location on the Northeast corner of Ninth and Denver has been reviewed by all city departments and recommen- dation for approval was given subject to the following conditions: 1. That the existing 10' alley which is shown abandon by this plat be closed by ordinance at such times as Safe- way Stores Incorporated becomes the owners of this property. 2. That the proper signatures appear on the plat prior to filing. 3. Provisions should be made at the south end of the proposed north -south 10' alley for the turn movements of City Sanita- tion Vehicles and an area should be left free of any obstructions which might interfere with this turning movement. A minimum radius of 36' is needed for the turning of these vehicles and should be shown on the plat as an easement for such turning movements. 4. The title should be Lot 1-A, Block 3, L. C. Grant Subdivision, a Replat of Lot 7 through 17 the West 25' of Lot 18. 5. This plat was presented by Mr. D. E. Cole. Mr. Farlow suggested abandonment of the alley and create an easement. Mr. Jarrell stated that the parking spaces were comparatively small and suggested a greater depth for parking stalls. Motion was made to approve this preliminary plat subject to a study by all department heads and to submit a final plan at the next Board meetiaga Motion was seconded and carried unanimously. Cole was present to discuss this proposed Safeway Store Site at the corner of Ninth & Denver with the Planning Board. Mr. Cole pre- sented a plot plan of this proposed site at the April 15, 1964 meeting and requested that it serve, as a preliminary plat. Mr. Cole stated that they had not completed the purchase of this land but comtemplate having it completed in the near future. He further stated that they wanted tentative approval or final approval so that when the purchase is complete he will only have to appear before the Board as a matter of form, Mr. Cole told the Board that he had received a letter from one of the property owners as to when they would begin to move the existing houses off the property. He stated that it would be 60 to 90 days before they could get a contract to move the houses, Utility relocations will be at the expense of Safeway Stores Incorporated. Mr. Otis Nelson, representing the owner of an apartment house on Rose Street east of the proposed Safeway Site, was present to discuss reasons as to why he was opposed to the abandonment of the alley and the location of the loading dock for Safeway Store. It was explained to Mr. Nelson, that this alley would not be closed and that there would be no problems of garbage in the alley because the company had special disposals for getting rid of garbage without odors or stacking of cans on the dock. Mr. Cole further stated that their produce trucks would only be using the dock two or three times a week and very early in the morning. It was suggested by Mr. Nelson that the dock be moved to the Denver side of the street, but home owners in that area of the neighborhood had objections to this because they felt it would disfigure their neighborhood also. Motion was made to give conditional approval to Safeway's final plat subject to the following conditions: 1. That the existing 10' alley which is shown abandon by this plat be closed by ordinance at such times as Safeway Stores Incorporated becomes the owners of this property. 2.
