requirements of Section 7, Comprehensive Subdivision Ordinance No. 2118. Unless otherwise
provided for, the plat must conform with the preliminary plat approved by the Planning Board and
meet any conditions imposed by the Board.
Under "Subdivision Name" insert the full name of the subdivision as shown on the plat being
submitted.
Under "Engineer/Surveyor" insert the name of the firm which prepared the plat.

The development of drainage facilities including Sikes Lake has been
resolved based on the agreements reached at the meeting of Sikes Senter
Developers, Midwestern University and the City of Wichita Falls, held
in my office on May 19, 1975. Midwestern University and Sikes Senter
Corporation, the current owners of the property on which the drainage
improvements are required, have agreed on a method of jointly resolving
the proposed improvements.
Based on this agreement and the assurances of full compliance with sub-
division regulations, the City of Wichita Falls will allow development
in accordance with those regulations. The approval of building permits
and certificates of occupancy upon completion of construction will pro-
ceed as provided for in the Code of Ordinances. The recent restriction
on new permits and final acceptance has now been removed by the City of
Wichita Falls.

Your letter of April 15, 1975, has been received and your comments investigated
as to the City of Wichita Falls' position on the Sikes Senter drainage require-
ments. The subdivision regulations of the City of Wichita Falls requires that
whenever a subdivision is traversed by a water course, drainage way, natural
channel or stream, there shall be an easement or right-of-way confirming sub-
stantially to the limit of such water course, plus additional width to accomo-
date future needs. Drainage facilities shall be provided and constructed by
the subdivider as approved by the Director of Public Works. It should be noted
that the original subdivider of this property, Mr. Louis Sikes, provided the
City of Wichita Falls in 1966 with a subdivision plan which included the drain-
age and street paving plans prepared by Hare and Hare, Inc., consulting engin-
eers, which included among other items, the improvement of the drainage channel
and the subsequent operation of Sikes Lake at elevation 960. It was on the
basis of the plans submitted that, on December 14, 1966, the Sikes Senter plat
was approved. The reason the plat was accepted was the submission of street
improvement and drainage plans approved by the Engineering Department and the
Director of Public Works in accordance with the subdivision regulations and as
submitted by Hare and Hare, Inc.
Again, on May 24, 1973, it was pointed out to the current developers that the
street improvements and drainage plans must be submitted for approval prior to
the beginning of any construction. Again, the developer chose to submit the
design of Hare and Hare as their development plan, those plans which included
the 960 elevation for the operation of Sikes Lake. Inasmuch as the entire
development of Sikes Senter and the surrounding area has been dependent upon
the design and operation of the drainage facility in accordance with the Hare
and Hare plans, the City of Wichita Falls has relied upon the integrity of the
developer to complete those facilities in accordance with the plans submitted.
The subdivision regulations of the City of Wichita Falls includes the following
statement:
''The City shall withhold all City improvements of whatsoever nature
including the furnishing of sewage facilities and water service from
all subdivision, which have not been approved as provided by law and

further, no permit shall be issued by the Building Inspector of the
City on any piece of property other than an original or a re -subdi-
vided lot in a duly approved and recorded subdivision; inspector may
issue a temporary connection of utilities permit for construction
purposes and only during the time of actual construction on unplatted
tracts of land if the owner of such property will sign an agreement
stating that he will forthwith start proceedings to have such property
approved and platted in accordance with these regulations and futher
acknowledge his understanding that a certificate of occupancy and a
permanent permit for connection of public utilities shall be withheld
until the platting of such property has been so approved and recorded."
The City of Wichita Falls allowed the development of Sikes Senter to continue
based on the assurances that the developers would complete the plans as sub-
mitted. That assurance now has been withdrawn upon receipt of your letter of
April 15, 1975. In accordance with the provisions of its subdivision regula-
tions, the City of Wichita Falls has no alternative but to withhold building
permits and certificates of occupancy on any outstanding permits in the Sikes
development. Except for the provisional permit given to Topps and Trousers
on Friday, May 2, 1975, no additional permits will be issued. There are cur-
rently two outstanding permits in the Sikes Senter area, i.e., the theater and
Perkins Department Store. In addition, on the Sikes Senter property the
Skaggs -Albertson building currently has an outstanding permit. Based on the
conditions existing with the development of Sikes Senter, no additional permits
will be issued for new construction nor will certificates of occupancy be gran-
ted to the previously mentioned permits as currently outstanding.
In order that all may fully understand the extent of the subdivision regulations
not currently fulfilled at the Sikes Senter development, those items needing
immediate attention and prompt completion are:
(1) The development and operation of Sikes Lake at elevation 960. It should be
noted that the Sikes Lake elevation of 960 can be accomplished with a mini-
mum of construction and effort realizing, of course, that to do so would
effectively destroy the lake for usefulness by Midwestern University. This
is a matter of cooperative effort between the two individual owners based
on the provisions of the single owner at the time of preliminary submission
of the construction plans for the drainage improvements.
(2) Completion of paving on Maplewood including the removal of sections on the
south bound lanes where failures have occurred.
(3) Completion of Elliott street, removal of defective material and completion
to City standards.

(4) Submitting a final plat, removing unused utility easements, providing a
current and accurate description of those easements occupied by the
utilities and providing additional dedication of right-of-way for Mid-
western Parkway as previously agreed. A revision of right-of-way line
to correspond with new alignment on Elliott street should also be in-
cluded.
Upon completion of the foregoing items, then the Sikes Senter development will
be in compliance with the subdivision regulations and will have freedom of
building permits and utility connections as prescribed in the subdivision
regulations.
The City of Wichita Falls is aware that there are certain limitations with
regard to freedom of control of the entire project as originally submitted
since Midwestern University is currently the owner of Sikes Lake, and has
certain control of the development of that area. The City is also aware that
there are certain legal obligations on the part of both Sikes Senter Develop-
ment and Midwestern University to see that the original plans are completed in
accordance with the provisions of the subdivision regulations and as designed
by Hare and Hare, Inc., and submitted by Louis Sikes, the original owner of
all the property.
The City of Wichita Falls has endeavored to expedite this matter on numerous
occasions, and have repeated our original proposal that if alternate plans for
the drainage should be developed, we will investigate and evaluate those alter-
nate plans. One suggestion to the original plans was a diversion of the channel
around Sikes Lake. Some concern was expressed that the Lake would not be ade-
quately served to provide a reservoir such as Midwestern University would hope
to use. It is our opinion that adequate runoff will be available from the north
source to keep Sikes Lake at a useable level the year round. This proposal does
not depend upon any alterations to the lake and provides only a minimal amount
of construction on Midwestern University property, and certainly will not involve
any of the property currently utilized by the University. Again, let me empha-
size that in the absence of any alternate plan, we must rely on those plans as
currently held by the City for the development and insist that they be completed
as submitted.
It is our firm hope that a timely and advantageous solution will be forthcoming
at the earliest possible time so that the schedules and construction of the
development plans can go forward. Please contact this office if any additional

This agreement made and entered into this the 20th day
Of September , 1977, by and between the City of Wichita Falls,
Texas, hereinafter called City, and Sikes Senter Corporation
and Robert Seabury, hereinafter called Subdividers,
WITNESSETH:
WHEREAS, Ordinance No. 2118, the comprehensive subdivision
ordinance of the City of Wichita Falls, requires that all
subdividers set aside land for park purposes when the master
park plan of the City shows a park is required in the area
to be subdivided; the ordinance provides that the City shall
be granted an option to purchase the land so set aside for
pair: purposes; and,
WHEREAS. Devel-ogers have filed —with the City the loth
Preliminary Plat of Midwestern Park, a subdivision of the
City of Wichita Falls, and the parties desire to formalize
the option which the City has by virtue of the above ordin-
ance for park land out of the area of 291.946 acres covered by
such preliminary plat.
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE PREMISES
and mutual covenants herein contained, and in compliance
with such ordinance, the parties hereto do hereby agree as
follows:
Subdividers do hereby grant to City an option to purchase
for park purposes the following described land situated in
Wichita County, Texas, to -wit:
All of Block 16,of Midwestern Park, as shown on the loth
Preliminary Plat thereof dated June 30, 1977, prepared by
Biggs & Mathews, Inc., which plat is on file in the Planning
Department of City, save and except that part of Block 16
which lies south and east of a line running from the most
westerly corner of Lot 34 of Block 2 to Miller Road, which line
is perpendicular to Miller Road,; such tract contains approxi-
mately six acres of land.
City must exercise its option to purchase such land with-
in sixty days after such time as 140 single family dwelling
units (including town houses and patio houses) have either
been built or are under construction within the total area
of 291.946 acres covered by said preliminary plat as shown
in the field notes thereon. Subdividers shall give written
notice to City's Director of Planning stating the date on
which such 140 single family dwelling units have been con-
structed or are under construction.
If City fails to exercise this option, the option shall
-- - Larmin.ate, and Subdividers may proceed to develop the land
in any way authcriced--by the subdivision nce, with no
further requirement concerning park lands in the area covered
by such preliminary plat insofar as Ordinance No. 2118 is
concerned.
To exercise this option, City shall give Subdividers
notice in writing within such sixty day period, delivered
by certified mail or by hand, stating the fact that it does
exercise its option. If such notice is sent by certified
mail, it shall be sufficient if the notice is actually de-
posited in the United States mail within such sixty day
period. If City does exercise its option, the purchase
price to be paid by City to Subdividers for such land shall
be the sum of $5,000 per acre cash. The actual quantity of
land contained in the tract shall be determined by a licensed
land surveyor. In addition, City shall pay its pro rata part
of all development costs attributable to such park land
including abutting streets and utilities necessary to serve,
such park land.
Subdividers shall furnish to City either a complete
abstract of title to said property, or shall furnish a policy

of title insurance. If abstract of title is furnished, City
shall, within ten days from the receipt of the abstract,
either accept the title or return the abstract to Subdividers
with written objections to the title. If title objections
are made, Subdividers shall have a reasonable time to cure
such objections.
When the title objections have been cured, or when the
title company approves title, Subdividers shall deliver a
general warranty deed conveying to City good and marketable
title to the above described property, free and clear of all
encumbrances, and City shall pay to Subdividers the purchase
price.

Mr. Sam Edwards presented the plat to the Board. It was felt that the
plat satisfied all the requirements of the Planning Board with the exception
of one. The Board asked that East Elliott Street be extended to connect with
the existing improvements on Kemp Boulevard. Mr. Edwards agreed to do this.
Maplewood Avenue will have a lake in the middle of it which will become
the property of the City and will be maintained by the City. The master
plat shows the drainage inlet and outlet of the lake.
A motion was made to approve the plat of Sikes Senter and dedication
of East Elliott Street and Maplewood Avenue subject to the extension of
East Elliott to connect with the present pavement on Kemp Boulevard.

SUBJECT: Final Plat of the Sikes Senter
This office has reviewed the final plat and construction plans of the
subject addition and recommends approval subject to the following
conditions:
1. A revised master plan showing the modified location of
Maplewood Avenue and Elliott Street should be submitted to
and approved by the Planning Board prior to recording the
final plat. Although a master plan has been submitted
previously, a revision is necessary at this time in order
to ensure compliance with an overall general plan.
2. The developer should make arrangementsfor the construction
of the culvert and pavement necessary to tie East Elliott
Street to the existing construction on Kemp Boulevard.
Additions to the construction plans should be submitted
which would show this construction.

At the regular meeting of the Planning Board held July 15, 1964 , the following
action was taken concerning your final plat of Sikes Center, Section 1/
Motion was made to approve this plat subject to the conditions listed.
1. The Surveyor and Notary seal be placed on the plat.
2. That the fifteen (15) foot dedication for Archer Street be labeled as a
fifteen (15) foot dedication for street purposes, and that the proposed
property line be labeled new property line.
Motion was seconded and carried Inanimusly.
If revisions are required by the Board action, I will need a revised sepia and two
(2) blue or black line prints of the revised plat for approval signatures from the
Chairman and Secretary of the Board. When no revisions are required, I will have
copies already in my office signed and ready for you to record. Approval of your
plat expires AuiNst 14. 1964 If you do not record this plat with
the County Clerk on or before that date, you will need reapproval from the Plann-
ing Board before recording.
